You have to consider the family factor (2.4 visas / applicant)...
    Then the 5000 becomes 12000.

more realistic is 2-3% . 5% is max - sample data in trackiit.

I am guessing close to 8-10K EB3-I Pending in 2002.

the only solution is congressional push for visa #s recapture, after this recession frenzy settles down.

:p:D;) so u suggest we wait till the recession frenzy settles down (maybe after five years, I am just trying to be optimistic here;)), and then wait for congress to push for visa #s (and hope there won't be any horses or other four or two legged animals who beat us to the finish). Hmmm....pls give urself a high5, lets make it high6, 7, 8 because buddy, we will be here for a lot of years....doing nothing but waiting.

    Everybody,

The draft of the letter is on google docs. Instead of giving any suggestions here, you can directly edit the document for everybody if you want to (that will be of more help). Just keep in mind keep it short and sweet. If you want to customize it for yourself only, then do that for yourself on your local computer. By the way, I am still waiting for the list of addresses. I have kept that area also in the draft, please post any addresses if you have.

    here is the link
    http://docs.google.com/Doc?id=dd4vkcmm_140ftnwd26b&invite=1870524266v

Many thanks. (Please PM me if you cannot view it or edit it)

Financially BMWs or Lexus or Acura are never an intelligent buy irrespective of age.

Luxury or higher end cars can only be bought for
    1. Attitude
    2. Business Development

This is what every advisor tells. Car is always is expenditure.

But recently I started to think that Car can be investment. Every day the most riskiest time I spend is during driving to work. driving home. small mistake would cost life.

So If I making lot of money I would rather buy Hummer or BMW 7 series which are solidly built to protect me if an accident occurs.

    What ya guys think.
For you I would say a 2003  Ford F550. Safest and a killer machine. You would steal the show when you park at your work place :).

    1) I have had a very painful experience with Immigration Lawyers

    2) Every document they need to send to USCIS, needs to be reviewed else there are many errors.

    3) Getting them to respond to emails or phone calls is next to impossible. Even when there is an emergency. Half the time they
    don't understand the issue.

    4) They know that we will be averse to firing/replacing them half way in the process (if at all your employer gives u that option)

YEs. I AM INCREASINGLY THINKING THIS IS JUST NOT WORTH IT. UNSCRUPULOUS LAWYERS. APATHETIC EMPLOYERS ET AL.

    **************************************************

Look at a leading Immigration lawyer online, being a so called bellwether or atleast self publicised incessantly, they did not do anything to help reduce retrogression. Not so much as even support the cause. But they want all of us to sign petition to increase H1. Duh ! How much more money do they want to make and they routinely talk about giving back to the society. If you are genuine to give back to the society put aside your money making motive. Say enough to money and do something that will help half a million deserving immigrants. Don't forget, you yourself were an immigrant before you setup your law firm. You just happened to be lucky, the process was easy for you.

For once show genuine interest devoid of gains and do something. You will gain true admiration and respect. Then you will not need to publish weekly bulletins publicizing your philanthropy to show how great you are. The immigrant community will decide your greatness by your actions, not by your bulletins.
    Those naive days are over.

I feel stuck after signing a contract for 18 months too. The breakage clause indicates that I have to repay the GC expenses, cost of finding a job and loss/replacement costs. The first atleast can be calculated but the next two I have no idea what they would ask if I break.

Has any one experienced the same and have any suggestions how to tackle this situation? Can an employer come after you and quote a 10K bill if you break the contract prior to 18 months? I have worked for 10 months and have 8 left.

I dotn think they will 'come behind you' - by doing this they will only spoil their name and I strongly feel no one can be 'forced' to work. But I need opinions from other members.

Worst case they can sue you if you signed a contract but that also means a lot of expense for them. At the end they may end up getting 2K for the 10K you owe, so probably they will forget it.

Also remember that employers NEVER cancel H1Bs after they are transferred to a new employer simply because it costs them and they get a bad reputation in the eyes of the DOL.

yesterday: I spoke to once CS officer at TSC. She vehmently said, RD on AOS receipt Notice has nothing todo, as it merely represents the courier delivery date. She says, the Receipt date as appearing on Online Case Satus verifications (again, more or less the Notice Date), holds good for your application to be assigne to an IO.

I amnot sure, if that is the case, how many EB2 PDs though current, can be cleared,as TSC is still at July 17 2008 process date. Especially cases, transferred between NSC <-> TSC where your Receipt date of July 2nd, is royally screwed up. Donot know, how far the CS is correct on this

    Let's hope for the best

But the question to ask is how many of those 20K+ apps were EB2. It is likely that most of them were EB3 (which is unavailable at this time).
I think the USCIS would sort apps according PD and then by RD in each category. Then the apps are assigned to IOs in that order. But since processing time on each application varies, it is likely that the application a bit later down that list is approved first...

It is possible that an app later in the list gets approval sooner because the IO is more efficient, app easy to adjudicate, or in a different service center.

    Guys,

I was wondering if I can work on campus (less than 20 hrs/week) while my AOS is pending? I am on an F-1 Visa and I recently filed for AOS as a dependent on my wife's application.

My understanding is that I am still on F-1 visa as long as I do not leave the country and meet my F-1 requirements (ie working less than 20hrs only on campus). Am I right?

    Regards,
    Hello:

Yes you can work on campus 20 hours as long as you are meeting F1 requirement. If you have student visa stamped with multiple entries you can travel out of the country.

EAD card is required to work 40 hours a week. Generally students apply for OPT card at the end of their education for practical trainning.

    I hope this helps.

So, keep up the faith. I think They've started to make the move, and to issue approval notices for all July applicants.

As I said earlier, there is a reason why NumbersUSA/AILA also ask us to click for webfaxes instead of automating it. This is a grassroots organization with each one having an equal stake.

We do not want to be sending a webfax just for the heck of it. When a user sends a webfax, he/she reads the content. That way, they know whats going on. When the right opportunity comes, they might be able to talk to lawmakers about it or maybe convince a few friends too.

I have got calls a couple of times from lawmakers office when I sent them fax (during S.1932). If I had just set up an auto fax and not read about it and then received a call, I would not know what was going on!

The lawmaker would then get the impression that these are all fake webfaxes and hence need to be discarded. Then all the faxes (even legitimate) coming from other members would end up in the trash can!

This is as much for the lawmakers education as it is for ours.

Point well taken Ragz. On a similar note, initially when we used to send web faxes, we got a copy of them in our email. It is not happening now. Is that intentional or an error?

USCIS website has the answer to your question:
    http://www.uscis.gov/files/pressrelease/FAQ2.pdf

For your second question, I don't think it would count towards a prior EAD because the first one expired already when you started using your H1. Good luck!

    1. My lawyer said that I need the 485 receipt notice to file for my EAD. But someone commented that if I have the courier proof of 485 filing then I can submit my EAD application. Is that true? Can someone please validate that?

    2. I had an EAD for my practical training period after my MBA. Does that count towards a prior EAD request as asked in the form?

    Thanks and Regards

I think your sample size is very small. I know a few H-1Bs who are scientists with leading firms like SAP and IBM; strategy consultants with Bain, BCG or McKinsey; investment bankers on wall street, other business executives and medical professionals. They also have outstanding academic records in India and the US. And yes, many Indians are intelligent and competitive. If you are interested in getting an outsider's perspective of India and Indians, I recommend "The World Is Flat" by Thomas Friedman - it's a good use of time while you are looking for a job.

    All the best.

    GG_007

I am a passive member of IV. I am not sure what is tempting me to write all this, maybe because at this point of time I am out of job pool and finding hard to spend time :).

My objective is just to express my opinion not to hurt anyones feelings

When I was in school, Teacher used to teach about the difference between developed and developing countries, poverty in Nigeria and Somalia, Economics of Japan, Population explosion in China and India, details about continents and pacific oceans. Most of the crap I was never able to understand I just mugged up for examination, until I grew old enough and got the actual opportunity to visit several countries of the world.

Credit of this real learning goes to the globalization and vision of Late Rajeev Gandhi of bringing Computer Education in India. I am from middle class family and cant even think of visiting USA, UK, Japan, Australia. The number of International Airports I have visited outnumbered number of railways stations I have visited in India and all this happened because I am in IT.

We Indians (I am just trying to be unbiased :D) say that US Immigration System is broken. Well its not US Immigration Systems fault, majority of H1B/GC applications are filed for Indians, which created this queue. And again dont tell me that Indians are intelligent, 95% of H1B/GC applicants do normal routine work of bug fixing, support and minor enhancement, which includes me also.

The original intention of US Immigration System for creating H1B was to provide real talent to US economy, which exactly is not happening because either some Indian company would file significant number of applications to provide cheap labor of 21st century, or some Indian H1B candidate look for ways that his B.Com passed spouse could get H1B with some fake experience and certificates so that she could work in IT which would never happen because she is already pregnant and finally it would be a waste of One H1B visa. Sorry for being so blunt but I know several such cases where this happened last year and genuine candidate lost the opportunity to get the sponsorship.

The same is applicable for GC process also I mean EB1/EB2/EB3 but we Indians try to look for ways just improve our chances to get GC fast.

Just to make this real short as this is getting boring now :(

Thanks to July Fiaso We and our Spouses got EAD, which is as good as GC. We should concentrate to make it multi year. This is not to discourage, keep on putting efforts for other pending bills who knows when any next miracle like July Fiaso happens.

Last but not the least enjoy your life, who knows by the time we get GC we wont have jobs in US, the way globalization is trending.

    Kondur,
I completely agree with what your "anti-amnesty" source stated. However, the main reason this issue has to be considered to some resolution is because kids are involved. Children who are either born here or migrate along with their parents ilegally are caught in between and have no place to go and no country of their own. This becomse even more painful when raids lead to seperation of the parents from the kids who are pretty much orphaned at this stage. This is the tragic situation which requires some sort of resolution. Otherwise the best way is as you suggested to tolerate the ilegals without making a big fuss of legalizing them. Anyway there is no simple solution. The policy makers can avoid this now but some day soon they will be forced to look at this issue right in the eye and face it. The Arizona law is just one of the signs that it is an issue that needs careful and immediate attention.

Yes, in the same boat, mine showing " Initial Review" still as I did not get any RFE. Priority dt July 25th 2006

I am in the same boat as well. I went through the thread for May 2011 approvals and it seems a lot of them started receiving approvals in the first week of May. There is also a sticky advising us what to do. I plan to wait till the 15th or so and then play it by the ear. Please let me know if you guys have any suggestions.

Arizona Law is equivalent to Racism in action. Like how Britishers use to rule the Brownies.. and most republicans are for that, they don't understand that the real native people are the so called "Indians" here (Red-Indians) these racists destroyed them and their culture! The President is really playing politics with what he has in his platter, planning to introduce the CIR only just before elections.
