There are a growing number of reports from the H-1B cap filers beginning from late yesterday that they started receiving "refund" of filing fees from the CSC or VSC. These are the cases of the petitioners whose filing fee checks have been cashed by the Service Centers. We do not know whether this news implies that the USCIS has completed the job of sorting-out and data-enties for all the cases and the random selection process has commenced. Assuming otherwise, one wonders how they have decided that these cases have been not selected and the filing fees should be refunded. There are two theories as to how the random selection would be conducted. Obviously, the entire cases should be data-entried before they can start a random selection process. Otherwise, the random selection process will be not scientic and too arbitrary. But no one knows. One theory is that in order to make the data entries, they should take the filing fees and the payment of these fees will have to be refunded for those which fail to make it. Other theory is that the checks will not be deposited until the selections are made. Currently the process of random selection remains a mystery. However, the fact that refund checks started being mailed out may indicate that the first theory is more likely than the second theory, and there is a possibility that the random selection is made by the computer during the process of data entry rather than after completion of data-entries of the entire cases. Since they had only opened and sorted out a little over 34,000 cases, it may be hard to believe that yesterday they could have completed sorting out of the entire remaining cases in one day. I didn't break the law knowingly, I did come here legally. I just happened to fall in love with someone and moved to her state. It's too bad it didn't work out, however I have maintained legal status after leaving the country and re-entering, back in '04. Look at the chronology.
Please try to offer constructive criticism or information. If you don't have any, move on.

Strange really strange....I am sure RD/ND had not move back and forth so those who applied in late 2007 or 2008....did get approved even though their RD/ND was not current....What nonsense is this...
Now the other thing to worry is FP notice...mine is beyond 15 months and I am sure many are in the same boat....so the wait is longer.....FP and then again NC/BC.....what the &*#$
This is insane....on one hand USCIS is saying it will be decades b4 ppl on EB2 and EB3 (I) will get approved and so ppl will just keep on doing biometrics /apply EAD/AP so added revenue model for USCIS

:(I am planning to renew my passport from DC Indian Embassy counter.
I was looking at their website for instructions and found that the passport size photograph required is (3.5 cm X 3.5 cm). But when I printed the application form from the website, Checklist at the end of the application shows the passport photo size as (2" X 2").
I am confused as 3.5 cm does not translate into 2" in size.
Gurus, Anyone who has recently renewed their passport at Indian consulate or DC embassy please share the information on what size of photographs were attached to application.
Appreciate your time and help.

Cost of attending the meetings with lawmakers and seeing every IVian, that attended the event during the last three days, working relentlessly for the entire immigrant community stuck in the huge greencard backlog : PRICELESS PRICELESS PRICELESS :)
I think, the event was a huge success and the outcome of the meetings were positive. I wish at least one representative from each state participated in the event. Some offices insisted that they talk to their constituents.
Kudos to everyone who participated!!!!!!!!!!!!!!

The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.
So far as the skills are concerned, you have been harping on the theme that you are highly skilled? If the definition of highly skilled is a mere undergrad degrees then 75% of Adult Americans are highly skilled. I bet not even 5% of you have PHDs and you call yourself highly skilled. Huhhh
And this for the leadership of your organization: You are wasting your time. If you are so desperate to get green cards contact me. We will see what we can do� One thing I believe though is this country needs people with leadership skills and not so called "Highly Skilled". So I will be more than happy to work with you. While we were shaping the Silicon Valley, you people were shaping the valley of drugs, smuggling, kidnapping, extortion and prostitution. All that you people can do is to eat, reproduce and talk trash.

My RFE was to prove status from 1999 to 2003..show I-20/EAD/F1/H1 etc....
Regardless of RFEs what I meant was preadjudication is a myth....anyone can get an RFE whether he is preadjudicated or not....
U can get RFEs for the silliest of reasons...and once you get that RFE it does not matter if it is genuine or not....you have to respond and your case gets delayed.
I don't understand why members in this forum are so hopeful that if they are preadjudicated then it is a matter of time (and soon) they will get green.
