    She does not have any criminal background. Any ideas. Please post if
    you had similar experience

    I think what he's saying is "During finger printing (at the center)" the computer displays "Match Found " after every finger is FP. I'm not sure whether this is same as "MATCH FOUND" in any database. If you are referring to what i'm saying then i doubt you have anything to worry and wait for the actual report.

    Its scary. I thought SAP consultants are just above water. That's a huge number....Just one person knowing 100 guys in SAP each with 7+ years sitting on bench! What is the source of this info? Is that from any networking site or from your company? We had two SAP consultants who were rolled off but they were able to find projects elsewhere.

    Disclaimer: I'm working on SAP Platform as a full time employee of a company supporting in-house SAP implementation.

    In this economy, no field is immune to layoffs. That being said, I know of almost 500 people in JAVA and .net without jobs. That does not mean, we will not find jobs in those fields. It is just the mindset of the people that matters in the end.

    This recession can be a blessing in disguise. You can use this opportunity to learn new skills and position yourselves in the market for the future ,or you can whine about lost opportunities etc and sit and do nothing.

    Like I said, it is all in your minds. If you want to succeed, you can. No matter which field you are in.

    As for as SAP is concerned, demand still outweights shortage.

    Reading the posts on this topic, I feel compelled to briefly describe my experience with the Murthy firm.
    Mine was a unique case. I had joined one univ for a Ph.D. (1999) but quit with a M.S. and went to work on the OPT(2001). Was on the H-1 and later went back on the F-1 for a Ph.D. from another school. On completion, INS refused to give me another OPT for a yr (they gave it to me for 3 weeks!). Lots of back and forth and the final verdict was delivered to me on a Friday of a long weekend around 4.30 pm. I would've been out of status the following week.

    Called up "Murthy" around 5.30 pm and the buzz word "going out of status" fetched me an appt right away with a senior attorney. Things moved with lightning speed and unerring accuracy despite my not being in town for most of that week due to prior commitments and an H-4 was filed on time.

    Meanwhile another univ filed a H1-B for me whilst the H-4 was pending and there was some confusion about this. Finally the INS approved both on the same day and story had a happy ending.

    Point here is, despite the acute deadlines, atypical nature of the case etc. my case was treated perfectly by them. Sure there were some obnoxious characters among those the firm employs to deal with primary contacts with the public but the legal personnel were unfailingly prompt and helpful. IMHO, with people who charge heavily for their time, pointed questions mostly elicit pointed answers. Even those snooty "outer layers" could be penetrated with angular and authoritative communication that carefully avoided repetitive, subjective or diffusive questions.

    Of course, this is not to suggest or even connote that any negative experience anyone might've had was purely a consequence of the individual's approach. However, I'm sure that many will agree that at certain times, many of us have a tendency to get ahead of ourselves.

    Bottom line, my experience with "Murthy" on a rather convoluted case was excellent.

    Hi Guys,
    I am new to this forum and a non technical (law) guy. So, please pardon me for any mistake in words i put together.
    Here I wish to discuss and invite suggestion on a issue, which happened with one of my friend coming from INDIA.

    That guy works for an IT company in INDIA as a software engineer.
    He had B1 Visa with him. He was travelling to Philadelphia for 4 weeks (1st time flier to USA) for assessment (technical) of a new business proposal.

    He was sent to second level scrutiny at the immigration.
    At the second level, he was asked for clients contact (after taking his statement - that he is here for initial assessment), which he did not have, so he gave contact of his company's local (USA) sales manager number, who confirmed to my friends statement (on purpose of visit).
    Immigration office then took client�s contact from sales officer and contacted the client.

    The guy from the client side gave a contradictory statement saying, my friend is there for work (fine tuning and all).

    This led to immediate interrogation of my friend for over hours. he was not allowed to contact\inform anybody. He was not given chance to prove non-guilty.
    he was immediately booked under section 212(a) and 235(b).

    His visa was cancelled and was scheduled to return to INDIA.
    He was kept in a jail cell for 26 hours with no food.
    He wanted one chance to clarify with client on confusion, which was denied.

    After there decision and signature on statement\order, he was allowed two calls (one to local contact and one to family). This was after almost 14 - 16 hours.

    He wasnt treated well there and was not even allowed to move\stand in the cell.

    Now here, I wish to understand, how can we get this order reversed?
    What all actions we can take to repair the things.

    Sorry to hear about your friend. Something similar happend in PHL airport in May.

    My my cousin and 4 of his colleagues arrived in PHL for the first time to one of the Big IT firms. The officer asked for secondary inspection for 1 of the 5 guys and other 4 were waiting outside. The guy was strip searched and asked to confess that he was visiting US for working not for Business trip. Then the officer came out and took the passports from all 4 of them and said that they all be deported. He also addressed all Indians as "Liars" and are here to take the jobs. The officer took the clients phone# and called the client. The client confirmed they are coming for Business purpose will leave within 2 - 3 weeks. After 4 hrs of intense grilling, they all were let go.

    Just wanted to share the story. Things doesn't look nice these days specially in PHL.

    its actually worse than that. Its not even strictly by receipt date, and there is a massive difference between what NSC and TSC are approving. NSC had a couple of 2004 approvals, TSC has done a flood of 2006PDs. The whole system is screwed up! :(


    NSC is much worse it's approving ROW Eb2 from 2007 PDs.

    Don't expect Loo to report this on his show that most of the immigrants are non - EB people because it is a "FACT" and he wants nothing to do with facts.;)

    Well that's why he is against amnesty. He knows most of the illegal immigrants will not be sent back no matter how much he cries. He doesn't want them to become citizens and bring their relatives.

    Just another thought I am not sure that IV had pursued it in the past....
    There hundreds of associations of different immigrant communities from number of different countries (TANA, ATA, etc...)...I am naming just a few from southern India.... they do spend considerable amount of money for their cultural, social activities every year. They normally do have large number of registered immigrant population including citizens and non citizens. Why don't IV can also ask their support in terms of donations, help in activities so on and so forth. After all they and we all need some sort of representation in this country. If those organizations can help these hugely backlogged immigrants one day they can become voting power.. consider long term interests... just thinking out loud...comments welcome.

    I don't see why you are saying it wouldn't help us.
    Spouse & children not being counted towards the cap limit should at least cut the backlog in half.
    Again point 3)Exempt STEM advanced degree graduates who have 3 years of U.S. work experience as a non-immigrant from the numerical limit on employment-based immigrant visas. Does this mean people with MS degree or higher and have been working on H1B in the US in the same field as their degree\research?

    If yes, than that should also help clear the backlog as well. I know of lot of people (including myself) who are in that category and are stuck in the backlog.

    It will not help us too much. It will help STEM .
    But I think we still end up in waiting several
    years. It will be much much better if he had text to increase
    EB visa's for couple of years or recapture unused ones and
    distribute on first come basis...

    If spouse and children are not counted it will cut the waiting
    time by half.....

    But something is better than nothing right ?

    My wife recently got her EAD after we filed our 485 applications. She was previously on H4, so she had an ITIN instead of SSN. When she got her SSN, she wrote to the ITIN unit of IRS notifying them of her SSN. Within 30 days of sending the letter, she received a written confirmation from the IRS that they had updated their records with her new SSN.

    That's a point I have been trying to make for ages now. Let's at least try to get something that won't raise anyone's eyebrows and will help most of the members in this forum. It can't be anything other than the ability to file 485 but "Hitting the Home Run" seems to be the motto here. Let's just wait for the home run then ... which may unfortunately be too late for some of us.

    Its a myth that numbersUSA is amenable to reforming green cards without increasing H1-B. The anti-immigrants will still cause a huge uproar if there is any increase in EB visas. They dont want to see additional immigration period. The only clauses that can possibly get through unscathed are those that do not increase visa numbers - things like filing 485 without a visa number, more mobility with EAD etc. I am starting to believe in this "silver medal" theory that has been doing the rounds on this forum - Last week showed that the anti-immigrants are fervently opposed to even re-capturing visas from past years let alone even a temporary increase in visa numbers. To say we are in for a very tough battle ahead would be an understatement.

    for a h1b transfer without paystub, will it not be an issue, if the candidate was without a paystub for 180 days??? When I was layed off, I was without pay for 3 weeks, at that time, I was told that upto 2 to 3 moths is ok without paystub, and upto 180 days, transfer is given without i 94, but if 180 days is crossed, there maybe issues.

    I don't think there is any USCIS rule that specifies a time-period for which the absence of pay-stubs is OK. This means that it depends on your case and the person handling the case. This has been mentioned repeatedly on the forums.
