No need to jump directly to the lawsuit, although that is a final option. We can start out by educating the lawmakers how quotas are discriminatory and against the spirit of "Equal protection". All we are asking is Equality between all the people in the line of immigration. We are not asking for the equality between us and the citizens.

If your new I 140 gets denied for some reason, your EB3 case remains unaffected and continues to be processed as before.
Also the answer Ron Gotcher gave on his forum sounds accurate. The only thing I might add is that, sometimes there is an inexperience officer at USCIS who may not understand the change of EB3 to EB2 and accordingly change in 485, and so may actually create problem. But this is not the usual scenario. Anyone with experience of doing this is welcome to share his/her thoughts.

Forget about EB2 with 3 year degree.
Now a days, even EB3 is difficult with 3 year degree.
EB3 is possible, if job description not mention about US degree equivalent.
Make the ADVT. wording to suit 3 year degree, associate degree or no degree for the post.
You cannot combine experience, PG diploma to add one more year to your three year degree to make equivalent four year US degree.
I know one person got I-140 denied, even after 3+1+2 year degree. He got PERM certified, but I-140 is denied for degree(EB2), even though he have 2 year masters from India.
For H1B, they will agree for the combination of degree and experience, not for GC.
Totally incorrect info.

In my opinion, again this is my opinion based on few of my friends in similar situation, you should file for your 485 and add your wife later. Since your PD is Feb your I-485 will not be adjudicated at least before 6 months. You can add your wife anytime before that.
Again..several of my bachelor friends who have PD in 2006 following the same.
You can check with your attorney too before you make the final decision.

thanks everyone, I have one more question though. I had my H1 renewed recently using my I-140 approval, and I have the I-129 and LCA from my initial H1. Do you know if the company (or the lawyer here) has filled another I-129/LCA for my renewal or is it just ONE I-129/LCA as-long as I am working for the same company?

This bill as is talks about giving unlimited Greencard if you had stayed in the country for a min of 5 years. I don't understand what else could we need to reform here.
I read it twice now and yes it talks about doubling Family but she removed all caps on AOS for Legals staying more than 5 years.

since some people were enquiring about lawyer, I am throwing name of my attorney, Mary ryan ... just in-case you are window shopping. Actually it's my company's lawyer, but found her to be exteremly reasonable and gives sound advice. Her office is located in baltimore, MD and practises under "Taylor and Ryan" She actually avoided me from falling into the trap of Counsler processing during last years july filings. I was gunning for it, as it had been my impression counsular processing is faster, especially since I had no fishy deal in my EB2 work history. But her advice saved me and thankfully, I am enjoying EAD just like you all. She might be pricy ... but that's for you to find out.

I recieved a email from USCIS regarding an interview at NBC. my 485 is at TSC. I just got it yesterday. I haven't recieved the hard copies yet.
