the growing budget deficit and falling dollar is sooner or later going to do two things. 1. rate of inflation would be high 2. Loss in consumer confidence, resulting in the recession.

the best thing to do is to go up in the food chain and give your employer enough reasons to keep you on the payroll in the bad times. and test the market every six months by floating your resume out.

Legally speaking, one should get a new job within 10 business day. However given the practical limitations, many people take somewhat longer time. If you could find a new employer within 10 days and file for H1 transfer \ extension, you would be fine. If you can't, it WON'T be an end of the world. so don't worry!!! I wish you good luck.

I had called USCIS and my NC is cleared but the problem is the processing time, they are still in July 16th 2007 and our RD is Aug. 6th 2007. I am hoping that they catch up and move dates same as NSC.
My GC was approved last year... Its been almost a year and my wifes application is still pending! 2003 PD... She has been current for months now and nothing has happened... We took and infopass and the officer said its stuck in name check, but now with the 180 days rule he said it should get approved anytime and that we should have patience... This was 3 months back! Still nothing... :mad:

The I-140 will not get cancelled by itself, the employer will have to withdraw it, and they will have to do it before 180 days since your I-485 filing. The worst that can happen after your employer cancels your H1 (and does not withdraw I-140), USCIS would ask you to confirm that you still have a job offer, in the RFE. Here is the kicker - if you get to respond AFTER 180 days are through, you can submit a job offer from a different employer. Given how quick USCIS is generally to turn, I would hope that at the very least, you will have enough time to get to 180 days.
Here is the good news - if you have an approved I-140, you will be able to port your priority date to your new green card process. I believe it is true even if the I-140 is withdrawn.
I know getting a good job on H1 is tough, but getting a good job is tough, period. I would strongly encourage that you forget about the H1 issue, and look for the best job you can find out there. Tell them you have authorization to work in the US (flash the EAD, if needed), but do go out there and make sure you get a job offer from a good company. When you have the offer in hand, negotiate about transfering H1 - since they are interested in you, they will listen.
Actually porting off an unapproved I 140 will be dicey. The employer just has to inform USCIS before 180 days in a simple letter they are revoking the I 140 (No reason need be given).
Even assuming the USCIS will get to issuing a RFE, it will be sent to the employer (or the lawyer acting on behalf of the company) and the employer will simply respond that the petition is revoked. Even if he doesn't reply to the RFE the I 140 along with the I 485 will be revoked and AC21 DOES NOT apply (Refer to the latest USCIS memo 12/2005 on www.shusterman.com).
Bottom line, try to leave on good terms with the employer. If that is not possible get a new job on H1b and start the process anew with fresh LC and I 140. The previous I 140 is not reliable in this case (if unapproved and if employer revokes it before 180 days have passed).

Is there any way to know that how many of these numbers are getting counted twice? I know many people where both husband and wife have filed for GCs through the respective companies - but it spread across the entire sprectrum EB1/EB2/EB3 irrespective of their education (probably because of job requirement).
What would be a good guesstimate?

Kids are allowed inside building upto the waiting room. If they are big enough to remain seated, you can take them with you to the booth. If they are too small or very active, you can space your appointments.
You have to deal with this when you submit your id with the frontdesk person so that your appointments are ~20 min apart IF NEEDED. The moment of FP/photo is decided by this person. Your appointment paper is just a guide or
scheduler.
YOu have to provide all the relevant immi papers + passport for scrutiny.
if it is biometrics, you have to fill up a form or two for name, variations of names used etc. Just FP, it should be a cakewalk.
These details should be enough; at the same time, if you cant help calling the INS for the same details, pl go ahead ;-)

Agree with most of what you say, but I do not think processing of I140 is happening based on whether PD is current or not. My PD has never been current but my I140 got approved a couple months ago.
I agree. My PD (4/2003) has been current all April 2008 and I haven't seen any LUDs. On the other hand, I am seeing scores of 2007/2006 PDs being approved when their GC opportunity if years ago (Sorry guys!!).
In line with the theory I heard last year about USCIS allowed 100s of thousands of people to apply for AOS in July/Aug 07 because it would generate a huge stream of revenue, this non-PD-based-approvals seem to validate the same. Approve I140's, keep guys on the hook for I485 and get them to keep paying for EAD/AP approvals year after year

ya i spoke to another friend of mine whose parents went for english interview at new delhi. without any request, the american officer asked them questions in hindi, which made them very comfortable. so, i think anyone wanting a hindi appointment and been waiting for 1-2 months can try the option of englsih. i will post my experience next week after my in-laws' interview in english.
