Regarding AC21, we make our own decision as each of us has different circumstances.
Some are already contented with the current employer (petitioner) and don't want to join another company. They do not need AC21.
Some are not really contented with the current employer (petitioner), but don't want to take the risk of using AC21. Let's respect their decision.

Hi - my 485 was tranfered to VSC from TSC last December. Their processing date for 485 is July 2006 :mad:! When TSC is already showing April 2007. Why would they load balance to a SC that is so far behind? Anything I can do to get the case moved back?? Has anybody else been transfered to VSC?

No both partners are seperating and assets and liabilities are divided into two.
1Is one partner buying out the other partner? Then your case comes under company being acquired. Check with your attorney who filed the I-140 and take steps to continue the petition. You can transfer H-1B as well.

I just came back from the rally to Dallas and sad to leave all my IV friends that I finally got to meet today! The rally was a very successful event and the positive energy was amazing! We come from many different places and are from different disciplines, but we share a common heart. A heart that beats for America, and we will not let that heart stop beating! The only option is victory now! We are well on our way, together!!!!

I never left the SSN field blank. I always filled in the ITIN number instead of SSN which has the same format xxx-xx-xxxx.
Yes i used it for the first time also (you need to obviously have the ITIN number in hand to file the taxes)
For first set of questions:
1) you have to file 1040
2) you will get entire refund electronically back to your pwn Checking account (not your wifes unless you tell them specifically you want it sent there). They dont split the money for your wife and youself.
3) you will not get additional $600 due to ITIN.
You could wait until Obama declares stimulus package details - it is quite likely once again that people who have ITIN will not be eligible. however having dependant filing probably offsets that amount as opposed to filing single. I think you have to do some math to figure out which course it best.

It is still valid. However, you need to provide two affidavits from her parents and/or relatives stating that you were born on so and so date and that they know this due to their relationship to her and that they were present at the time of her birth. If you have maintained her after marriage name while filing, think you should mention her former name, along with the name she is currently carrying, in the affidavits. Make sure that you include both affiants and your spouse name, birth date and place of birth in full format. Does her birth certificate include all name in full name format?? It is very important as they mentioned in my RFE. Include any secondary documents such as her school certificates, ration card, medical or any other legal documents showing parents and her full names along with her date of birth. Good luck.

Actually Ilyas, when i look at Dudemans footer, I see a cut-out of a crystal picture, Probably altered the Hue/Sat on that layer, added a black box over the center and altered it's opacity, THEN added the grid via a pattern he made (EASY as hell those grids), and deleted the top part of the grid, altered the grid's opacity too. Then added the text on layers of their own, rendered them to get rid of vectors, and stroked them with a 1 px line (black),

dont have high hopes for a recapture. the year is almost over.. its holiday season mode from next month onwards..
instead of a BIG reforms..we must try for smaller reliefs..
CIR will happen ...but not NOW... Obama has staked his future on health care reforms.. Immigration is a non-issue for now.. the sooner we realise it the better for us.. else..we will be chasing a mirage..

b.) 4-5 year EAD's - without restrictions..
c. Allow dependent spouses to file for I-485 (and EAD) if the PD is not current for the EBX beneficiary.

To properly comment on such questions, one must see all the RFE and denial letter details and the documents you submitted.. Without that it is impossible to get the complete picture and where things went wrong. So I will just answer based on little details I read in the post. This is not a legal advice and I am not an expert. Use it at your own risk.
- First. When you get an RFE for ability to pay, you must always make sure you have a good attorney who can spend lot of time preparing your RFE and is an expert in these matters. Then, if a CPA's help is needed, your employer must get help from a CPA.
- File an appeal. The decision of this appeal will take more than a year. So you can use this pending application as a basis to get your H1B extended.
- If your employer wants to employ you permanently, he can file another GC application and start from scratch.
When I got the RFE, my lawyer submitted the company's tax returns and my W2s only. The denial says that since the employer is not paying me the profferece wages in the year 2003 , 2004 , 2005 and 2006, and also while responding to the RFE Statement from the CPA was not submitted as an alternative to the tax returns since tax returns were very weak, thus the denial. Now the situation is that I know that even after appeal chances of approval are bleak but I am not worried about that right now the reason is at this time I only need to buy some time to apply for a new labor through another company with stronger financial background and that will pay me the right wages. I have alreay talked with that company about 15 minutes ago and they agreed to file my new LC and transfer my H1. I am only concern is how to appeal and buy some time.

But I heard that as long as my 485 in not approved before my marriage I should be able to file 485 through CP or AOS. Is that no longer true? Also is there a possibility that a 485 application gets approved if the dates are not current?

It is very highly unlikely that your i-485 will get approved before your marriage (End of Aug) with so much madness going on. Also, they will send finger priniting notice. You can postpone the finger printing notice (even if you cant post pone, just dont show-up for the first notice). This will buy you some time, but like I said before, you cant even expect FP notice anytime soon.

I guess the best way to project the suffering the H4s go through due to the insanely restrictive policies of the USCIS is to project them in a "euphemistic" way that is more of an attention grabber and the locals can relate to.
I think my favourite is: "In the land of the free, USCIS treats H4 visa holders like Taliban treats women"
Frankly I think the statement is closer to the reality than being a euphemism.
It's worse. People in jails are treated better and can do more than people on H4's
