I equate the situation to a person who sneaks into your house at night and in the morning demands that you respect his human rights and provide him with food and water. No one would tolerate that, yet some how some people think thats ok when it comes to the countries borders.
The church encourages it as most of the illegals are catholics. Poor and illeterate people are usually more likely to attend church and contributes to the churches influence. Believe me, were the Mexicans muslims, Jews or Hindus the church wouldnt care and would probably oppose it. The mosques and temples on the other hand might step in..............
Regarding the children, please understand why they are in this situation. Due to the choices made by their parents.
I think you and I can agree that illegals need to be treated with dignity. But they should not be coddled. . A US citizen who commits burglary, driving without a license, outstanding fines could easily be facing a jail term. The article wants you to feel outraged because her leg was shackled? Please read the headline again. Their strategy is to demonize the law enforcement when ever they try to enforce the law against illegals.
Yes the problem is deep seated and complicated. Giving amnesty would make them all legal, so the problem goes away! Just like you hear some people talk about drugs. Lets make all drugs legal, so the problem of illegal drugs will go away! What kind of solution is that?
I am with you 100%.

Last time around, there are lot of cases in preadjucated state, So, they were able to approve in thousands. This time, most cases they did not touch till now. That makes it difficult to expect lot of approvals.

On my 485 receipt, I have RD as 7/20/07, ND as 9/13/07. But when I check my case online, it has 9/12/07.
I had called TSC yesterday and the rep kept telling 9/12/07 and TSC is processing 8/30/07. I told her I have the original receipt in front of me and it says 7/20/07 and not sure where you are getting 9/12 from. She said "Oh I am sorry, I was looking at the incorrect place". She later gave me a SR # and took all the info. The funny part was she even refused to open a SR telling the date was 9/12.
Not sure whether opening a SR now will help but trying does not hurt and it is FREE !!!! Hopefully the officer looks at my file and then approves it.

Thanks a lot IV and all members. We all worked as a team & helped each other during this time of extreme anxiety & stress. This shows how team work & organization can create a difference. Also the teachings of great Mahatma Gandhi are still so much relevant and applicable.
I feel a part of IV family in this long journey of immigration.Congratulations everyone.

I disagree that substituted labors has really impacted immigration..Those labor certifications that were once filed were thought to be used for some one anyway. If the original applicant wasn't laid off or hadn't changed plans, he would still be ahead of the current pending applicants. It's not the biggest of our current problems.
Companies should not have filed GC for all the non-qualified idiots who are currently got ahead of us.

My heartiest congratulations to IV and Core. Over the last 2 weeks I found that IV was the most reliable and quickest in giving us information.
I have a question for IV , is there a possibility of increasing annual GC quota or atleast reusing unused Visas from previous years.
Thanks and thanks again for all your work.
Murali
Yes.
If members continue the support and we will definitely now aim for these. The battle is only half won with 485 filings

I need to add my daughter's last name to I-485 and subsequent AP. Do I still need to have US court order for doing the same once her passport has correct last name ? How much time does the US court order take and what is the cost ?
Please share if anyone have experience adding the last name with USCIS and how long does it take ?
Look for Name Change document in your local county court. This is fairly quick process and one can use court order indicating name change to update name change in passport and all pending applications at USCIS.
You may need new visa stamp indicating new name.

Does one need to be on an F1 (students) visa to get an assistantship?? Can one work only on university campus while doing their assistantship?? If not where is one eligible to work on assistantship & what type of jobs are available?? My wife is planning to do her CPA on an H4 visa, can she work on assistantship while pursuing it??Please respond.
She can do CPA on an H4 visa(its unfortunate that CPA is not considered an Advanced degree:( )Unfortunately cannot work on assisstantship while pursuing it. At the most to gain US work experience she can work on voluntary basis if any company/organisation is willing to offer her tht position in their acctg department.

GCStatus,
Please stop using condescending remarks. I have been reading all your posts and your tone is going from bad to worst. It is not possible to place all the threads on the home page. We make a decision to put threads on the home page that we believe are important for our effort. If you feel otherwise, that is ok. But it is not ok for you to use derogatory language. If you feel so passionate, why don't you start your organization and spend your time, energy and resources and advocate for the cause instead of posting derogatory messages for others. It is very easy to fire when the gun is on someone else shoulder. We understand and share the frustration with green card delays, but that does not give you license to use derogatory language. Everyday there is new thread asking for update, leadership, direction etc. It is not practical to reply to every such post on this forum. That too does not give you license to use derogatory language. In last over 2.5 years we have answered many thousands questions in forums, emails and phone calls. I have heard many a times from my fellow team mates that not once did anyone receive a Thank you note from someone after that someone was fully able to resolve the situation after receiving reply from my colleagues at IV. None of us spend time on this cause to receive a Thank you note, however, posts like yours makes us wonder that are we a community of thankless educated immigrants who are so obsessed with our individual case that all that we want is instant gratification to exactly know the current status of our green cards, without which automatically IV is at fault. Just so that you know, people spend 30 sometimes 40 hours a week over the period of years, just to read a post from someone like you. We received a call at 12:30am yesterday from someone asking about changing to another company because his current employer was not being fair. So when you mock, please make it clear that you are not the one standing in the line of fire and you are not the one who wants to stand in the line of fire. You just wants to be the one to mock and ridicule. If you are serious about taking the baton, please let us know your phone number and we will post it on the website so that people can call you when they have a question. Lets talk about passing the baton, how about we start from posting your phone number on the website, lets see how you take that challenge. No one is paid to work on IV. People spend time on this effort out of their good-will and passion for the cause. So please be respectful towards others for their efforts. And please stop being a pain in the neck and talk some sense if you are serious about picking up the baton. Email us your phone number and you will see it on the website within an hour.
Now its time for you to go to all the forums of the world and say that IV Admin is rude and dictatorial or whatever.
All the best,
Listen, i dont have time for go on a website and accuse people. If you read all my posts, you wont be talking like this. This is my 4th or 5th attempt to reach you guys and now i get a response. Not sure who is rude.
"Hey Pappu - First of all, great job to keep this site going.
Also want to hard wire the thread "If i can be a little blunt" and send a PM to all members with the first post i made, if at all possible.
Thanks much"
You call the above e-mail rude. You got to be kidding. Read again your post to me and you will realise how judgemental and rude you were. Its ok, i still respect for the initial efforts you have done to this website. And it ends right there.
Now i know how it works here. Its your site, your order. Have a good one.
PS: Unfortunately i am busier than you to run around and talk about your credentials.

IF I COMPLETE MY M.S. IN 1 YEAR AT A U.S. UNIVERSITY
AND THEN IF FILE A H-1B THROUGH A CONSULTANCY
WILL COMPLETION OF MY M.S. IN 1 YEAR BECOME A PROBLEM FOR GETTING A H-1B IN THE MASTERS (M.S.) QUOTA OF 20,000?
BCOZ SOME OF MY FRIENDS TOLD ME THAT IT IS NOT GUD TO COMPLETE M.S. WITHIN 1 YEAR OR IN EXACTLY 1 YEAR, LATER IT BECOMES A PROBLEM FOR GETTING A H-1B THROUGH M.S. QUOTA.( THEY SAID THEN I WILL HAVE TO GO THROUGH GENERAL 65,000 QUOTA AND WILL NOT BE ELIGIBLE FOR 20,000 M.S. QUOTA, if m.s. is completed in 1 year)
IS IT TRUE, IS THERE ANY SUCH IMIGRATION RULE DURING H-1B FILING
please clear my doubt as soon as possible

USCIS UPDATES COUNT OF FY 2008 H-1B CAP FILINGS
WASHINGTON U.S. Citizenship and Immigration Services (USCIS) announced an updated number of
filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
and 3 are subject to the FY 2008 congressionally mandated cap.
USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY
2008 H-1B cap because they were filed on behalf of aliens holding a masters degree or higher from a U.S.
institution. USCIS can now announce that the cap of 20,000 on these exempt cases remains open and that
USCIS will continue to monitor these filings.
USCIS will provide regular updates as the processing of FY 2008 H-1B cap cases continues.
Is this the final number or interim number while the counting is going on.

Dude,
I just saw this post and I would like to understand a bit more about what you read. So, I have two questions for you:
1. What is your EB category?
- I am EB2 India Sept 2006.
2. What exactly did the memo say? Now be careful and think hard before you post.
- I can't reproduce as it is, as I just had a cursoy look at it. I just went through it. I was more worried about my Namecheck, as she hadn't said she would let me know about my Namecheck as of the moment.
When she showed it to me, I was expecting that the memo would be from USCIS, but it was clearly written at the top as Department of State?
For instance, you may cover the following in your post:
- Who was it addressed to?
I don't remeber.
- What was the subject?
It was some thing like 245- xxxxx India/China
- Was it about about EB or FB?
It was about EB and she said it is for EB2 India/China
- Did it mention any dates?
Not Sure
- Did it mention any country names?
- Yes. India/China
- Was there anything about what the adjudicators are supposed to do?
I don't remember exactly. But at the bottom it URGENT was written three times. The IO said they just received it and it supersedes everything.
- Which city/state was this?
In Midwest.
Your response will be very helpful.
Thanks.
I really don't understand why people think I am lying????
When I read the memo, I was more worried about my name check and whether she would check the status of it than about this, as anyhow my dates are not current. After showing the memo, she did offer to check the status.
With all the experience our guys have with USCIS officers and staff, it's hard to belive an IO would be that helpful? But, she's and even the staff at this office is not as bad as others have experienced.
I was even telling my wife about the behaviour and how staff at other offices behave.
