I have filed for H1B under the Masters quota but i will be graduating only in May and gave an official document from my University that i would be graduating. Somebody i know had also done a similar thing but he got a h1B rejection mail from USCIS yesterday. This has made me really upset. Is anyone there who has filed with a similar document and has received H1B? He had filed it witha consultant while mine is a highly reputed company. Will that make a difference?

The letter actually does not mention all degree requirements have been fulfilled. This left me really upset (I asked the dept to fax it directly to company, so I had not seen it).
It says "XYZ completed all coursework requirements for his PhD in EE at the University ABC, and deposited his thesis on April 11 2007. His degree should then be officially conferred in May 13 2007"
Obviously course + thesis = all degree requirements for PhD, but I wonder if USCIS might question it. The company's attorney (a highly reputable company) okayed the letter and he said denial is unlikely and that they will either approve it or issue an RFE; but based on my readings of other posts I think there is a fair chance that it might be denied.
The irony is that I got a letter from the registrar on April 16, but by that time the attorney had already filed with the weaker letter. I asked him to send the other one when quota was still available but he said it was unnecessary.
Please anyone with similar experience comment.

As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can�t be possibly because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.
There is only one explanation. These labors were already pre-approved. It is the attached I-140 on these labors that are getting approved rapidly. And the subsequent I-485 petitions on these applications are depleting the visa numbers.
The reason of this post is not to start an argument about the ethics of labor substitution. It is just a FYI post to explain the seemingly inexplicable. The chickens are coming home to roost.

The idea that core wants to float is to have an effective campaign under the IV umbrella. Please come up with more innovative ideas and discuss with core.
I think this campaign can be pretty effective if we want it to. This idea is not totally outlandish. If you recall, recently fans of the CBS series Jericho sent nuts to the office of CBS when that series was discontinued.
Sometime back, Indians in the UK sent thousands of unstamped letters to their postal department, protesting a stamp that hurt their religious sentiments.
Those campaigns worked and so can this. All we need is a little bit of enthusiasm!

Mr Unitednation takes the advantages of ignorance (in immgration law) of most of the forum members and spreading wrong information in both web sites.
Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

first: my use of an extreme exemple to explain the EB category difference seems to have caused misunderstanding and offence amomg some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intersting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thred?

All I did was posting it in August EB2 India/China approvals thread about what I read and heard from an IO. Just to inform people. This visas are not available only for India/China and not for other countries????
If people think it is not appropriate, the admins can delete all the related posts and threads.
