USCIS is not wrong in any way. and yes there is sympathy for EB3 folks. But the problem is EB3 wanting some quota from EB2 and naturally EB2 will not support. This would have been the same from EB3 folks had the spillover flown to EB3.
Hard fact is your support or opposition to this does not matter.
USCIS os doing what it thinks is the interpretation of the law.
Congress is not going to update anything just for EB3. So support/opposition does not matter.
EB3 folks instead of waking up once every month need to work for the IV's goals. which will serve them best.

What type of work do the "Consultants" do ?
If you are an independent consultant, do you have any affiliation to a company ? Or you just work sort of a like a lawyer we hire to do our GC ?

Can those who have already filed AOS based on the EB3 labor also take advantage of porting to EB2? How would that work?
Really appreicate if you can clarify that for me.
My suggestion is whoever has EB3 PD earlier than 2003 , should work towards converting from EB3 to EB2. At least apply and get the PERM LC certified and have I140 papers ready.

1) We have already seen DOS is giving unused ROW EB2 visa's to EB2 India and China and I would assume this trend will continue in near future.
2) Once USCIS stops accepting 140/485 concurrent filing, this should again help the retrogressed countries. This will essentially further reduce the demand for Visa's from ROW and EB2 current countries.
3)And you never know USCIS might start the I140 Premium Processing to get the lost revenue from multiple year EAD/AP.

I filed my I-485 on 23rd June 2007. My FP was completed on 08/14/2007, I received my EAD on 09/24/2007, and FP on 10/09/2007.
after a RFE my I-140 was finally approved on 10/25/2007
with the following wording
"On October 25, 2007, we mailed you a notice that we have approved this I140 IMMIGRANT PETITION FOR ALIEN WORKER...."

I am in the same boat. Been thinking for last 6 months. Finally chalked a path.
One of my colleague got into Wharton full time. That pushed me to do my reasearch.
To judge whether I can handle exams and concentrate on studying, I started out by giving PMP certificaion.
Passed in Feb 2006,without any issues and I confident that I can handle at least some stress of studying.
My background
1. On H1 , pending green card, 10 yrs experience in IT.
2. I cannot get sponsorship for MBA from employeer.
3. Family responsiblity.
I wish to go to top school, but cant move to F1 due to point 3 above.
Then did research on Part time, Online.
Finally decided to go for AACSB accredited Online MBA in a second tier school. Since doing part time or Online in a top school, you anyway are losing on the networking aspect.
But still planning to apply one top school and few second tier.
Preference for Online since after the GC fiasco I am not sure I want to stay for long term here since the wait time is going to be too long. with online you can complete even if you are out of US.
My goals
1. Primary, short term,vertical growth in current job.
2. Secnodary, long term Start own business in near future.
Current state
1. Preparing for GMAT. Material-Princeton Review guide , OGB. 2 months study deadline.
Universities in mind

I used AP @ SFO airport this morning. Thought I'd share my experience:
The immigration officer asked me what the purpose of my visit to my home country was and I said vacation. The officer points me to the 'Read this section' on the AP form and says -
Do you understand that AP does not guarantee your entry into the US?
Do you understand that I could send you back home now?
Do you understand that you cannot use AP as and when you wish for vacation, etc. , you can only use it for emergencies like funerals?
He posed these questions and made some weird statements at least 3-4 times to the point where I felt like I was getting a dressing down from my manager.
I just kept nodding in order to avoid a confrontation. Finally, he went on to say - I see a pattern in how you are misusing this privilege, if we find you abusing(?!!) the system like this in the future we will have to deny you entry into the US and/or revoke your AP privilege.
Then he sent me off for secondary screening. At the secondary screening, I had no issues whatsoever. The officer just asked me how long I was out of the country, took a copy of the AP, stamped the other and let me in.
At the secondary screening, I saw a very old Indian couple being harassed by another officer - this guy was teasing them about their daughter's job(in a way that questions her character), etc. Him & his cronies were having a good time, I guess, the couple did not understand what he was doing, they were just paranoid.
This is just harassment - switch the USCIS backdrop for a bar in Tennessee and one could walk away thinking this was a bunch of hillybillies having fun at a strangers expense.
Has anyone experienced anything similar? I travel once a twice a year out of the country and have never seen this before. Is this restricted to SFO? - Just wondering...

It is for emergency travel and the reasons you provide at the POE should be along those lines.

Well i am totaly F~~Ked then, because my employer has already been waiting for a year for me to come over from the UK, As you know you have to have a concrete job offer at the very start of the process, so now my case is at the NVC and i have a case number, and it hasnt moved forward a day in 3 months, (In in England.) my prority date is June 2006. Can i safely say that writting a letter asking what is happening to my case will get me no where??
I have had my life and my bussiness on hold for very nearly a year. How long do i have to go on like this. It total ridiculas. How can the EB1 and 2 cats be current, hand thenm out like tic tacs, but the EB3 and getting screwed over so bad. it is just so wrong, i was getting so worried about it over xmas that is was having trouble sleeping and felt ill.
What am i and people in my position supose to do. how long do they think my employer is guna wait for me. You dont hire somone on the basis of having them start in 5 years time.
If i ran my busness the way they run the imigration stuff, i wouldnt have a bussiness, its that simple.
I think i am guna be waiting forever for my visa, in fact i dont think i will ever get it. and the whole thing has been a waste of thousands of dollars in legal fees, and trips to find a job.

actually you do have the right to ask all those questions. You are a paying customer of USCIS and this is a free, transparent society. That accountability in the US is one of the biggest reasons so many of us are waiting so long to become permanent residents here...
