When you go for I-485 finger printing, that time they give you a form to fill. That form has a line saying new name or something like that... if you want to change it to something more anglicized.
I remember seeing it when we went for fingerprinting and was joking to my husband that now is his chance to change his long tongue twisting last name!
You get the same chance again when you go for Citizenship finger printing. (There may be opportunities in between that timeframe too, but I am not aware)

Surprisingly the same Fragomen firm told me that it is OK to travel on H1 while my I-485 is pending! In fact, I have to get my 3 yr H-1 stamped when I go to India in Jan and they know that. Fragomen advised me against using Advance Parole for travel citing reason that if I do that I will have to use EAD for work (the attorney agreed that it is a gray area and it is safer to use EAD for work if entering on advance parole).
About your washing episode, I have heard stories like this from friends though I personally don't know anyone to share their experience with you. So you are not alone...
I remember answering yes to the question on I140 and I also had a copy of the 140 handy in case they wanted to see it. But the conversation lasted barely 10 secs as all she wanted to know was if I was still with the same firm. & I know I have to tell my attorneys at some point and I also realize that they probably dont care all that much about what happens to my case eventually but Im just stalling in the hope that my AP somehow gets approved even though I left the country after applying for it when my then H1 had expired.
Senk1s - thanks for the links - they answered my question which basically is stand in line again assole! And though its pain for me to go thru figuring out what to do, I can perfectly understand why others may find it amusing and it's fine so long as I get answers to my q's so thanks again for the links.

It is always safe to maintain dual status as a safety net!. To answer your question of filing GC again while you are on EAD. Yes you can. But make sure to file G28 (change of representation by attorney) to the new company that is hiring you. It helped me and also they helped with some of our RFE after I switched job. I did inform USCIS the job change and filed AC21 support documents to be safer along with G28. There were lot of LUDs at that time and it got settled down. There were no RFE related to my job change, but for my wife's immunization and medical.
Good luck

Here is the analysis of Employment Based Green Cards (EB GC) related clauses in Specter's markup of the Comprehensive Immigration Bill. This is not definitive. Only our opinion and subject to errors in judgement.
:) Remove applicants with certain Advanced degrees from the EB quota
Those with advanced degrees in Science, Technology, Engineering and Math are taken out of the quota. But note the applicant must have worked in a related field in the US for 3 years prior to their application. So if you started working in Jan 2001 and applied for GC in Dec 2003, you are still in the quota and not outside of it. Could take out 20-50% of EB-2 applicants from quota.
:) Many of EB1 applicants and all of EB-2 National Interest Waiver are removed from the quota
Applicants with extraordinary ability or outstanding researchers are removed from the quota. This leaves only the Multinational executives in the EB-1 quota.
:D Remove all direct dependents from the Quota
Direct dependents of all EB GC applicants removed from the quota. The best clause for us. All positive.
 Direct adjustment of status for those with certain PhDs
Those with PhDs in Mathematics, Engineering, Technology and Physical Sciences and are currently working can directly apply for Adjustment of Status. I am not able to find any rationale as to why they specifically mentioned Physical Sciences here. Every where else they have just mentioned "Sciences".
:) Above changes applicable to existing applications and new applications
Good again.
:) Special labor certification processing for those with certain advanced degrees from the US
If you have an advanced degree in sciences, technology, engineering or mathematics from a US university, there will be a special labor approval process for you. Not sure of the details of this.
Increase in H1-B
Increase H1-B quota to 115,000 from the fiscal year following the enactment of this law. Also removes those with advanced degree in science, technology, engineering and math from the quota. Allow for increase of the quota by 120% if the quota is reached in the previous year.
:D Increase in EB quota
Increase the quota to 290,000. Recapture the previous year's quota if it is not filled up. Recapture those EB Green Cards lost from 2001 to 2005. All positive
:) Immigrant visas given to spouses and children after Oct 1 2004 to be recaptured.
Great again. Likely to give an one time boost of more than 150,000 to the quota
Change of allocation of the quotas
Reduce EB-1 and EB-2 from 28.6% to 15% each. So despite the increase in overall quota from 140,000 to 290,000, the quota for each of these categories then increases only marginally from 40,000 to 43,500. Increase EB-3 to 35% from 28%. This increases EB-3 quota from 40,040 to 101,500. Create a new class for other workers with a max limit of 30%.
:o Increase in per country quota to 10 percent from 7 percent
Good but only marginally so. See below.
 Strikes out the section about removing per country restriction if EB GCs are not used by the end of the quarter.
This is very bad news for those from the heavily retrogressed countries like India and China. In the previous years, applicants from India and China got the remainder of those visas that were not consumed by the rest of the world. This strike drastically reduces the actual number of GCs given to people from these countries.
 No mention of filing for I-485 when Priority dates are retrogressed.

Not sure why people would be giving me red for asking this question.. I don't really care on the red dots or green dots as it does not stop me coming here and get help I need or help someone in need. I know this forum is for and from people who are qualified enough to be here.. and I hope we understand this and move on..

your persistance worked.. I for one thought that the person MUST be present to get a ITIN number but you proved it wrong. I am happy for you.
Thanks :) What was amusing though was, the IRS reps are not very well-informed, and their process is not well-defined either. I checked with a couple of them and they both gave me different story. One of them told me that even after receiving the ITIN number, my tax return will be processed without the exemption and to be able to get back the return I would have to file an amended return. Turns out, they processed my return WITH the exemption and I got the refund back . Not that I'm complaining! Well I hope this thread helps out someone else who is in the same situation as me.

US visas are machine readable. I believe that they have a thin magnetic strip with info on it. (In fact did you know that US visas are scannable as identification while doing e-checkins at US aiports (atleast some airlines).
It may be that the machine readable portion is still ok.
But to be on safer ground, getting re-stamped would be better & depend on your exact situation (i.e how many years ur stamp is valid, whether any travel plans outside US, etc etc.

Someone wrote that your salary can not change also during the GC process. What about annual pay increases? What about bonuses? Would that affect the GC process?
Thanks
Salary is different from Promotion. So i do not think Salary increase would affect GC process.
Also about the Promotion, in many companies, they do have different levels for each salary bracket so moving from one level to another level won't affect GC process if Job description remains same.
I have seen many company using this scare tactics and not giving raise to H1b holders.

Aren't there 140K visa for EB category?
On Dec 11th 2009 - # of Outstanding 485 = 209,441
On Oct 1st 2010 - # of Outstanding 485 = 168,846
So NET reduction in backlog = 40,595
@40K NET reduction per year, every category should be current in next 4 years !!(There may be deluge of applications once we cross 2007 July ) . Atleast in 2011 we should see another ~40 K reduction- Good net reduction.

I don't think that's true. I think US government wants you to declare any income you had anywhere in the world and pay tax on it. So if you earn interest in NRO account in India you will have to declare when you file your taxes. I don't have a link right now that proves this but I will try to find it for you. I am pretty sure this is true.
Yeah..that's what I thought. Usually banks send 1099-MISC Income for tax purposes. But in this case not sure if ICICI sends any form like that. Anyway, i openend my NRO account only couple of months ago. I will wait and see if I get any form like this for the next tax year.

Just try Cell phone mins. where there is no roll-over. If you intend to use it and Cell phone company had a network disturbances and delays in fixing, will you pay for the service??
Here is one example -
Let us say that you have applied for passport and you have travel plans after two months. If, for some reason, if passport is issued after 3 months, can you file claim to recover loss as you couldn't travel and lost money on tickets?
I hope that this helps you see through the reasoning.

Ensure no conflict on interest exists in using the same attorney for your future process that your employeer used / uses
Yes attorney says there is a agremment between my old employer and attorney.
But my old employer and attorney is ok with continuing as is.
My quetsion is, can I continue as is and pay fees from my pocket?
Is it mandatory/appropriate to go with new employer's attorney?
