    I guess that's the best thing to do right now, no matter how frustrating it sounds. I'm another July 2nd filer with no news. Called USCIS and the lady asked me to wait till the end of the month, she would not answer or explain any of my questions. Lets practice patience because it surely looks like we will need a lot of it on the road to GC.

    My rejection notice reads as follows

    "The above application or petition, along with any check or other form of payment, is attached. The application or the patition cannot be accepted because the proper fee of $1010.00 U.S is not attched. Since the case is not properly filed, a priority or processing date cannot be assigned.

    Please attach a check or money order for this amount and resubmit this entire package to the address listed below. To speed processing, please leave this notice on top.

    Enclosures

    NOTE: THE FEE FOR THIS FILING WILL BE $1010.00 U.S. IF RECIEVED AT INS ON OR AFTER JULY 30, 2007."

    I believe this is an improper rejection since the fee for July 2 filers is not $1010. The fact that they are claiming that a check for $1010 is not included clearly implies a mistake by INS. But my lawyer disagrees with me and resubmitted the application with new fees without mentioning the July 2 filing fact.
    Note that the rejection notice has the receipt number and the rejection notice makes no mention of priority dates for refiling. How good are the chances of TSC accepting my resubmitted application.

    Currently I have my EB3 with priority date of mid of 2003 LCA and its corresponding I-140 approved. I would like to know

    1) whether it would be possible to file EB2 PERM LCA followed by EB2-140 with MS + 1 year/1.5 years experience for a more senior position (ie Senior Programmer Analyst) with the SAME EMPLOYER and have the OLD PRIORITY DATE OF MID OF 2003 TRANSFERRED to the new EB2 I-140? What is the CRITERIA for doing it and what CASES are not possible. If possible can you describe HOW could it be done (ie what PERM job position, job requirement qualifies for EB2 and its advertisement details and when and how is the priority date transferred to the new EB2 1-140).
    2) I also heard that for a given employer/employee with approved EB3
    I-140, the SAME EMPLOYER CAN'T refile for EB2 PERM LC to RETAIN THE
    OLD PD(of EB3), followed by EB2-I-140 since refiling(to retain the old
    PD of EB3) is possible for the same employer/employee only if the job
    description, employer, job location, alien job title, job requirements
    REMAIN the same. Hence then it would mean again I could only refile
    EB3. Is that TRUE? Can you please point me to the LEGISLATIVE article

    In this case, buy a green piece of paper and keep your EAD in that. You will feel that you have a Green Card in your pocket.

    Dude, not long ago, people were saying......Oh...for PD 2007 forget GC, it will take 25 years, look today, they are preparing for EAD.

    What if they recapture unused VISA numbers? What if they change the cap? So many iffs. Keep your spirit high and get on with life, if you find a day when you can not wait any longer, pack your bag and go home, no one will stop you.
    Before shooting off any reply, read the title of the thread. The OP is talking about people who were not able to file. I don't think those unfortunate folks can file for EAD.

    Also, it must be some ***** such as yourself who'll get comfort by keeping a piece of green paper in your pocket.

    People's spirits are high enough and nobody needs your advise on what to do if/when they can't wait any longer. There's no question of that, so you can keep your advise to yourself.

    I got the denial notice. I wanted to copy it here, but it is a pdf converted from .jpg. Does any one know how to convert it into text so that I can copy the relevant part for every one purpose.

    The denial letter looks pretty simple to answer to me. Some how my lawer messed up and the evaluation that they submitted in latest intent to revoke notice was not good. Basically he combined both my AMIETE+MS showed as double degree. And I don't have 5 years experience before PD after my completion of MS. This is totally screwed up. I am getting evaluation from WES and ACCRAO and hope they will accept as new evidence. I have until 6/7 to appeal.

    BTW, has anyone ever received a 2nd FP with a Code 3?

    From what I've understand, an FP notice with a Code 3 (Finger Printing, Photo & Signature) is issued when you first apply, and a name check process is initiated. Any subsequent FP's if issued, will be Code 1, for finger printing only. Please correct me if I'm wrong.

    So, does it mean that my name check was not initiated when I gave my first FP, which is a Code 3?
    If that's the case, then its too bad, especially with all the forward movement and pre-adjudication.

    I would really appreciate your input.

    I have been a long time reader and I have contributed to almost all the fund-raising and flower campaigns (like most other users of the IV).

    I have a stupid idea but thought I should bring it up and see what you all think. What if we organized a national-wide day of protest outside the USCIS offices and demand that they treat us like humans and not as faceless pieces of paper in their files. In particular, I feel they owe us complete details on where exactly our cases are in the queue, how many cases are there in front of us and where exactly the queue is being worked at. That way we can plan our lives and perhaps that means that some of us conclude that their turn won't come on a timely basis and leave this country. The present status-quo is unacceptable and the only way to change it is a) make it known and b) demand it to be changed.

    Personally, I have been in this country for over ten years, contributing in my humble way to the US society at large and earning an honest living (like you all). I have never broken any laws; I don't even have a traffic violations. I don't even have the right to know where in the queue my case is? And I know 99.99% of you all are in this category too. Feel free to tell me that it is a stupid idea.

    Is there any such rules/requests in any CIR or any upcoming laws for the CitizenShip Contingency?

    Not only EB3 but almost all category backloged and all countries will be looking for this law. Due to Visa-unavailability, their 485 Applied status time will be counted (atleast partially like 70%) towards the Citizenship required period of @5 yrs ? We all know that unless we upgrade to EB2 or more, we don't have quick GC chances..

    Is this happening by any chance ?

    Question:
    Can the visa bulletin be updated to reflect the correct dates of processing. Ex July VB dated June 12 to say applications accepted for employment based category for applications received from July 2 - Aug 17.
    This is because when I pulls the VB to check if the application falls under that VB , if they pull VB of Aug for application reached after Aug 1 but of priority date less than June 2007 , USCIS might reject sayiing Aug VB is "U".
    This is what happened when I met Immi Officer at SFO.

    Question:
    When USCIS returns application which are because of mailroom error or their other error, when we resubmit would be treated with receipt date of original submit date?

    You are right, and indeed money is the only thing that talks in the US. Rallies and promises to buy homes etc mean next to nothing in comparison. The only plan that has potential to work is a visa recapture for a suitable price. If paying a price for a visa recapture isn't going to fly then people should forget about a visa recapture for free which has even less potential in this economic climate.

    More than likely it won't but if does, We all can kiss a good bye to USA and GC..

    Politicians help becos they want issues to get limelight.. They don't love anyone but power..

    One more thing, I am still a citizen of India even after GC.. So I will have a right to ask them... This can be very easily painted as trade problem for India..

    Forget about individuals, companies like Wipro, TCS etc.. also can't do business.. lets not discuss about if they should or not.. but it will be a problem for politicians if they start showing losses... So this bill will have much bigger problem than we could ever imagine...

    Trust me every one of us will be impacted, it doesn't matter if you work for a small company or a big company.. its just a matter of time..

Sorry for being scarcastic here, but if you want to do an MBA, just give the GMAT and decide based on your score and experience. Worry about your salary later. If you perform well you will get paid well...;), i mean its not worth rolling with the replies you get to make your own decision regarding the questions you have listed.
