USCIS UPDATES COUNT OF FY 2008 H-1B CAP FILINGS
WASHINGTON � U.S. Citizenship and Immigration Services (USCIS) announced an updated number of
filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
and 3 are subject to the FY 2008 congressionally mandated cap.
USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY
2008 H-1B cap because they were filed on behalf of aliens holding a master�s degree or higher from a U.S.
institution. USCIS can now announce that the cap of 20,000 on these exempt cases remains open and that
USCIS will continue to monitor these filings.

Big deal! So there are two or more people using the same computer/ IP address to post from two IV logins. In all likely hood if there are more than one person, MadhuVJ and GCStatus account users know each other.
Move on. If you really insist, there is only one way to settle this. Since its the same IP address, post your actual st address, a few IV volunteers if they are so inclined would have to visit the site and find out who all live/work there.

Please read my history and answer questions below.
Your non-judgmental and objective answers are greatly appreciated.
I first came to the US on a tourist visa when I was 15 years old.
I was out of status when my parents couldn't act fast enough to change my status. However, I faithfully maintained my status once I reentered with a student visa.
So here is the history:
Dec. 1986: Enter the US on a tourist visa (age 15)
June 1987: Out of status from the tourist visa for 10 years
Sept. 1996: IIRIRA 96 passes-- 3yr./10yr. reentry bars apply effective April 1, 1997
July 1997: Obtain I-20 for school, leave the US and return to home country (age 26)
Aug. 1997: Reenter US on a F-1 visa
Oct. 00: Initial H-1B
Oct. 03: H-1B extension
Dec.04: RIR filed (priority date)
Sept.06: RIR approved
Oct. 06: H-1B (7th year) extension
Jan. 07: I-140 filed (pending approval)
July 21, 2007: Preparing to file I-485 with the same employer since 2000
So here are my questions:
Q1. The way I interpret the law is that the 3yr./10yr. reentry bars apply when the law went into effect starting April 1997. Is that correct?
Q2. If so, would I have to worry about getting the I-485 approved?
Q3. If not, should I filed for I-485 at all?
Q4. Any suggestions or possiblities to consider?

Its already there. 20000 for masters and phd students.
Giving GC to stem is to bypass them from EB based line, which means they won't consume numbers from 140k. Isn't this good?

Hi,
As you know cap reached on 30thApril for Masters, can we assume applications that reached on Sat and Sunday(28th,29th)non working(non business) days are safe? or will the be considered to be reached on Monday and hence come under lottory?

This thread is good. Keep it going. I strongly recommend that - everyone active on thbis thread , please update your IV profile and also join a state chapter if you have not already done that. if you do not have a state chapter, contact your neighboring state chapters or if you want to start a state chapter, contact pappu or paskal and get permission to start one.
It is very nice to see a lot of new mwmbers getting organized.
I live in PA. Please let me know, how to join the state chapters so that i can activiely participate in IV initiatives.

Isn’t it odd that the timing of your rally coincides with the introduction of the Strive act?
Granted you scored a point when you were allowed to file for employment authorization this July. If your one rally worked, do you really think other rallies will work too? The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.
So far as the skills are concerned, you have been harping on the theme that you are highly skilled? If the definition of highly skilled is a mere undergrad degrees then 75% of Adult Americans are highly skilled. I bet not even 5% of you have PHDs and you call yourself highly skilled. Huhhh
And this for the leadership of your organization: You are wasting your time. If you are so desperate to get green cards contact me. We will see what we can do… One thing I believe though is this country needs people with leadership skills and not so called "Highly Skilled". So I will be more than happy to work with you. I am sure you have my e-mail address. At the least, I can help make the process faster for you, if so called visa numbers are available.

I became an IV memeber few days back during May 2007 and actually became active sometime around June 10th 2007. Within this short timeframe - IV core and its great (mostly :)) members have given me so much knowledge, confidence that i filed my 485 on my own during July 2nd - I just cant believe that i did that !!!
Now its July 17th its the same IV who made USCIS accept all those hard earned documents .... Yes - I'm that guy who was forced to sign a $10,000 bond for getting Future employment letter.
"No bond, no employment letter - show me what you got" - I was thrown this challenge straight on the face. Now once i get EAD its my turn to show them what i got.

- Best is to delay OPT
- Get a letter from your Advisor and your Internaltion Student Concil Mgmt
- Try to look for a H1 sponsor organization who will wait for you till Oct, 2008
- Try not to get a job in non-profit org/universities in exempt H1, later your will be subjected to H1 cap if you try to txfr to for profit company

Let me start by repeating myself, it is not about EB2 or EB3. We all are EB communities. We didn't design the system, neither we believe ourselves to be superior to EB3. The point is all of us need to work together and help ourselves to change the system. IF EB2 gets some advantage then ultimately it will help EB3 as well.
It is a simple logic, when the cake gets cut it rolls down to all the people in line. If there is no cake, whats the point of arguing who is ahead in line?
Please everyone, stop complaining about who is ahead, work together. Instead of complaining do some more constructive, involve more people. lets gather necessary means to file this lawsuit.
