    Yes, that is right, I said “plight of EB2-India”.

    I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...

    Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.

    Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.

    There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).

    All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

    For all the attacks that are bound to happen, here is the fodder.....this is probably my first and last post, I haven’t contributed a dime to IV, will work here as long as I like it and if not, India is a great country and provides enough opportunities for any skillset !!

    most ridiculous argument and surprising because it is coming from a Phd. Surely, you must have defended your doctoral thesis, or did'nt you have one ? :p

    The people who go for Phds should know that they are sacrificing short-term future cash flows in exchange for a far superior long-term cash flows. The others "EB3" go for a more milder but increasing series of future cash flows.

    To each his own!!! But when people say that "my career is over because my gc is delayed" UNDERSTAND that they are venting their frustration. It does not mean that their career is really over.

    And, like you, they will also work here as long as they like it and if not, go back...

    Let me tell you about my experience. I had accident two times one on the street in front of stop sign. My mistake. The other guy hired an attroney to get claims from me. My insurance attroney went on asking for more and more time and finally they made a settlement around $2K. This is a normal american negotiation
    My second accident, it was on the freeway and a BMW car hit me at the speed of 70 miles. Called 911 and medical came and asked me whether i was okay and i had no problem the other car bumper was dislogged. They went to nearest medical hospital and was reported a scratch on their body. They made a big claim. My insuarance lawyers were not able to solve the case so the insurance lawyers hired a expert lawyer for me. I met the expert lawyer and he asked me about the accident. He told me that this is a normal way of opening a big window and the insurance lawyer has to close them. Once i got the court paper work he replied with a letter for 90 days time then delayed more. The other party was paying for his hired laywer to sue me and was draining money in the end he signed a full release paperwork with little payment.
    Another case, of my nearest friend, Her daughter was tralleving with her friend who was driving the car and dashed on a pole and the passenger girl died on the spot. The girls parrents put a lawsuit and the other person had millions in his bank account (the car was insured with min requirement 15K/30K..) the case went till 4 years and in the end the lawyers made money and settled the case. They blamed the state for roads.
    This is how the lawyers make money. Don't worry about anything. Take it easy Whatever happens. If you want remove money for your personal expense like parents needs in india and send them. It will take 18 months to solve and the judges are also bored becasue they hear them everyday.
    My insurance lawyer told me this is the way we all make money so don't worry don't talk to the other party. If you get any letters send to the insurance company.
    there was a another accident one indian driver made a left turn when the lights were green and three cars hit him. He had minimum insurance and he emotionally suffered for few months. All the other cars who hit had to fix their cars.
    (all the above incident happened in CA, and i had been in US(CA) for 7 years).

    Don't worry. I drive 100 miles on a busy freeway everyday. Nothing happens if you don't have money.

    This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.

    Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.

    Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. If you need more info on this let me know I have gone through this and waited for almost three years to file for my spouse I resheduled my FP notice in 2004 to get married by the time my wife came retrogression kicked in and waited till June 2007 to file for my wife. My PD june 2002 still waiting

    I don't think AILA is fighting this memo on the grounds that it is illegal because of the fact that E-E relationship is illegally defined by USCIS, but they are fighting on the grounds that it is illegal because such directives should come in the form of laws!

    Simply put, they are telling USCIS to follow the laws passed by the Congress without providing their own interpretation. This could very well apply to AC21!

    EDIT:
    After re-reading AILA's response, it appears to me that they actually don't have a strong case to say that the "EE relationship" definition is illegal. They are going with the argument that a precedence has been set for 50 years, and that is one of the main reasons why USCIS should continue to interpret the EE relationship that way. I'm not sure how strong a case this can be.

    Re-read AILA memo once again. You haven't noticed the main point yet. Precedence is not their main point. Precedent just provides an additional support. E-E is the most controversial item in the USCIS memo which also is illegal.

    Make H4 illegal and get a job in farm land. Then in two years you will get your gc as dependent. Just kidding.

    This country does not like legals. We have to get all the illegals(if agjobs bill get passed) on legal boat behind us and at the end they will also realize what the sh..t it is to be as a legal in this country. Then IV will get more members and funds and they will get united with us.

    Again, if they take different queue than us then we are in SOUP. We have to make sure we get our bills, if somehow we fail on this and illegals gets something, still we need to make sure illegals come behind our queue. If this is done, then even our little whisper will be heard across the globe. What a pity situation for taxpaying legals. By this time, it will be 2025 and my son will take care of me.

    February 2006 - Every time I visit Silicon Valley I'm reminded of a simple fact: American businesses lead the world because they employ talented people. From the top executives at companies like Apple and Cisco to the science and engineering students I'll speak with Monday at San Jose State University, Americans sit on the cutting edge of technology.

    We have less than 5 percent of the world's population but produce almost a quarter of its wealth and enjoy the highest per capita income of any large industrial economy. Americans receive more patents than the citizens of any other country, have the world's best university system, do most of the world's basic research, and take home the lion's share of Nobel Prizes in the sciences.

    As many people working in Northern California's technology sector have realized, however, we can't afford complacence. China and India together now produce at least twice as many engineers as the United States. Both have fast growing populations and high-quality universities. In search of profits, companies have begun to outsource more low- and medium-skilled jobs to these nations.

    No amount of funding, furthermore, would allow the United States to catch -- much less exceed -- China and India's combined production of scientific personnel. We just don't have enough people. Even at our own universities, foreigners earn an ever-increasing percentage of degrees in the hard sciences. Some remain, but many end up taking their valuable skills back home. American companies, meanwhile, have thousands of scientific and engineering openings that they can't fill.

    If we hope to remain the world's pre-eminent economic power,/ we need to produce more scientists and engineers and train them better. One recent study, indeed, found that 85 percent of income growth stems from technological change.

    While every American deserves a high-quality education, we need to target additional resources on the most talented students to ensure America retains its competitive edge. In particular, we need to provide an incentive to all of America's bright, driven low-income students who want to pursue careers in the sciences. Right now, far too many talented students from poor backgrounds drop out of college or shift away from hard science because of the expense. It's bad for the country.

    One program that the president signed into law earlier this year takes the first major step toward fixing the problem. The SMART Grant program, which I developed, will focus assistance on students in science, math and strategic foreign languages who earn B averages or better during their junior and senior years of college. Next year, the California State University system estimates, more than 3,000 students systemwide -- including many at San Jose State -- will benefit from the program. Many will have their tuition payments eliminated entirely and the numbers will rise in coming years as the program attracts more people into the sciences. Thousands more students in the University of California system will also benefit.

    Of course, tuition subsidies alone can't ensure that we'll have enough talented workers. In the coming months, Congress will consider the president's proposals to improve K-12 math education, increase funding for basic research, support high-risk/high-reward applied science projects, and make the research and development tax credit permanent. Fiscal realities, of course, will play a role in any final decision as Congress examines these proposals.

    Silicon Valley companies already do an excellent job recruiting America's best and brightest. Now the government needs to build on its efforts to increase the ranks of homegrown scientists and engineers.

    1 week after getting approved, I got the card in mail today.

    All the work that I put in the last 2 month to get my file picked finally comes to an end here. It's good to see that people are proactively calling USCIS and following up on their cases.

    Good luck to all EB2 folks who are current and waiting and to all the EB3 folks, hope you guys become current soon.

    Well, I could read out for you what you wrote. You wrote that - "I am EB3-India, yet I dont support the removal of per country limits, as there is a reason for the diversity rule, Indians and Chinese are currently on the wrong side of the equation so it seems "fair" to remove the quota."

    Does that ring any bell?

    And, if everybody was promised the current system, then there should never be any change, ever, because whenever you make any change, it will be unfair to the people who are waiting at that time, right? Even the increase in numbers or recapture is unfair because when we applied, we did not know if recapture will happen, right? So why change. There should be absolutely no change because my galactically stupid friend sc3 thinks he was "promised" something. Open your eye, there was no promise made to you or to anybody else, the system has evolved and will continue to evolve while we continue to wait for approval. Its ok if you don't believe in evolution theory, maybe that evolution thing is also "unfair" and "wrong". You see as we all continue to learn, we all continue to improve us and our surroundings from that process of learning, but there are some who do not want to improve anything, inspite of learning. Here you can argue that learning process is at different level/speed for different people. So that would be quite understandable.... you know what I mean


    So where did you learn your English? Do you even know how to read sentences? I suggest you learn how to join words and make sense of what is being said. Then and only then comment on what is being posted.

    Also, Before you call others stupid, make an assessment of your own stupidity.

    If you want to argue, then argue how is the removal of quota limits fair for ROW applicants. Don't throw out unrelated arguments.

    You do NOT have to go anywhere - what you are saying is "SBI Rapid Remittance" by SBI where the money will reach your Foreign account the very next day ( But you might have to wire the money as well to BOA-NY or SBI-NY ?)

    I really dont know how this "reputation" system works. But some poor frustrated person out there (I have a guess who that is :) ) just left me this comment on my post
    "i am taking you the wrong way...you deserve it!" :)
    With this attitude, we will all be stuck in the crab-pot for ever. Lets be positive and try to accomplish something rather than just be grumpy negative people like ahem...cough!! cough!! - someone on this thread. Lets debate things openly and see how that goes. Cowards rarely win anything more than a battle or two - never the whole war.


    I started visiting this forum only recently. From what I have seen briefly, I can say that the actual contributions in terms of effort seem to be coming from members like Pappu. And I really appreciate that. I see people here and there saying that IV isn't doing anything useful etc.
    My point to such people would be - no one is stopping you from organizing a rally or doing a hunger strike or whatever it is you have in mind. Lead, and we shall follow. These efforts that are being led by IV core leadership doesnt detract from whatever you want to do.
    Dont take this the wrong way. From what I have seen in my very brief history of following these forums, this is one of the few immigration forums out there that is not driven by ulterior motives - lawyers' interests etc. Please, please, as a favor, do not drag this effort down. I understand many of us are frustrated, but let not the frustration drag us down deeper into the hole. For people who don't agree with the policies here, put forth some constructive suggestions and see how that works. If it doesn't work, well you have realized how tough it is to get a group of people follow your conviction :) And then you might develop an appreciation for the work being done here.
    And if your approach works, hey..excellent for all of us. But please don't put forth only negative criticism.
