I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?
I realize that the question is a little weird, I appreciate any response.
Thanks

I thank all new contributors, I think the efforts from members in the last 2 weeks are truly inspiring.
If you haven't done already, please consider contributing and donating some money to IV. It is entirely run from our donations (and the shortfall made up by the core team).

I am not trying to question the dedication of the folks here, but I have not see any plans or goals set for this year.Is this because of election year?
The site has become one more forum site to discuss personal issues and to vent out our immigration frustrations. We seem to be losing momentum on the larger effort of Visa Recapture or even looking forward for any new bills? Well even if we consider that there would be a change in white house, doesnt the senate and house still be intact with the members.
Does IV work with CompeteAmerica or any Lobbying group which could help us with direction?
Just my thoughts for the day.

Fatjoe,
Thanks for your response. Wow that's quite a grill. How many days of notice did u get prior to the interview? Did you get any RFE previous to this interview.
Did you ask her any questions? Like if the case stands preadjudicated or not or if they will need more info in future?
Going by the questions, it seems she asked all that she can ask for.
Best,
SoP
You're welcome. I came to know from the forums that you would know well in advance (i.e) a month before the interview; I got the interview letter too a month a head. No, I did not get RFE before the interview. The interview was for my spouse, and the DAO said that my spouse might have to go for the second FP, and spouse(alone) did receive the second FP notice a few days after the interview.

One Psycho gave me this red dot for posting my interview experience.
I'm really happy to hear this. Serves you right for making calls and taking InfoPass all the time. You are unfairly trying to get ahead of others and lowering the productivity of USCIS. Let them work.
See the attachment for screen shot...red_by_psycho.jpg and enjoy.
Hey..Sicko..get some help.:D:D
Also, my message to you..
Instead of me letting USCIS do their work (in a way, i am calling them to remind their work..or probably you should tell IV folks to shut down everything and let USCIS do their work..a**hole....) probably you can quit job and go back to your country..I am sure you will do a great job of Lorry driver or cleaner (their psyche seems to match yours..sorry, lorry brothers no offense to you)
I guess you can shut your pie hole now..

I hope it went through without any hassles.

How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".
EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.
You are critizising H1B indians and their employer screwing the system which is not relevent to what we are talking here. If you feel so, then attack who ever spoiling the system and regulate those. Instead you are trying to justify your interperataion is right and what DOS is doing is right. I will be the happiest person if they ban labor subsitution and ban desi consulting companies or H1B dependent employer participating in GC sponsering. Then this mess might have not happened.

dude, you sound viscious. You missed his/her point.
His/her point is EB catergory does not depend on advanced education as claimed by your earlier post.
and i did not claim that either. the EB category is based on the job requirement, it is therefore natural that a majority of people that apply in the category also have qualifications that match that requirement. therefore the wonderful solution offered, ie ignore EB category and give GC by PD only, does not work. it would be very unfair to a lot of advanced degree holders that are actually in EB2.
also that is not all that he/she is saying. read his/her posts a few times, maybe they will sound "vicious" too. as for my posts, the facts are what they are...even if you do not like them.
just because the two of you have advanced degrees does not change the facts. btw i have sincere advice for you, something i do not bother handing out a lot. your PD is 4/04. your qualifications are excellent. go and find a job needs your MS rather than short changing yourself. you will be current in EB2 and you will have a GC as soon as the I140 is approved. in your place, i would be doing that asap. of course i do not know your situation. but i hope you will find that opportunity.
its a better solution than moaning about why "EB3 is not discussed on IV".
for the last time, this time really so. this thread is meant to discuss other things. do not force me to close it.

Thanks for posting the link.
1.4.6 A pregnant inmate shall not be restrained while in labor, while giving birth, or during the post-partum recovery period, unless requested by attending medical staff or as specifically directed by the Warden. If restraints are necessary in any manner under such conditions, they should be the least restrictive type possible to remain consistent with sound security practices.
So the warden can still order restraints.
The Sheriff or his officers are not Wardens. A Warden(the head of a prison) can order it if the inmate has demonstrated a history of assaultive behavior or escaped before. Neither applies. And the restraints have to be the least restrictive, not have both legs and hands shackled.
Dude its apparent that you are a moron.

first: my use of an extreme example to explain the EB category difference seems to have caused misunderstanding and offence among some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intresting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thread?

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.
One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?
.
Obama enjoys a high rating because of the cyclical nature of US political landscape. To understand the current political situation, a trip down history lane is important. Historically for the last 300 odd years, the country has two broad sections, believing in almost diametrically opposite philosophies. Federalists and Democratic-Republicans. Federalists believed in a strong central government whereas the Republicans believe in more power to the people and believed in self-regulation. Over the years, the tone/tenor of these parties have changed but the core beliefs have remained the same. Liberal Vs Conservatism, Tax cuts Vs Spending, Giving benefits to the comman man Vs giving benefits to small busineses who in turn will help the common man.
Obama's future success lies in how much he can pull the democratic agenda of 'helping 95 % of people who are middle class', building educational infrastructure, taxing businesses while spending to help the 'common' man, reforming healthcare while keeping deficit within acceptable limits ($500 billion maybe perfectly acceptable). A certain section of the republican party (read Bush+Cheney and gang) caused the republicans to take huge losses and gave Obama the boost. Tomorrow it can be Reid+Pelosi+Clinton who can cause the downfall of the democrats by over-doing the 'welfare' agenda. Thus I called it cyclical.
Yes, we can learn from our surroundings. But it is a little bit more complicated than what meets the eye.
BTW: I am neither challenging you nor calling you names. Just gave my 2 cents.

First of all let me thank all of you who responded to this thread positively or negatively. I have a humble request. Please make sure that the comments that you post in this thread are not finger pointers to anyone else in the community. Please provide your positive or negative comments about this idea. Also make sure that your comments are not cynical ones which will just put this idea into the dust bin. If you can't motivate, please do not discourage others from getting some motivation and giving motivation. Without positive energy and a conducive environment, we will not achieve anything. If you have high cynical opinion, please hold that with you - as it will help you as well - because by doing that, you are helping this community to work on an issue with positive energy. If there is some positive outcome of the effort by this community, you too can enjoy the fruit. So, my point is, your biggest help would be keeping quiet. Lets have a constructive and productive brain storming.
Even after this brain-storming, if our conclusion is negative, we should not give up. We should continue to work on this and if this requires a legislative change, still this may be an easy one as it wont add any new GC numbers to the existing quota. This just removes the UNCERTAINITY surrounds our life. What I meant was, there wont be much ammunition that the protectionists and anti-immigrants can gather against this effort.
I can completely understand the user Gangutelis frustration. He has a very valid point too, with respect to applying for I-485 when dates are not current. As I quoted earlier A journey of a thousand miles begins with a small step.. So, we should continue this effort in small steps instead of a big bang method. In this current economic environment, if our proposal is too big, it could get ignored within no time. Administration will say that, we will do this along with Comprehensive Immigration reform or something like that. We may add a reasonable addition to this proposal to fix the problems of folks like Ganguteli. Something like, if your 140 is approved and 1 year has passed, the person must be able to apply for 485 irrespective of whether his country is retrogressed or not. I am not sure about the legality of all these. Thats where the importance of this community emerges. If we can work together, we can solve all our problems in small steps.
If IV and our community take this as a priority item to work on, I will provide $500.00 as an initial aid to this effort. I could offer more on the way.
An interesting idea to say the least. Out of box suggestion.
However, there are few things, from legal point of view, it needs to overcome. I will post my detailed comments this afternoon.
Once again, this is a great idea!
