Senthil I agree withyou on 40% of H1B consumption are from TOP Indian IT consulting firms, even though those companies doesn't sponsorship, but atleast 50% cadidates are switching to other companies after entering US for GC sponsorship, which we need to take in to accountablilty to come to our conservative estimates.
Not all of them in h1b are applying gc. Top 5 H1B Indian companies TCS,CTS Wipro,Satyam and Infosys are not processing GC. So less than 40% of people only apply gc. In that some of them are not serious. So if 650k people comes on H1b Only 200 to 300k people should have applied Gc. 70% of H1b persons are Eb3. So EB3 is in very bad shape. Also no adjustment was done for H1B increase from 2001 to 2004 to 195K. If some temporary relief is done by giving one time increase of 100k to 200k gc will make PD picture much brighter

I don't know whether 140jibjab is actually guilty of domestic battery. If he/she is, I am incensed that we are helping someone charged with domestic battery. Why would you beat up your spouse?? And then have the guts to ask for help in a public forum.
Well, no one knows and I think no one except his lawyer has right to know what really happened in JibJab's home. All I know is that the truth can be anything. Possibly he/she has beaten up his/her spouse. "Battery" suggests throwing something at someone. Like an object you hurl at someone.
But again, there are people out there, who press false charges in order to gain leverage in divorce proceedings and there are people who press false charges just out of revenge. I dont know what happened in this case, he/she could be guilty or may not be, and none of my business and none of anyone's business.

Essentially if the I-140 has been approved, the new company has to get the name changed on the I-140 app. Still would like to hear from someone who has been thru this.
Also the question of going to a new employer under these conditions still remains? Please advise.

I am from mumbai and new york and used to the fast pace of life and used to seeing a lot of people. I would feel depressed if I dont get to see people. And OK is practically in the middle of nowhere. My cousin used to study there and it was very difficult to plan and make a trip to OKC from anywhere in the US. Secondly there arent many places you can go to around there. The nearest attractions are in Missouri or texas which are atleast 4- 6 hours away. Besides my other experience is with how people are with you over there. Once you have lived in the north east long enough you get used to everyone being neutral to your brown color. Not so in the midwest. I have'nt had blatant discrimination but you do get to see that people dont really like you and dont think you belong here. This played a lot on my mind and am put off by the entire mid west area in general (saw the same thing happen in knoxville, nashville, missouri etc)
Good luck on the move. My advice to you would be to make a weekend trip it might cost you 300 odd dollars but you would get a real feel for the place.

Since HR 5882 is almost dead, having a very rare chance of getting through (since, there is no much time left as 26th September is last day) and no contributors for IV in $$, I would suggest sending mails to probable presidents Obama and McCain about our issues on their websites. If only couple of us sends them mails, I doubt they will get though scrutiny but if we mail in 1000's, may be they will get aware of our issues.

You CAN switch from EB3 to EB2.
How do I know? I did that sucessfully.
You have to file an amendment to your original certified I-140. Note that the original position mentioned in the Labor certification petition should be consistent with EB2.

All we are asking is Equality between all the people in the line of immigration. We are not asking for the equality between us and the citizens.

Thanks everybody...We feel terrible that we let the consulting company down..They helped us when we needed this H1 stuff..! And now we filed for AOS/EAD...But then what to do...Everything was so circumstantial.! S**t happens u know.!! Sometimes we have no control.! We have offerred to pay for expenses (filing fees + attorney fees) + something called DAMAGE FEES of $1000...$%%@?? thats a total of $3500.!
We're doing this in good faith & to keep it clean.! We feel responsible for letting them down.! ...THERE'S THE REAL WORLD & THEN THE IMMIGRATION WORLD..!!

Grow up, learn to accept that there are multiple ways of getting a refund !!
I am not sure when you have filed. But if you are filing ITIN without tax filing and claiming the purpose as Tax filing - it will be rejected.

Thanks for the replies and concern. I forgot to mention that my 7th year H-1B expired last week. So basically, my H-1B extension is pending and my status is now completely based on this approval. Could anyone tell me if I could apply for a new 8-10 year extension with a new company with this fact in mind.
