My I-140 is approved, and I filed I-485 in July. Now, My company got acquired by another one. Old company no longer exist.
Can new company revoke I-140 filed by the old company?
Anyone know?
Personally I faced this problem, employer has the right to revoke the I-140 before approval, also there is a fair chance that he does not respond to RFE which will land u in trouble.
Ideally I suggest you to stop thinking on the idea of not moving before your I-140 clears. Don't say that you cannot survive there, you NEED TO HAVE PATIECENCE, WHICH IS LAGGING IN EVERY HUMAN BEING NOW A DAYS. Also I would say IT IS BETTER TO DEAL WITH KNOWN DEVIL THAN UNKNOWN ANGEL. There is one another say all land look green from distance. So my brother please be patient, you are not gonna earn the whole economy by moving to a new employer. I myself have personally experienced this and also I know both sides of the coin. Every one thinks that these Employers are sucking but they have their own problems. After reading this every one will bang me I know but what I want to say is every one should be patient I mean infact ur employers also.
I understand that you are going through lot of pain, so it be until you clear your I-140. Trust me you will be in good hands once you cross this.

My heartfelt condolences and my prayers to the mom and her family.
I know several attorneys have helped answer questions in this IV website in the past. (conferences etc.) Can we take this up in humanitarian grounds and get one of the attorneys to answer?

Hello All,
I am sure many here would have thought about this since GC (esp EB3) has little hopes.
Wanted to open up pros & cons on immigations to canada.
I am thinking just applying for the PR and kept it as a back up then later decide if moving to canada is worth it etc based on jobs there... family needs etc at a later point in time. I think I should have those this 2 yrs ago and by now I would have had my PR:mad:

Yes I got finger print notification for my son. He is 6 years old. I didnt pay any FP fees. But I got the notification. For me & wife it is on 10/19/2007 and for my son, it is 10/23/2007. Looks like FP is required for Kids also with free of charge.

Sorry to hear about your friend. The job market is very tight for semiconductor industry and more specifically for AMS kind of job. I am an experienced AMS designer and am having a tough time even getting a call. Your friends doesn't have lots of AMS design experience, the job market currently has lots of AMS designers with 10+ yrs exp it would be tough for him to compete esp with a H1. His background is quite related to device/fabrication there are few recruiting going on for those kind of positions. AMD/Globalfoundries is looking for quite a few device folks.

Hi I have a quick question..
I was arrested for aggravated battery. I plead not guilty and fought the case. The judge dismissed the case in single hearing by giving a verdict that i am "Not Guilty". Also my ex filed a 498a case in India. She included everyone in my family. The case is still pending as my ex is here and not attending the court. I was wondering whether this will impact my AOS, I140 and my H1 renewal?
Since AB falls under Criminal Offense, i am worried whether i should even try applying AOS or not?
Please advise.

I can understand ur frustration - now you have some info on how to deal with them - so you may not want to bad mouth them anymore - as such all these consultaning companies have poor reputation.
The governement knows all these things and how these companies operate - there are thousands of complaints. So just get going on what you have to do. Good luck

Thanks everybody for ur replies in the past..! Here's a detailed story of my wife's H1B case - My wife already has a H1 since last 4 yrs with a CAP EXEMPT (company A) employer...This employer had refused to file for GC hence we thought she should switch to private company thru new H1 and start working there OCt. 1 2007 so that at least she has a chance for GC to be filed. So her H1B was filed on April 1 2007 thru a consulting company. She would have quit Company A and would have started new job on new H1 from Oct. 1...but now we have applied for AOS/EAD and also i must mention that the H1B with COMPANY A is valid for 2 more years...and she has a good job there.! So no need to switch to new H1 and no need for new job.! hence i told the consulting company that we do not want take the job and to withdraw the H1 which has not been approved as yet..we only have RECEIPT #.! I am willing to compensate him for his expenses that he had to pay to file for H1..! This is pretty much my story..!!

Applied on Jan 28 2011.......got it yesterday Apr 14 2011.
I think the USCIS online system has conked off or has a 10 day delay. So far there is no online update on my status and same had happened when I had renewed my EAD in Dec, they updated it 10 days after I had already received the card. Even the phone operative had no idea that they had already shipped the card and only kept parroting what was online.
FYI, I only got a 1 year renewal not the new supposed to be 2 year one.....:mad:

United says there has to be a Code (CPT code) of some sort that Doc will bill against.
Doc says ther e is no such code for the Immigration Physical, so they cannot bill the Ins Co...
Nothing really I can do here.
But for immuniazation, i can go to my Primary care Physician and get the shots whcih will be covered by Ins..
I am sure other Ins Co's will be different.
The doctor can and should be able to give you code for each immunization or test. Now if the insurance company is involved they have to provide the same service at the discounted price. That is why you see different rates at different Doctors.
Well I had to fight for it but it was worth it. When there is reason and logic involve I can fight its the illogical and unjust systems like USCIS that I can not!!

Everytime I start to ask myself or my foreign workers colleagues these questions, the only answer we keep arriving upon is that the business lobby along with foreign business lobbies want cheap labor. Companies may choose to outsource it, but it is even more attractive to bring labor here where intellectual assets are more tightly monitored and schedules are more easily managed. Net result, win/win for the business and lose/lose for US citizens.
Im just saying....
that is your version of reality. You are gathering evidence to prove your assertions. All this anecdotal 'evidence' and you performing these field surveys tell you what you want your mind to listen. Maybe it is time to take up the issue to your company's HR. Why are your foreign worker colleagues telling you that they are cheap labor? and when they made that assertion, you took it lying down ?
The current economy has many IT professionals out of work. Yet, the visa workers remain. Students graduating in engineering in top US universities cannot get jobs. Why?

We should write to Zoe Lofgren, Chsair of the House Immigration Subcommittee, and Senator Ted Kennedy....USCIS ought to have some accountability. This is pure discrimination based on chance....you'll get your GC sooner if your aplication goes to NSC and it will languish if it goes to TSC. This is not fair. First you have the country quotas that discriminate based on national origin and then you have service center problems like these..
Anyone up for a phone/fax campaign to LOfgren and Kennedy's office. They are as pro-immigrant as one can get in this ebvironment.
