Can H4 to F-1 COS be applied anytime?
i.e. Can one start MS (or MBA) on H4 and then at anytime apply for COS to F-1? OR can this be applied only when one semester end and another starts?
H-4 does not need full time course load, while F-1 does... hence wonder if one can apply for H-4 to F-1 in the middle of a semester...(when one is taking less than full time course load on H4)
I am thinking about using the H4 to F-1 COS in case of layoff risks for the H1 primary holder. (Have the EAD option, but can't keep H4 in status).

I didn't say that I got H1 extension. I got RFE for H1 ext.

these I-140 based employer switching seem to be tricky these days. yes you are right - many people want to do it and will want to do in the near future. even after reading so may posts and peoples experiance - each individual case can be different in many ways. since you are dealing with attorney's on both ends ( which is a good thing ), the best bet is to clarify with them to see which best works for you and how to get it done and post your experiance too for others in this forum.
why do we pay them for. feel free to ask all sort of questions you may have and get it clarified.

Hi,
If you don't mind, could you answer a couple of quick questions;
1).We are asking for "re-issue of passport" when our existing passport is near to expiry?
2).Sending in application thru mail or handing it in personally, both options still require us to fill out the "online application" mentioned on the consular website?
3).The address that we want on the passport (as asked in the online form) is our US address?
4).What documents did you send for "proof of residence"?
5).Were any of these notarized?
6).For "Porfoma Verification" question 11 and 12, are we mentioning the original date of our leaving India the first time and consequently the number of years that we have lived in the US?

I got my new passport within one week from NY Consulate. Never called or emailed them!
My suggestion is wait atleast 4 weeks (the time they mention as required for processing) and if still worried try to contact them after that. Usually they contact if there is any problem. It may not be possible always to talk to somebody whenever people like to talk. It is always better if there are many customer service people to reply to all the applicants on all of their worries; reasonable or unreasonable.

ICWA, ignore the hate comments, may god bless you too and good luck with your effort with institute and your GC dream. Hopefully you will succeed in convincing them on upgrading the entry level requirements for their Exams rather than 10+2 and 2 hours semister foundation course or what ever it is called which they are trying to equate to advanced degree in US or equivalent. Please try to answer above questions as well when you get a chance which will help member understand the situation better

No doubt about it! This is very nice to have lawer for all our concerns .
I'll also contribute on this one .
I also recomend to have our own CPA who will work along with our lawer
for any kind of issues like opening LLC/Tax, AC21 ATP showings etc..
IMPORTANT: I'd strongly like to add here one thing: I lost 3 years of time got hurt after employer cheated by tieup with the lawer and lawer wrongly filled (options selected wrongly when fill) for all LC/I140 other docs. to get intentionally deniel/RFs to keep employee etc..
If we have our own lawer who can take care of this kind of things and resolve this kind of issues will helps a lot.

I recently applied for my passport renewal through mail (I live in Northen VA 26 miles from DC), as per Embassy web site - do not contact us with 3 weeks of applying. I waited about a month and got my passport without any follow up.
I know there customer service is worst, but often I have seen if there is something wrong with your application, it takes a long time for them to contact you regarding the error (wrong fees, doc missing etc)

I am also sailing in same boat like you. I don't know whether USCIS purposfully doing it or not. This is shame on them, just for nothing they are playing with life of many people.

Company lawyer submitted on 08/15/07 to USCIS as per Fedex Tracking. Since they filled in the last movement I think I got lately 485 receipt. I can see Notice date as 10/23/07 at top right side on I-797C (Case type I485 aplication to Register Permanent Resident or Adjust Status).
So I'm just waiting eargarly to complete 180 days from notice date and I think I dont need any original labour or any other document to use AC21?
Can you suggest any good lawyer to help me in taking care my GC process.

USCIS is supposed to give a weekly update on receipt status - every Friday at Close of Business. There is nothing yet for Aug 31. Past few updates were also late, some questionable on the status reported !!!
