No offense to the OP and Thanks for posting this, but this thread is kind of diverting us from some of the efforts currently in progress, we are again playing the prediction game.
Lets contribute to the FOIA funding drive and get the right information.

This thread should not divert our attention from FOIA action item. We just got some information through senator. It does not have enough details to conclude anything.
This response should help us to focus on what to ask for in FOIA/efforts through senators. It is a pointer that we won't get the required info unless we clearly specify what we want.

Hey guys, thanks for the replies and the good advice, which helps a lot. It's true that prevailing wage for H1b and CG are different, so I don't think my employer is breaking the law...at least not yet. (Logiclife, what do you think? Wouldn't the attorney had told them that they are breaking the law?) It's just a hard reality check to realize that all the "we care about our employees" is just a smoke screen.
They do care about employees. They just can't handle immigration and visa issues. It is too complicated for a lot of employees. For a lot of employers, the term H1b visa or sponsership gives "jitters".
While a lot of employers look at things from their perspective, they do understand all issues that you face. It all depends on how important you are and if your absence would make a difference. If you are irreplacable, and employer thinks they must keep you at any cost, then they will do it, or you have to take care of yourself.

Logiclife, I am sorry you are wrong.You don't need to post hour by hour update, but the update you posted today on Aman's meetings , help people to understand what really IV is doing and are necessary atleast once a fortnight.I am sure you are working in a corporate world and drive projects.The first rule on driving a big project is status meetings once every week.This helps all the stakeholders.

Got a RFE for my spouse's TB test as it was not submitted at that time...
gcisadawg, remember, you can get from a pediatrician or whoever BUT as you know they should be "Certified" by USCIS for you to go get from them...dont forget that..and based on the links I referred to you earlier you dont have too many options abroad...basically a center where you may have to go and get there..
To avoid all these headaches I would go try to get more time by asking USCIS..

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status? This is crucial to know before jumping to conclusions.
It was received well within time. If they don't receive resonse to request for evidence; they specifically mention it in the denial.
right now; there is issue with on-line case status with uscis. Not always updating. This is not what it is.

Couple of my friends, who have 3 year degrees from India and also have 2 year Masters degree from India, have not been able to apply for EB2. Their lawyers suggested that 3 year degree are a hindernace to get EB2. They both have not tried applying for EB2 and both have active EB3 applications.
My M.C.A was 3 years. this will help?

I talked to my lawyer today about what he thought about this new development and he indicated that there might a court challenge to this new rule. Now from a lawyer's and employer's point of view, I can understand their frustration and they certainly have the money to drag this thing in the court for a while but the question is will they? And if they decided to go to court, will the new rule be halted until a decision is made by the court? He indicated that the least the lawyer's and employer's might accept is to exclude the existing approved labors from being affected by this new rule.
Let's all hope that they don't succeed; otherwise this new rule won't help us as much as it could.

They need to enter data into their system before they reject.

I clarified this by looking at the records in tarckit. There were people filed on 05/31/2007 to reach on 06/01/2007 and got the the receipt.

My lawyer says mine was received on july 1st. I am yet to receive a reply from my lawyer. What will happen to the applications received by USCIS on sunday?
