You are right about the temporary license in that it is given during residency training.
But in my own experience i was given a temporary license (restricted privileges) after all the paperwork is submitted.This is because sometimes the board(state medical board) meets on one set date every month and you have to wait till the board gives the approval.
Now as far as USCIS goes as long as the application for H1B is filed i think one is ok because by the time they look into the application and then ask for the medical license it buys us time to get the licensure done.Now again this is a grey area but as per my attorney and my own experience USCIS is not worried about the 30 day rule as they know that the 'resident' was not out of status prior to the H1B application.
My own experience- the state of georgia does not issue license for IMG's (foreign med graduates) till the completion of 3 yrs of Graduate medical education.So i was in a similar situation. But the licesure application was applied 6 months prior to completion of residency in anticipation of this rule.
But the georgia state medical board knows this problem ( and one of the best state medical boards to work with) and issues temporary licensure for visa issues.
Again it is subject to individual state medical boards.....

Any advice
I work as a dentist in a company which was held in partnership by 2 partners.I have a approved H1b and my I 140 is filed.Now as of Oct 01 the orriginal company is finished as the partners have seperated.I am confused about my case, if I have to file a new H1b and 140 or an ammendment or just nothing.The tax id number for the company has changed.As for me my work location has not changed and I still work in the same position.Can I take paychecks from the new company which now belongs to one of the partners or do I need to inform immigration.Any advice is appriciated.

First time I came to US on 12/15/2000 and left US after 86 days that is on 3/10/2001 , during this period I didn't had any paystubs. I re-entered to US on 12/15/2002(this is my latest entry into US) , I don't have paystubs from 12/15/2002 to 2/14/2000(60 days) ,i have paystubs from 2/15/2003 to 4/15/2003 and again I don't have paystubs from 4/16/2003 to 9/30/2003(165 days).After that I have continuous paystubs.Does it mean that I was out of status for more than 180 days(i.e 60+165=225 or 86+60+165=311) or I was out of status for just 165 days .Maximum continious days that i stayed in US without paystubs are 165.One more thing my employer(s) didn't generated my payslips though I worked for some days.My Labor and I-140 are cleared and my I-485 reached CIS on 07/09/2007.If I am out of status for more than 180 days what are the options i have?

Choosing to sing or not to sing the Anthem is everyone's right. Even some Americans refuse to recite the Pledge of Alleigance. Yet, at IV we call ourselves what we are "Future Americans" and therefore this is our Anthem. Just like many of us are from India, China or elsewhere most Americans also have foreign ancestors and feel a closeness to those countries on some level. Yet, the idea here is to show respect for our new country, the country that we have adopted, and which has adopted us.
Americans appreciate people who come to America for true love of the country and wanting to assimilate and contribute to its greatness. Look at what the illegals did in their rallies carrying Mexican flags and translating the Anthem into Spanish, rightfully angering American citzens. This is our opportunity to understcore how totally different we are from illegals and how we have earned and deserve our green cards.

It is raining now. After seeing the visa bulletin, it depresses my mind terribly in this gloomy weather.
Two month movement is not enough. Per my calculation, it should move at least five months per month. There is some part in the picture, which I don't see.
Counting from today, May 1, 2002 is almost 4 years and 5 month apart. It means it takes at least 4 and half years plus the third stage processing time whatever it may be.
Four and half years is just too long in this modern world. You go through changes in your personal life, family, and work situations in four and half years. You develop your new talent and equipped with new skills. Sitting in a same job without promotion for over four and half years is just too long. As our current job is the life line that is linked to our spot in the que, we tend to panic over minor matters at work and it is hard to defend ourselves. When your whole family is depending on it, it is more so. Professionals with bright minds like us cannot be kept stagnant and status quo for such a long time. It is same as killing.
Well, I cannot go back to my home country. I have invested everything I have in this country. I have developed skills that better fit to U.S. I don't fit to my home country any more. I can contribute much better to American economy. My kid even cannot speak the language from my home country. My child is so young that she doesn't know that she does not have even a social security number. (All of my family are in legal status. Never illegal in a single day. For children, they can have SSN only after issuance of GC. ) Nevertheless, my kid is 100% American in her substance.
I understand it is taking so long because of the gap in supply and demand. And I also understand that we are imposed of various restrictions in our life before getting the green card. However, just a little more flexibility will save so many people and rescue them from their tremendous daily pain. For example, if they could allow us to change our job in the same category after first stage and then allow us to change our job without restriction after I-140 approval and be able to process the application in continuance without causing any break. I think the method in U.K. and Canada are close to this and causing less restriction to stick to one employer or the same kind of employer. The current U.S. system is just feeding immigration lawyers because many of us have to do the process over and over again from the beginning with a different employer.

This is sooooooooo true... but again we made the choice of coming here and i dont have regrets about that because obviously i would have never dreamt of making the money i made here back home !
but again after 5 years of waiting and 8 years with the same job it sucks !!

If you wanna hear something REALLY stupid here goes. My wife wants to do her CPA in PA since we are living in PA. But guess what she CANT. Why you ask? Coz to even DO a CPA you need to have a SSN. Yup u guessed it, cant have an SSN if you are on an H4. So now she has to do it in DE becoz of that.
Does anyone know if that is enough grounds to get an SSN? I mean the CPA in PA does not let you even STUDY if you dont have an SSN.
If anyone knows about this issue pls let me know.

You shold have a official letter from the organization that SSN is required. I used to live in PA and my wife had to have SSN to take her BAR exams, i showed the requirement letter from BAR council and they gave it to her.

Please use the WH4 form, you can google it and get this form. DOL lawyers are generally responsive and make sure the company gives you thee money.
Always save all your communication emails in your sent folder - and if you are working for a client - your manager signs the timesheet - report to them about this employer - your manager will not likethe fact that your employer is not paying.
When you file complaint uisng WH4 - include all evidences and DOL lawyers will help you with the stuff.

The reason for delay is because your brother's file is most probably sitting on a desk at DHS....they are really slow. Same thing happened to my wife...we just kept bugging the SSN felow daily after 2 weeks were up until he finally picked up the phone and called DHS......the file was cleared in 15 minutes....we got the number next morning and card in mail within a week.......

Talk to the doctor to whom you are going for your canadian medicals and ask them.
If they dont have any problems. Sometimes u need to persist with them.
Once they say YES, u r all set and iam sure u will be able to save money.

many people I know got ead approved on june 30th , for 1 year, eating up 3 months of old EAD time, thereby they got only 9 months
