Hello there,
I am from Texas. My reciept date for my 485 is August 6, 2007. However, my notice date is Ocotber 3, 2007. when i check the status online it sates something like this.
On October 2, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our TEXAS SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
In Texas they are processing August 2007 for emplyment base 485. So does this mean that mine will get processed since they are doing august or will it get processed in Ocotber since the date of notice in Ocotober. My priority date is not current yet, I am EB3 row and it is July now, mine will hopefully be current next month as mine is august 2005.
also, should that notice message have changed by now. I have friends whose messages have changes to something like, initail processing is done and move to center for processing. I have had my finger prints done in Ocotober, so with the new law passed in Feb, does the name check period starts from the date of finger prints or when the 485 is filed. Either ways, my 6 monts period will be over at the end of April month anyways.

We got turned down. We also asked if we can just pay 20K flat instead of paying these lawyers over and over again (definitely 10K+), but it did not fly :(
You will not get any amendments that will exclude lawyers. Its a very obvious thing. We can suggest paying up on top off what we pay the lawyers; say a fee to expedite the process and that could fly, considering how crunched USCIS is for money. Any thing that will leave lawyer will be a NO SELL.

My 2 cents.... if you are not in hurry, just wait for a week or two more and things should work around. But in case you need it urgently, like I needed police clearance certificate. I emailed every email address I could find on there website asking them return my passport and document by a set date as I am visiting India. I also faxed the same contents. Someone replied to the email asking me to call but no one picked up the phone. However, I got my documents 2 days later. I do not think they are too bad, just that they are overloaded. Someone told me there are like 6 people supporting entire India population under Washington DC.

If you are buying physical gold apmex.com is a good one. I bought from them and even sold it back to them when I wanted to sell it back. They are very reliable and safe.
I also had TOCQUEVILLE GOLD FUND(TGLDX) in my portfolio. I sold it a couple of months back thinking that I have made enough. But then I regret selling it as the price has gone up 15% after I sold it. SPDR Gold Trust(GLD) is also another good one. Please research by yourself if your are investing in gold based bonds.

I am on H1 and my wife on H4. My wife is also an expert in the art of embroidery and handicrafts, she's become quite famous for her artwork locally. A wholesaler has approached us recently expressing his desire to market her handicraft to other indian stores in the area and beyond. I checked up some info on registering an homebased business and they don't ask you to submit an SSN for registering a proprietary bussiness either at state or local level. A federal or state tax-ID doesn't seem to be an requirement for homebased business either. They just ask you to submit a schedule C attachment with your regular 1040 form when you file tax return.
My questions are following ?
1. If I register a homebased business in my name and include it with my personal tax return, what are the possible implications ? Does IRS or the state business office share info with USCIS regarding business registrations or the only way USCIS would know about the business is if they see my tax returns ?
2. Any other alternative/creative ways to handle it ?

Agree: I also strongly suspect that honoring the RD is BS that USCIS is dishing out. I feel they are selecting cases based only on ND and approving them randomly since all their systems, tracking, receipt # seems to be based on ND and not RD. Historically the ND and RD were only a few days away from each other and so it didn't matter - but thats another fight.
I agree. A current PD only means that a case is ready for review/approval, but the case number denotes the ND, and they are going by the case number/ND. That is why ppl with PDs in Dec 05, Jan 06 have gotten I-485 approval ahead of me.... (where is my bottle of xanax.... ;))

The proposal would eliminate the repayment requirement in an existing tax credit for first-time home buyers, and raise the credit to $8,000 from $7,500. This would be applied to all home buyers from Jan 1 2009 to Dec 31 2009. This amount doesn't have to repaid, but you should have payed enough taxes to get the credit. Please do more research to know the fine prints of it.
For people who bought houses (like me), from April 09 2008 to Dec 31 2008, would qualify for $7500 loan, which would we have to pay back starting from 2011 tax year for 15 years for an amount of $500 each year. This is just 0% interest loan.
I am not sure if people who bought houses in 2008 would get anything because i am not sure if the current bill replaces the earlier one or this bill is addition to the older bill. If the older bill still holds good than definately we get $7500 0% loan for 15 years, if not that we don't get anything.

USCIS cannot reject your petition just because the letter was not the exact format. The keypoints are "permanent" & "same/similar job". Looking at your email, the letter provided by your employer should be OK.
If you want, you can attach a letter mentioning the specific clause from AC21, and how you are proving each conditions on that, with your new employment, including the conditions in LC.
In my case, the employer has two separate types of employment categories: 1) Regular Fulltime and 2) Temporary Fulltime. I fall into the Regular Fulltime category. So, I believe the key point of "Permanent" will be satisfied with the wording "Regular Fulltime". This is the standard for my employer and they will only provide this standard letter. I hope, "Regular Fulltime" will suffice. What's your take on this?

Please let me know the risks while using AC21 and thus working on EAD. Can the current employer through which I got EAD create any problem in my I 485 petition if I move to another employer andhow can I make use of AC21? Do I need to contact a lawyer or I can change jobs just like that?

Keep working on H1. Use AP to travel. If AP gets denied when out of the country, go get a visa stamp and return. How does that sound?

I would like to share my experince in this aspect. On Feb 15 '08, I went out side of US. Had valid H1B for which I94 is valid till october 2010.
When I came back using AP, got new I 94 valid till 1 yr( I came here on april 14(2008), Got new I94 number valid till April 13 , 2009.
H1B I94 is no more valid once you enter in to US using AP.
Amendment needs to be filed in order to continue on H1.
Spoke to attorney and told him that I want to continue on H1B. He filed amendment and got New H1B valid till 2011 (for 3 yrs).
This helped me a lot, as I485 is denied erroneously. Filed service motion to get I485 reopened which was done eventually.
Especially when we face this type of situations ( I485 denial etc), valid H1B helps.
