    Hi All,

    I need advise on how should I proceed with my case; I filed my I-485 including my 5 dependents by myself. NSC received all the 485 package on July 02, 2007. Like everyone else, I was waiting, waiting and waiting for my check to be encashed. After I read the USCIS weekly receipt update, I was already sensing that there was something wrong with my application and then it happened... we received back today, 8/27, all our application :(::mad::( with USCIS stating that our application was rejected due to incorrect fee :(:(

    Here's the problem; I overpaid one of my son, who at the time of my filing is still 13 years old but would be 14 on 8/8 (remember i filed on July 02). I paid $395.00 for his I485. USCIS stated that I should be paying only $225 because he still under 14 years of age at the time of my filing. And adding insult to this mistake was that I only wrote one check for all of us. My bad. If only I wrote each check for each application, I would probably have only one rejected application. All because of my ignorance. I thought all my bases were covered. :(

    So then my dilemma is this; should I pay under pre-July 30th fee or the post-July 30th fee??? :confused::confused::confused:

    I know part of it is my fault but part of it too is I blamed USCIS for taking so long in replying... I might be able to pay it before Aug 17th. Now, I don't know if I can afford to pay the newer fees.

    Please share your thoughts.

    I wanted to post a question along the same lines. I'm planning to get a visitor Visa processed for my mom. She lives with my brother in India. My brother is the only son she has and my father passed away a few years ago. I have another sister who lives in India.

    My brother might be coming her on B1 in the near future. will it be a problem to get Visitor visa for her if my brother also comes here?

    Please share your ideas and experiences if any...

    Even if large number of people porting their Priority Dates is true, its not easy.

    These days, typically it takes 1yr for Labor Approval and another 1yr for I-140 Approval.

    So it is like 2yrs of waiting at least for people who are trying to port.

    1 year for PERM. This can not be true.

    Imagine the person's relative had been run over by an illegal with out a DL. That was why he/she is in the hospital. Then how would we feel about the law?

    Lets say a person has a relative in emergency in the hospital which is 20 mi away, he is stopped once in a certain area in the suburb, he has all the papers, the cops takes 20min to check and then lets him go. Three signals later another cop suspecting him to be an illegal stops him and asks for papers, it takes 20 more minutes explaining to him that he was already pulled over just a few minutes ago, he say's he's sorry and lets him go, by the time he reaches the hospital it is too late.
    For the next few months this person is stopped almost daily, however since he is legal , he shows his papers and explains it to him about his status. On a certain 'legal' immigration extension, his papers were late , although he is not out of status, he has no valid documents, he was pulled over driving on the highway and has been put in custody to be deported.

    Now think about this, you say you are comfortable with the law ?, can you imagine yourself in a situation above ?, if you can, you need to join AZ government which thinks like you.

    Hey,

    I myself Being AMIE graduate understand your pain. I agree with nice guy doing self study and preperation with not much guidance it is very difficult course to complete.

    May be you can try another evaluation agency and do the appeal.
    Generally they convert EB 2 t EB3 if they accept the evaluation.
    Not sure why they rejected in total, may be they will do so in appeal process.

    There should be an international law/treaty/convention that requires countries to accept/approve/deny visa/immigration applications within a timely manner. The countries with the least resources to approve such applications would probably have low demand to immigrate to that particular country and would not need to worry about funding its immigration centers. The mental torture is inhumane, prisonors at war almost get better treatment under certain international conventions/treaties/laws.


    You are exaggerating. This is not a mental torture. In fact you are in agood position as a skilled person to find your avenues in many other countries. Not getting gc is not end of world

    This country has to decide whether they want high skilled educated people coming here or low or NO skilled family immigration?

    If they want former, they have to address the issues for which IV is fighting.

    I see many family based immigrants coming with ZERO skills only to become burden on the system specially in this economy.

    One person will bring the whole village with him/her.

    I know a famly in which one person came here 20 years back. Now his father, mother, 6 sisters and two brothers are here with their spouses and kids. His wife's parents, sisters and brothers too are here with their spouses. Most of them have No education and No skills....Now most of them are unemployed!

    There would be many such cases.

    While there are close to Million people with jobs and skills waiting for their GC for years and may keep waiting for another few years.. in the mean time the family mentioned above shall be sponsering their next generation in family based category..

    Give me reds. I dont care.

    You as a skilled immigrant will 1. Not probably have too many children as you know that you probably won't have time to give them 2. You are too busy and stressed with your job to have such a high fertility rate anyway

    So where is the incentive for the politicians to support your cause. They'll just say that since you can find a job in the USA, you can also find a job in XYZ country and your stress is hardly the same as relatives separated by borders (never mind that the same relatives reunited will have more drama than a soap opera plot :D)

    We all know that the immi system of the US is a big joke. That's why we are at IV.

    On the record - nobody gave anyone false hope. Canadian Dream is simply distorting the truth by saying that anyone of the core team gave false hope to anyone. IV has always been fueled by a sense of urgency and not just in recent months as Mr./Ms. Canadian Dream claims.

    I want to clarify something. First of all, there's a reason why the lame duck session is called a L-A-M-E D-U-C-K session. Let's get this clear - it isn't a session where Congress typically introduces new bills, as I understand. Appropriations bills come up for discussion and voting, and this particular year, I believe the Indo-US nuke deal will be voted upon in the Senate.

    The fact of the matter is that comprehensive immigration reform (CIR) is the only way that this will be possible, and to those of you who are keenly observing politics and following the campaign leading up to the upcoming elections, it must be obvious that if the Democrats do take over the House and/or Senate, then they will set the agenda. Nothing new or drastic can then be expected until the next Congress convenes in early 2007. CIR is not about to come up in the lame duck session. When it comes up is up to the Senate Majority Leaders and the House Speaker. Please put two and two together, after recalling the fact that both these posts are potentially up for grabs in the Nov. 7th elections.

    Yes true. Otherwise Mukesh Ambani / Steve(dont remember correctly) would not have gone to top schools. They dropped it too and ironically they are the top two sucessful candidates now from their batch.

    Ambani has inherited success :) So there is nothing ironic about his success despite dropping out. Actually, it has nothing to do with either getting into an MBA program or dropping out or whatever. If you have that kind of a background, go for an MBA, sure, although it is not needed really!

    Also, someone else said (on another thread) that he/she got an MBA from Babson College for 30K (the employer paid the remainder of the fees). That is a very good deal ... the cost is equivalent to buying a BMW and you get a degree from a well-respected school. Definitely worth it.

    I know of some people buying BMWs because their spouses wanted to drive around in them. Getting an MBA from a good school from the same amount of money is definitely a better idea. But spending 100K (or getting a loan that big) is not a very smart thing to do. Just my 2 cents.

    I agree that they would need to fix the root cause for sure. Any type of perimeter security must be backed up by policies enforced by upper management.

    The physical security is just one component of this whole equation. Personally I would solve this very easily;

    Put the fence there. Enforce common immigration laws such as the ones that exist in your country. Simply use the system that is already in place and let in more permanent residents, both skilled and unskilled to perform menial jobs. Relatives of unskilled people already here could just petition to bring family members who prove a certain level of education and skills as is happening right now. They just need to increase the visa numbers ! Increase the visa numbers from 1 million to perhaps 1.5 million/year. Guest-worker programs do not work. For the "guest-workers" who crossed the borders illegally, they've already made money and enjoyed their staying here. As immigration laws are enforced, many people would gradually go back home. Many others would get deported occasionally.

    You will see how things should improve to us as well. Many people in this forum do not realize that illegal immigration is our problem as well and has impacted us directly.

    Yes border should be fenced BUT this alone will not fix the problem.They will find more innovative ways to come in.

    You are an IT manager and you must be knowing that unless you fix the root
    cause of a bug, and provide broken hacks and work arounds, the bug will keep coming in other forms.

    Root cause of them coming here is that there are Jobs here and they easily get jobs here. As long as they keep getting jobs here, they will keep coming.

    Just imagine for a second that No illegal gets a job here.

    Will anybody still risk their lives coming to US illegally?
    Will those who are already here still stay here?

    First make sure No illegal gets a job and then if American employers need
    workers make laws so that they can easily and legally hire workers.

    I did what all is possible from my side i.e calling all the sponsors for the bill, contributing to IV and being ready to share any expenses incurred if anyone wants to pursue sue USCIS.

    Most of the people are selfish - Survival of the fittest. They want solutions that benefit them. For ex: EB3 folks around 2002-2003 say they want oldest priority dates first irrespective of EB category.
    EB2 folks who have their dates current or already got GC, want gap between EB2 and EB3 no more than 3 years. They would not ask for this when they are waiting for their PDs.

    No one wants to fight for general cause like
    1. Visa recapture (law change)
    2. Dependents do not count on EB visas (law change)
    3. Allowing all approved I-140 applicants to file for I485 so that applicants and spouses can get EADs (Admin fix)
    4. Increasing country limits for severly retrogressed countries
    May be more which will help everyone.
    5. EB1C misuse in the name MNC managers - crap!

    EB3 folks are worried that EB2 folks will get GCs but they do not worry about EB1. Misuse of EB1C, EB2 or other exploits. Typical mentality that it is okay if we suffer but others should also suffer.




    USCIS is not wrong in any way. and yes there is sympathy for EB3 folks. But the problem is EB3 wanting some quota from EB2 and naturally EB2 will not support. This would have been the same from EB3 folks had the spillover flown to EB3.
