I didnot started this thread not blame anyone. Everyone knows IV is our only hope....sorry if it hurt someone.
All I wanted convey is that the current visa bulletin is an opportunity (just like jul 07), IV should try to take advantage of it. They made a mistake by putting in writing that USCIS can not estimate, lets use it to our full advantage.
Lesser mortals like myself can not do much...but surely IV core can.

my I-140 (approved from TSC) also has a LUD of 7/28 and my application was filed with NSC on july 6th. I would think people who have applied before me would get receipt first. But it does seem like cases that are being moved to TSC get LUD on approved I-140s.

No, I didn't go out of the country for stamping, coz i was under the impression that my visa was Change of Status from L-1 to H-1. Only now, i could find from the immigration lawyer that i don't have a valid I-94. My employer was napping too, all this while.

logically speaking lottery will be applied only on the applications that have crossed the limit. for 20000 MS H1 quota assume on April 4 the numbr of applications recieved is 18000 and on April 5 the number of applications recieved is 4000, then lottery will be held for the 4000 applications to determine the 2000 cases. All applications recieved on and after april 6 will be returned.
This is just my logical reasoning.

Even if you assume there are 3000-5000 labor subs that chocks up the queue, it might have benefited the ones with a 2003 PD like yourself. But for others (beyond 2003) , it is not much of a help. A visa recapture would benefit the community at large.
Even if you consider 3000-5000 labor subs, not many of those are "sold" labors, many of them are legal ones. labor subs were all legal until some companies started selling those.

Prior to July 2007, the law & regulations allowed to utilize the labor cert, that was certified for a Alien with a diff Alien, provided skill, edu... etc matches. Though it is legal, the amount of mis-use led to sunset of the program after many many years of existence.
My argument is that Labor Sub, does impact PD movement significantly, Also most people I know with PD prior to 2002 , except very few unlucky ones most got their GC. Also in July 07 rush, many who had already filed 485 with PD 2003 and early 2004 also got approved.
I know there were lots of approvals from Backlog Elimination center, but unless you work for a very good company, I doubt you will still be stuck with the employer from 2000 just for the sake of GC. When the dates were current, many moved to other companies, If you were here in US during late 2000 and 2001, that was not nice year for IT / Tech. Now where did all these old PD's pop from. Definitely sub has a big role to play. As I said in my earlier post, nothing can be done abt. this.

My RFE was to prove status from 1999 to 2003..show I-20/EAD/F1/H1 etc....
Regardless of RFEs what I meant was preadjudication is a myth....anyone can get an RFE whether he is preadjudicated or not....
U can get RFEs for the silliest of reasons...and once you get that RFE it does not matter if it is genuine or not....you have to respond and your case gets delayed.
I don't understand why members in this forum are so hopeful that if they are preadjudicated then it is a matter of time (and soon) they will get green.

By non-genuine I meant something where an IO decides to asks for additional info to clear something for which he/she had a reasonable (for him/her) doubt. Of course, all RFE,s have to be answered. For preadjudicated cases which have not been waiting long, and nothing has changes since preadjudication, there should be a little chance of a fresh RFE.
For your case, if documents attached with your I-485 did not prove that throwout your stay in the US you were covered by some type of legal status, they have to ask you to prove it. One of the conditions to get you a GC is that you were never illegally present in US.

Come to think of it, this idea has potential to fly. We can ask CIS to make the date of I-140 filing as the PD for substituted labor case. This will ensure that PD will move forward smoothly till July 07 at least. That will cover most of the long standing ( and long suffering) GC applicants and bring them relief. This will not have any other impact on the number of outstanding apps or available visa numbers etc. I guess this change in PD assignment logic can be done by CIS without the need of any new legislation.
The idea inherently appeals to those who believe in fair play. How do we take this forward.
