On one hand we want to hasten the GC process so that we can become citizens and enjoy all the freedom and benefits, and on the other hand, we are hesitant to sing the US national anthem?
Anyway, not everyone has to sing the anthem. I know the words but I find it too difficult to sing it anyway. But there is no harm in someone else singing it to show respect.

I raised a second service request about 23rd April, so USCIS had until 24th May to adjudicate. I had them record in that service request if there was no action by 5/24 that they would next hear from my Congressman's office, and I had been preparing for WOM if that got nowhere.
My wife had to travel yesterday, so I'd been a little distracted recently. I just got round to calling law makers about bills this morning. So I'm still active, and still a spokesman.
She will be in the limbo state when she returns not really H4 but no I-551 in her hand either, and no AP. However, all my research on this leads me to believe that IO's are sensible humans, indeed we spoke with an IO last night at the airport, I've given her the receipt notices and USCIS memo about H class travel without AP, and a cover note.

I know him personally but unfortunately cant vouch or have any experience of his professional competence. Hi,
I have a quick question, I received the RFE from USCIS to provide them the BC of my wife.
We did not had BC at the time when we applied for I-485, so in June 2009 i asked my in-laws to get the BC for her.
They are able to get the BC but the BC has registration date of June 2009 and Issue date of July 2009. On the BC my wife maiden name was used i.e. the name which she use to have before getting married. We got married in 2006, and then her name was changed.
My question will the Issue date or the Registration date be a problem. Like when she was born she was not registered, therefore, no BC was obtained back then. But now she is registerd and thats why we were able to get her BC. So thats why the municipal listed the current dates on the BC.
the BC contains all the necessary details such as MOTHER NAME, FATHER NAME, PLACE AND DATE OF BIRTH, CAST etc....there is no information missing.

Applied on Jan 28 2011.......got it yesterday Apr 14 2011.
I think the USCIS online system has conked off or has a 10 day delay. So far there is no online update on my status and same had happened when I had renewed my EAD in Dec, they updated it 10 days after I had already received the card. Even the phone operative had no idea that they had already shipped the card and only kept parroting what was online.
FYI, I only got a 1 year renewal not the new supposed to be 2 year one.....:mad:

You have to fill out forms but that takes just 5 minutes
In our case we had to wait 1 hour after filling forms to get finger printing done as there were a lot of people for FP at 8 am. Instead of giving people staggered times they gave 8 am to everyone and so even though we got there at 7:50 AM, we had a long line ahead of us.
The finger printing itself took only 5 minutes. Like monkeyman said, dress smart as they take a picture, probably for GC.
Also I saw quite a few people with kids.
We finally got our FP notices and had some questions about process itself.
- Do we have to fill out any forms etc after reaching ASC? Or just the FP notice along with supporting documentation is enough?
- How long does the biometrics capture process itself takes?
- I am in situation where we may end up taking our little kids with us to ASC (they are not part of AOS). My wife and I have appointments one hour apart (0900 and 1000) and was wondering if kids may be permitted inside the bldg or we could take turns with them in parking lot while the other one is inside for appointments. knowing the process times may help us decide how do we handle this.
I am worried that say my wife's inside for her 0900 appointment and I'm waiting with kids and if she's not back by say 0945 - I am considered late for 1000 appointment or something like that.
Any help appreciated.

I agree that software jobs in INDIA are more in number compared to Canada. Ofcourse India as our HOME country, we will be closer to friends and family. But work culture in India not really great compared to USA/Canada/west. I worked in almost 5 countries and only in India it is expected to work most of the weekends and long nights. I know a lot of people whose salary in Canada (particularly Alberta/Toronto) getting around $85 USD. So it is up to the person to choose between India/USA/Canada

Don't get so upset. Your questions are exactly what this forum is about and the reason you got the raction, you got, is because you are not new to the forum and hence, percieved to know this. Anyone who has been here a few times, would know these issues as these are discussed every few minutes.
When you switch employers after I-140, even though your PD is yours, your new employer would have to start PERM and I-140 for you again. So after this "new" I-140 is approved, depending on your PD, you can file for change of status (485 or consulate processing), and fingerprinting is at that time.
Now if you were not indian (or chinese, mexican, or philipino), you could have been able to file I-140 and 485 the same time ,as your russian friend did, as these countries are not affected by "retrogression". But unfortunately you are, as we all here are, in countries that do not have a "current" PD so we cannot file 485. Basically thats exactly what this forum is about.

I am having trouble with my employer and the situation could lead to my layoff very soon.
I filed my I485 this July 19, and hence, still have some time before I can use AC21. My I140 is approved and I just received a mail yesterday that mine & spouse's EAD cards are approved and I expect to receive them soon. I have about a months vacation hours accumulated and I wish to use these to search for a new job.
I would appreciate if someone can answer the following questions:
1) Can I use EAD to join some other company at this stage? If yes, I believe the job title & salary has to be in similar conditions.
2) If I leave my present company, would the employer know that they need to withdraw I140 (My management is quite dumb when it comes to these matters but they know that they need to inform USCIS when H1B person is terminated)
Please suggest the best course of action for me. Your help is truly appreciated!
If I were in your shoe, I will explore options where I can go on unpaid leave of absence. For example, some companies allow to take unpaid leave of absence to take certain courses, or to take unpaid leave of absence to go and take care of elder parents, or any sick member of your family. Some of these laws are mandatory to follow. For example in state of NJ by law, you can get upto 12 weeks unpaid leave of absence to support your family members. Just try to find one of those clauses and see if you can invoke one of those. You are just buying time here and the end of such period you can go back and resign from the company. This will maintain you employee status with your employer.
Falling back on H1 may not be a good option for you because you will have restart you GC process.

By outside the box, if you are referring to me and the other member who started this post, here is my rationale:
- It is a good option for those who want to exercise it
- If joining the army or helping the US Defense industry makes an immigrant shameless or bad (for GC or otherwise), that would make thousands of immigrants in this country, very bad people. There is no shortage of scientists from other countries coming here and helping with defense research etc.
- Some people come here for money, some for a better life, some for socio-economic reasons
Reasons are many but the goal is the same. Making this personal and calling people names is petty (as I was called in a previous post by the user agamilka). This is my last post on this subject. I will continue posting on IV though.
As for me joining IV, I have joined as a user, contributed funds, and, made my contact info available to the core team to be considered as a volunteer. Anything else anyone wants from me, send me a PM and we shall take it from there.

my guess is.... it depends on the job requirement & if pg diploma is in the relevant field..... if the job requirement qualification is pg diploma.... then u'r 2 yr. pg diploma will count towards u'r education.... if the job says bachelors.... then u need to have 4 yrs. bachelors.... in which case not sure if u'r pg diploma will be counted towards the 4 yr education requirement.... then u'r 2 yrs experience will be applied towards 1 yr education..... and the remaining 3 yrs. counted as u'r experience..... making it eb3 requirement.....
another thing is.... only experience before joining u'r present employer (who is applying for u'r gc) is counted.... say u'r working for the current employer for 2 yr..... which happen to be the petitioning employer.... in that case u'r 3 yr. experience will counted for the purpose of gc application.....
don't mean to sound -ve..... we eb2's don't like more people applying in our category....:p

NSC I-485 dates have moved back. It was July 30th last month. Its June 08 Now.
