I did not catch the whole speech but he was talking on the Senate floor about abuse in the H1B system, at the end he did say that he is not against increasing the cap for H1B's but he wanted that done with provisions to make sure the abuse of the system is prevented. He also said that he is willing to work with other Senators to fix this broken H1 system before the year end.
Do we anything more about this?

K , I see two views by two different types of folks.
View #1: This system sucks. Its not fair and just. America is a great country and land of immigrants and we chose to immigrate here. Lets work on this issue so that I myself and folks such as myself now and going forward do not have this problem. I will do what ever it takes. I personally feel that regardless of the outcome, it gives immense self satisfaction to commit to meaningful cause. Others might not feel so, but all of us believe that this problem needs to be solved and do what ever we can do.

Should I say that all of you those who bought homes and are having a life bought a home with 0% down and interest only loan so that you can save your taxes now and if your GC does not come through in 5 years, you will walk out with out any loss as you made hefty deductions and haven't paid single penny towards the mortgage and simply go to Timbuktu or Krakovia. I will not!. Just because you chose to buy a home and have a life does not mean that others dont. Every one lives their own lives. Those who dont buy a home live a life of their choice. Stop judging people. GC was not a risk or hindrance to you in buying a home but could be for Joe the Analyst. You might have deep pockets, Joe the analyst might not or have other commitments. I know you are a committed member and you contribute as well. You have been helping the holiday thread to be on the top too. I was talking about my IV holiday fund raising to one of my co-worker who is a US citizen and who does not have an Indian/ Asian ethnic background and he had mentioned to me you guys are 25,000 people and all of you are hard working legal immigrants. you dont need to go to anyone else for money. your group is financially very strong. If all of you put in 10$ each month you will have 250K funds available every month. What you should really work on is get every member to commit to that 10$ every month. What can we do to get every one of us put in that 10$ every month?

It's about the ones' who cannot for what ever the reason may be....you and me pointing to the salaries or house-hold incomes will not help them join the wagon.
It's about increasing the donations irrespective of people joining the monthly-contributions scheme....Other viable options...may be having a IV donation boxes...in immigrant owned businesses....etc.
In an ideal world as you mentioned atleast 20000 of 25000 will contribute monthly....It's defintely good to aim for that....but that's not realistic.

I didn't find where in the PDF AILA is saying the definition is illegal!
They provide one example a court ruling where the EE definition was established in the case of an insurance agent. But such an issue has already been address by the EE memo by USCIS (Temporary/Occasional Off-Site Employment).
Is it your own interpretation that the EE definition in the memo is illegal or did you read it somewhere in AILA's response?

According to the I485 inventory they published, there is what.. 400 cases between these two date, why only move 400 cases per month = 4800 per year when the annual quota for EB3 ROW is what.. around 30,000?
Never mind the spillover, can ROW just get its normal quota at least?

(2) Working out per diems in percentages
(3) Changing job titles to suit their needs
(4) Most important - employee tries to do what he/she can to keep employer happy as the green card petition is filed - I have seen this - people I know do this - they lick the boots of their employer - get coworkers fired so that their jobs are secure - get personal in alomost everything with employer so that they feel secure and job satisfied - These are the people who come out anonymously and talk bad bad things about their employer because they know they are into a screwed up relationship - no pay hikes, employer cheating on perdiems - employer knows employee is ass kissing and talks sweet but exploits - employee knows that things are not going to be the same for a prollonged period - puts a false mask and blames organizations like IV for not doing anything - these are the folks who encourage employers to do what they want to do.
And the day these employees get their green cards, they will open they companies and will do the same thing to the new immigrants; and the circus will go on.

I would think IT experience is the same anywhere so taking it to canada should be ok? If not there are plenty of other management jobs there. It might be a new start but in a one year timespan you will be well established.
Is it just my wishful thinking?
As for masters, are you persuing MBA? How about PMP?
1. Apply for Canandian PR and then if you are lucky you may get a good job in Canada in IT or else you will end up working in Wal*Mart or some grocery store cursing why you came here. Canadian Companies wants Canadian experience. US experience is not enough! :(
2. Just enjoy without doing anything and hope that your GC would come before you die. :D

The story of memorandums is like this. If present law does not have provisions for certain things, then the government departments can publish a memorandum to give some kind of legal basis for their actions. Publishing a memorandum itself is enough to conclude that current law does have provision as such.
Usually these kind of memorandums are made against people who are vulnerable and do not have avenues/options to challenge. There were several memorandums made against undocumented workers not long time back. None of them stand the judicial scrutiny when challenged. Example, there was court ruling in many states that police cannot ask people about their immigration status.
The intentions of this memorandum is clear not to give any more H1Bs to small consulting companies.
I do not understand why some people in the forum have so much anger against the small consulting companies? This is just playing into the hands of anti's . Consulting through multiple layers is perfectly legal and a successful business model. No company wants to hire a person for 6 months project. It's been the goal of anti's to make small consulting companies look bad and they have been successful because of us. If this business model is bad, why not make laws to stop this type of business practice? If you ban that type of business, there will be no need for small firms hiring H1Bs.
