Sorry to hear about your situation. To begin with your chain of events (merger, etc..) are very complected and given USCIS intelligence level I won't only bank on MTR.
Based on your description, it seems you are with a big company which has lot of money. Assuming this is correct, I would push for MTR and at the same time apply for fresh I-140. To best of my knowledge, now with your Phd and work experience you might qualify for EB1 and get your GC quicker. I know few people who have been getting GC's (under EB1) within 1/1.5 yrs.

Your Petition indicates that you r applying for Professional with Advanced Degree or exceptional Ability . According to ETA 9089 submitted with ur peition the min reeqmnts you are wiling to accept are less than MS degreee. Part H of ETA 9089 indicates employer will accept BS + 72 months of Exp.
Advanced Deg is defined by US academic of Proff or a Foregn equivalent aboce BS. In the alternative US BS or a forient equiv degree followed by at least five years of progressive exprecience in the speciality shall be considered equiv to MS degree.
There is no other definition of Advanced Degree. Service therefore finds that the certified ETA 9089 does not support the filing of I-140 in teh requested classification. You are therefor afforded this chance to amend yout I-140.

Can you post a link to that IV thread? The reason I ask is because I waited almost 3 months after H-1B approval to transfer from company A to B. I have extended my H-1B once already from B. So I guess my H-1B was not voided for waiting for more than a month.

Today I called TSC using POJ. I provided my receipt number and asked about status of my pending I-485. The lady checked the status in her system and told me that it is under pre-adjudication. I asked her whether it is assigned to an IO or not. She said it is not assigned to any IO yet. Also, she couldn't tell me whether the case is already pre-adjudicated or waiting to be pre-adjudicated. I asked her what the priority date is on my I-485. But she couldn't find the priority date in her system. But she could find the priority date when I provided my I-140 receipt number to her. How does USCIS pick pending i-485 which are eligible for adjudication when the I-485 file on their system doesn't have priority date? Does anyone know how this works?

For sessions I agree he is anti immigrant but then there are quite a few in Republicans who are very strongly supportive of Legal immigration, I can say the same for Democrats and Illegals.
Go and read Economist, Time or even WSJ and you will be able to read that democrats are against legals.
Recently Economist published an article that Under Obama biggest casualty is Legal Immigration.

I am curious to know if many people still went ahead and filed knowing the bulletin changes? My lawyer advised me not to file even though it was ready to be sent out on July 2nd. But since things changed on July 2nd itself, she felt it would be unwise to file and wait for updates.
How many filed anyways? Should I file at this point before July 30? Is it wise to file, since I am reading posts about USCIS accepting July applications?

I had to do ITIN for my wife, so i went to a tax filing company which was like 0.5 miles near to my home, i enter and inside no one there knew anything about ITIN, the lady would go in to the computer and file the tax and she says provide me ITIN number, i am saying i dont have one , i need to apply then she tries and tries and says computer does not allow me to file a new ITIN application, so i am like freakin fedup, then i go to their website and search for a tax professional who specialized in ITIN and found a guy with 20 yrs experiences and who knows this stuff and he is like 10 miles away from my home, but still went to him, and he knew everything, he applied for a new application for ITIN and attached it to my application.
So the moral of this story is "Go to folks who know and who have knowledge" - so look for someone in Tax , who has experience with overseas mortgage and then you need not worry."
When a lawyer gives out advice on immigration matter, he/she MUST be able to back it up (and you, as a client of the counsel have a right to demand) with underlying supporting law or act or a authoritative memo release. He/she cannot "advise" you because they have "always done it for other clients" or "that has been their standard practice."
Similarly, when a CPA or a Tax Professional advises you, he/she MUST be able to provide underlying applicable IRS publication / Tax Law. Simply going to the "right person", who has the (claimed) knowledge or someone who "knows" how to do it, doesn't cut it.
I do not want to get into details (you can find my other related post about IRS publications and treating second home, regardless of country of origin), for Tax purposes you CANNOT deduct your out of country mortgage interest. If you are, if IRS audits your case, try going back to the "go-to guy" who helped you deduct it, and see if he absolves you of "penalty of perjury". He/She will simply wash his/her hands off pointing you to your very own signature (or electronic consent in case of e-file) under the penalty of perjury section of form 1040. Please be careful.

Hi,
As a followup on this thread with slight variation I had a question for all the Gurus.
My wife is travelling to India on AP in Aug (She has valid H-4 till Oct 2010 but she is not going to get it stamped) and I am not travelling with her.
I have a valid H-1 (till Oct 2010) but not stamped too. My EAD is expired and I am applying for renewal but do not have a hope that it will be approved before she comes.
Question #1 - What all documents does she need to carry?
Question #2 - What are the questions they may ask her at the POE?

This is really solid advice for anyone thinking about filing 140 in PP. I think its worth the extra money and the chance of extra scrutiny if there is a clear risk of getting laid off in the next 6 months. If there isn't such a risk you can file regular and if a risk develops you can always upgrade to PP.
I would suggest premium I-140 processing only if you want to port your old PD - possible reasons being leaving the company in future or there is an imminent risk of lay-off. Otherwise it is a waste of money.
