Thanks everybody for all the information.
Can you please clarify these doubt for me -
1. If my wife begins to work with her EAD, does she have to change her H1 to H4 ?
2. If she finds a contract job, what are her options to work - W2/1099 ?
3. Can we open a company on her name and can she work through?
Why am I suddenly finding lots and lots of junior members asking extremely naive questions and asking for help or solutions or suggestions to bring them out of their illegal troubles?

back from awesome 2k people IV rally in DC! Great to see people stand up and exercise their right to protest.

My wife recived FP notice without EAD. Even though online status shows Approved and sent, on Sept 27 we haven;t got receipt or approved card.

1st, when fertility rates drop below 2.1 children per woman, population doesn't stabilize, it drops. European populations are dropping for this reason, not stabilizing as he claims. When one generation retires, a diminished population causes damage because retirement benefits like social security is based upon one generation paying for the retirement of the next. European countries are in serious trouble because the generation that could pay for the baby boomers is much smaller. But baby boomers have the votes to force their retirement benefits. The loser is future generations who will foot the bill.
2nd, he uses a graph to look at population clearly showing diminished margins. But he assumes that immigration will only grow linearly, which is clearly false. Unlike his claims, it is clearly "conjecture" and it is clearly "subjective". In fact, it sounds like a pump-and-dump stock scheme to me.
3rd, if the growth of the population doubles, that does not mean that the expenditure on infrastructure doubles as he implies. Most of the expenditure is maintenance on existing infrastructure. (He must know that, he is attempting to scare the beJesus out of people.)
4th he assumes that immigration is purely from the third world. I'm sorry, but I did not escape poverty coming to the US from Canada. If anything, I believe that the US is not addressing long term infrastructure and health issues that will make Canada relatively wealthier in the long run. (see 5)
5th is assumes that immigration is what causes wages to drop. How about the abolishment of unions, the US health care fiasco that bankrupts and destabilizes families, the increase in the costs of education? How about funding schools in poor neighborhoods?
Surely the 5 in 1000 immigrants (the ones that don't vote) are not the ones responsible for lowering of wages for less educated Americans. The longer they blame immigrants the longer the problems will not be fixed. So he is doing a disservice to the American poor. One good thing about cutting off all immigration to the US would be to see these guys look around at all the troubles that they still see, and remove the possibility of blame for their own problems.
6th, I've never heard of an American claim that immigration is a solution to third world poverty. That is a red herring. There are policies that could work, such as lessening farm subsidies, lowering trade barriers, prevention of war, fewer privatization of poor country's infrastructure for the benefit of western firms, etc.

I am on H1 and my wife on H4. My wife is also an expert in the art of embroidery and handicrafts, she's become quite famous for her artwork locally. A wholesaler has approached us recently expressing his desire to market her handicraft to other indian stores in the area and beyond. I checked up some info on registering an homebased business and they don't ask you to submit an SSN for registering a proprietary bussiness either at state or local level. A federal or state tax-ID doesn't seem to be an requirement for homebased business either. They just ask you to submit a schedule C attachment with your regular 1040 form when you file tax return.
My questions are following ?
1. If I register a homebased business in my name and include it with my personal tax return, what are the possible implications ? Does IRS or the state business office share info with USCIS regarding business registrations or the only way USCIS would know about the business is if they see my tax returns ?
2. Any other alternative/creative ways to handle it ?

The USCIS website has given the processing date for I-485 as July 31, 2007 for Texas Service Center. Our application is at Texas.

It is always safe to maintain dual status as a safety net!. To answer your question of filing GC again while you are on EAD. Yes you can. But make sure to file G28 (change of representation by attorney) to the new company that is hiring you. It helped me and also they helped with some of our RFE after I switched job. I did inform USCIS the job change and filed AC21 support documents to be safer along with G28. There were lot of LUDs at that time and it got settled down. There were no RFE related to my job change, but for my wife's immunization and medical.

Will 7th year H1b extension from a New employer possible using the LC filed & I-140 from the previous employer?
If this is true then i think it makes sense to pay the additional 1k and get I-140 approved for what its worth.

Most banks have a remittnce facility. You can use that facility to transfer money from NRE, NRO or ordinary account. The caveat is that while with NRE there is no restriction on transfering money, you can only transfer 25K USD from NRO, or local accounts. I heard that the limit was raised to 50K last year but couldnt confirm it. You will take a signifant hit in forex conversions.
YOu can get a USD DD from the bank that you can deposit in US or use the banks wire transfer facilities. Best bet is to talk to your local bank. But beware that they might be uninformed about the exisitng transfer limits.

It doesn't matter what the attorney is saying, because USCIS takes decisions based on their own regulations and memos, and not the advice given by Immigration attorneys to their clients based on their interpretations.
I have not come across any Memo, FAQ etc. from USCIS clarifying this point. It's a legal grey area just like whether a person can continue on H1 after using AP. Every attoney out there has his/her own opinion.
I'm not championing any view. I will be happy if AC21 could be invoked on RD. However, I would be interested in seeing the USCIS Memo, FAQ, or USCIS Field Manual for Adjudicators section clarifying this rule. Newsletter from an attoney will not do. I want to hear it from the horses' mouth.
