What the first post might mean is this.
DOS has already allocated the available visa numbers for this fiscal to qualifying pending cases. There are are no more visas left to allocate.
It is still completely possible that there are ~ 14,000 pending cases with visas already allocated - simply awaiting approval by USCIS.

I wrote a letter to the university chancellor where I graduated from and urged him to use his power to influence lawmakers to pass STEM -or similar -bills or face the consequences in the form of dwindling enrollment of brilliant students. I used strong but not so harsh words. Refer to the following thread.

My state chapter leader was also excited about this idea. I posted the letter and the chancellor's response on this forum only to motivate someone 'higher up' to read it, endorse it and make it an action item for everybody (with a US degree). I feel now that I did my part as a dedicated member but the IV leaders (those who have the authority in IV circle) failed to lead my initiative or take it to a higher level (may be I am not able to find better words here).
Usually discussions get buried in forums. People open all sorts of threads and discuss - which is fine, but when some real effort is going on - I recommend the person who is behind it to own the effort. Thats what IV is - everyone MUST own the effort from start to finish and not give up or pass it on.
It is difficult for people to spend the time and effort in a thankless job. And we all need a lot of motivation and courage to do things. We are all professionals and currently dealing with politics and bureaucracy - must understand how difficult it is.
Below is for all readers
I just read the messages from Aman and Pappu - their tone is understandable - they are definitely stressed because they have to deal with all this. Am sure they are definitely looking for committed individuals who can help them and who can be trusted. There must be more than 100% commitment to do what they are doing.
Is it possible for everyone to commit themselves at that level?
If not can people do the following at the least?
(1) Provide correct information
(2) Contribute monetarily
(3) Join State chapter
(4) balance their schedules and create some time for IV and do at least something
(5) Stop crap talk and blame games and concentrate only on useful stuff
(6) Contribute in any other way - publicity, convincing friends, coming up with innovative ideas .....
(7) Channelize all your frustration into positive energy.
Based on commitment, availability, skill, trust IV can definitely utilize your help in different levels, maybe ann admin, maybe a chapter lleader, maybe a chapter member , maybe a media coordinator ...... Do you have that in you? Are you willing to do it??

I have a problem where my "Given Name" is entered as "<first name> <last name>" in my passport (India). The "Surname" is left blank. I have been in the US for 7 years now and it has never been a problem so far. I usually enter the "<last name>" in the last name column on all documents. I wonder if this will cause problems during the I485 name check stage. Any one here who can throw some light on this issue?
I realize that the question is a little weird, I appreciate any response.

I had the same issue and I got it changed from Indian consulate NY. The whole process took around a week. You need to advertise in local newspapers which is not a big deal. Around Rs 200 in indian newpaper and $70 in US newspaper (Classified section).

According to a specialist on immigration forums "Mr UnitedNations" the unused visas are directly being used for EB3 ROW , I am not how he knows that but maybe thats what is happening.
Maybe EB3 ROW being a diverse group is being given more precendence than highly subscribed countries.
This information was there on a visa bulletin. This is not a guess but a confirmed fact.

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact others basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damege or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.
Bill Clinton did a wonderful fix by signing AC21 which corrected many shortfalls of immigration law.
I am personally not impacted by backlog. However, I am feeling bad enough for the failure of current sysem that overlooks human tragedies. 180-day name check fix is a commendable step by USCIS (brought about by healthy debate and do not look at this as court-imposed). As in the scientific world, peer review and criticism is taken seriously in this country. By law suit, we are trying to create peer review or honest analysis about this impasse. No body wins but the truth and humanity.
If there is any way to open up annual quota (recapture, family members exempt from annual limit or any measure I am not aware of), automatically everybody could benefit. It may be also possible for EB3 to interfile or refile for EB2 and take advantage of old priority date and shorten the wait. there is ot a magic wand. I think we should start a campaign where members will contribute $25 for every 2 months (recurring) untill another 6 months.
So, immigrationvoice would be adding funds to the tune of 175K every 2 months and also $25 every 2 months is not a big deal for most of us.
This way we are guranteed atleast some portions of our funds. Even if $25 is a lot of money, $10 can also be acceptible if they are paying a recurring payment. To sustain this campaign and maintain our presence in this space we need funds.
Let us know, who are ready to sign up for this campaign?

If all members get active, there is no doubt that we will succeed very soon.

Pascal ... I really admire your straight thoughts. I am watching this EB2 Vs Eb3 uproar from last couple of months. Its amazing that we are more focused on this useless conversation rather than taking positive steps and spending our energy to fix the problem. Only if all the affected people start contributing money, start organizing the state chapters, and start participating in the IV activities .. we will see some light at the end of the tunnel. It purplexes me that people use this forum to start war of words, just to keep them busy, but seldom use the forum to unite themselves and fight for the cause.

How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".
EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.
You are critizising H1B indians and their employer screwing the system which is not relevent to what we are talking here. If you feel so, then attack who ever spoiling the system and regulate those. Instead you are trying to justify your interperataion is right and what DOS is doing is right. I will be the happiest person if they ban labor subsitution and ban desi consulting companies or H1B dependent employer participating in GC sponsering. Then this mess might have not happened.

Let me add my observations here:
For people who doubt where all the money is going, remember Aman founded this organization putting his own money into this ( not in hundreds but thousands). He and some other core members has already got their green cards, but they continue to work for this cause. I also remember Aman and core members saying this "It is not about you. It is about the community. You just don't think about yourself, you work for everyone." Most of the talk points for meetings were meant for relief to the entire community, not a specific group.
For me, I had to go for a meeting alone. Initially I was disappointed, but I could handle that meeting very well, thanks to IVs training session. For those who are apprehensive about attending these meetings -- It is pretty straightforward if we follow IVs talking points and presentation style. We cover ourselves well with arguments and counter arguments during training session.
As for meeting lawmakers, it will always be a pleasant experience. This is the greatest democracy on the face of the earth. Lawmakers will lend a patient, listening ears to your issues. No worries there. Also fixes to our issues will benefit not only us, it will help this country in the long run. If you haven't met your lawmaker yet, please plan meeting them and let them know your pains. A meeting from a constituent is very valuable for these lawmakers.
A request to IV core:
It is better if IV could conduct the training in different state chapters, so that people will feel more confident and less apprehensive in meeting their lawmakers.
