I dislke the idea that we are getting bogged down thinking about an organization whose very existense depends upon serving immigrant community if AILA tries to sabotage our efforts sooner or later it will come out and that will act against AILA and probably that will make people realize that nobody is going to help them except themselves. I hope we realize it sooner than later.
I do not see how AILA can lobby against it (*premim processing*) publicly and claim to work for immigration community. They may not help us but they can't cause hinderance publicly.
It also makes me think why should there be any attorney involved in this in the first place, like drivers license do we actually need an attorney to apply or a passport. I am not suggesting that the GC process is that simple but attroney him self is another layer..

Thank you all for your posts. It is really helping me think through this issue.
I spoke to my sponsoring manager (Director of IT) and he said the following:
i) the Senior position is not available yet, and only in early next year would he be able to discuss it with senior management.
ii) he is not aware that the position specified in the I-140 need to be offered as soon as GC is granted (nobody expected the GC to be approved so quickly in my case)
iii) he still wants to see "more improvements" in my skills before I could potentially be promoted to the Senior position
iv) he will make me sign a document saying I will pay for the entire cost of the GC process if I leave (he did not yet specify a time frame for this).
Does anyone have any comments on the above statements? Do any of them jeopardize my GC in any way? Aren't they STRONG reasons (i..e, acceptable to USCIS) to start looking for a job elsewhere?

Hi Guys,
Because I have valid H1 and the dates were current, decided not to renew my EAD by hoping that I will get my GC. But nothing happened as per my expectation.
Recently couple of weeks back I applied for EAD renewal, but after that because of this bad economy lot of things happened at work and I started looking for a job. Even though I can work in the existing company till April mid, I aggressively started looking for the job and in fact two companies are ready to offer me the job. I am expecting offer letters from both the companies next week.
I am not sure whether these companies will transfer my H1 or not? so far we didn't discuss that during interview. Because I have been working in US last 9 years they might have thought I have GC. I will try my level best to convince them to file for H1 transfer, but in case if they didn't agree for that I need to go for EAD. One of these companies is Public company, so it's very difficult to convince them to file for H1B transfer.
I am sure lot of people might have went through this type of scenarios, can some one suggest what are the options I have and which option is best? Few things I can think of are
-- Go to local INS office, explain the scenario and get the interim EAD
-- Go to local senator or congress member's office and request them to give me the recommendation letter

I recently renewed our passports and did not find ECNR stamp in the new passport. Our old Passports had the ECNR stamps. I checked with Indian Embassy, according to them ECNR stamp is not required in the new passports as there is electonic reading strip on the passport photo page.
I am not sure, but this was their answer. I will appreciate, if other members who recently renewed their passports will confirm if they have or don't have this ECNR stamp in their passports. Thanks

My Attorney filed AOS for my spouse, myself and our daughters (aged 16 and 13) with filing fees of $395 each. Later on, he realised the AOS filed for 13 year WILL be rejected for improper filing fees (as the correct fee is 225 and we sent 395 and he has to re-file with correct fees, thank God PD was still current). As expected her AOS got rejected and we got RN/FP notices for all other but for her aos. I am yet to get r/n for her re-filed aos.

I take it that you are under retrogression. You could use AC21 and be on the EAD, provided the new job is similar in nature. Check with an attorney.
H-1B after 6 year period is derived from the pending GC application. If your GC is rejected, automatically your H-1B is also invalid. As you are on H-1B extension beyond 6-year period, it does not matter if you are on EAD or H-1B. There is no switching back to H-1B unless you leave the country for one year.

Guess, they have many people sitting on bench unpaid, they did not want to add one more to the list, given the economy and etc.... The company would not have told you this in writing - they can simply claim that they have first class mailed the petition and have not heard anything from you, this will take them off hook or any legal obligation.
One does not need SSN to start working, but need SSN to process payroll. The REAL corporation pay company check, if you have joined them and not received the SSN in 30 days and later process the payroll reflecting the complete pay period since the join date.
Aren't you and your sponsoring company abusing the sytem?! This is the 6th post that I am aware of.... Anyway, travel outside the country and come back on H4.... and File complaint against the employer with DOL and USCIS, if you and offer of employment was genuine.
On contacting my employer they told I am still on H4 status and will be on H1B status only if I apply for SSN.

I think all those things were OK when economy was good. Now the table has turned. It gives them more justifying reason to object on self-employment. My opinion.

One of my friend, he came here last DEC 2005 from India through Atlanta based consulting company. My friend paid for his H1, he paid for Air ticket to come here. The company never gives any support to find his project. They did not give him accommodation and relocation. NOTHING from the company side for the past 1-year� we friends helped him by providing accommodation and food. By this FEB end his H1 is going to over (first 2 1/2 years approximately, he came after one year from approval). The company is not helping him by applying extension. Now he got one job, his company is not willing to sign the contract for this project. (Reason: They have to apply for extension, But they are telling their attorney advice them not to sign the contract since he is here for an year without their support, that will give a problem to the company). There is no other way for my friend other than to transfer his H1 to some other (good) company� but He doesn�t have a pay slip� What to do? The entire fault is from the company side, but my friend is suffering. (He spend his H1 cost + Air ticket for nothing�) Is there any solution for him? Please kindly advice /suggestions and Ideas�
