    Hi guys,

    My I140 got denied based on the three year degree we made appeal against the decision but also starting the process all over again.

    I have contacted three attorneys and all of them gave different opinion the new filing, I want to consolidate all thoughts before moving forward with the application.

    Please suggest what would be the best draft for education requirement for degree with math, physics and chemistry.

    Your input is highly appreciated thanks in advance.
    Your degree should match with labour advertisement.
    Eg: If your advertisement containing only bachelor degree, You need to submit 4 years degree from single institute.
    if you have ad like bachelor degree/3 year degree, 4 year degree is not mandatory.

    Since my old employer agreed, I am planning to keep the current attorney who filed 485 as my G-28 rep as is.

    Is it ok/legal to continue with the current attorneyt as is and pay attorney future expenses from my pocket?

    I have no problem with people asking for contribution. But when you ask that against a question someone asked, it means you want contribution in return of your answer. You can only ask money for your suggestion when you are a professional, like a lawyer. Otherwise, do not ask contribution. If you do not know the answer or do not want to answer then simply do not reply. If you so so, your behavior is considered a rude.

    Hi,

    I feel the situation iam in right now, is kind of the one this thread has been started for. I had to explain my situation in details as following as I wanted to be very clear for getting your valuable suggestions.

    I completed masters in US, And have worked on a project and have pay stubs for my employment with my 1st employer from july of 2005 to jan of 2006. then i went for H1-B stamping to mexico and got the visa changed from F-1 to H1-B. Since Feb-2006 2nd week i was off the project, and I was trying for a new employment with an another employer as i wanted to leave my first employer for my own reasons. I have an another pay stub with the above employer from feb-2006 ending till into 2 weeks of march-06. At this time, me being off a project with them, I could not convince my 1st employer to generate pay stubs for me from March-2006 2nd week till April-2006 ending.

    I got finally into a job with my recent(2nd) employer, who has applied for a H1-B visa transfer for me on May 1st of 2006, and I have been working on their payroll till jan-17th of 2007 when my recent contract project has ended.

    All this time, My H1-B visa transfer that was applied on May 10th of 2006 did not get complete. I made a vacation-visit(3 weeks) to India in Aug-2007 and had an new I-94 affixed to my passport. I got a query from USCIS in the month of Sep. 2006 for the missing paystubs with my 1st employer and asking for a supporting letter for the same from my 1st employer. I was able to get a letter from my 1st employer saying i was on a non-paid vacation for the missing pay stub period.
    Just today, Feb-1 of 2007 I got the reply from USCIS for the approval of the H1-B visa transfer but they haven't send me a new I-94 copy. The attorney was even saying my H1B extension has been denied. I am waiting on the fedex copy from her to look in to the actual details from USCIS.

    My attorney has said that I'll have to go out of US and get My visa stamped. She is saying that I am currently out of status and have to get back to status soon. Is this about my status Correct?, But they are not willing to give me a current employment letter with them because Iam not on a project currently with them and they have given me a laid-off letter to me on Jan-17(last day of my recent proj) of 2007. But they were trying for a project for me since then, so that i can be on their payroll again.

    My question is, I see the current employment letter as the very required thing for me to get a visa stamping in the US consulate, But which my current employer is not willing to give....and insisting me to go out of US so that my status doesn't go bad...they are insisting me to leave US next week itself....I've been hear for 5+ years.....feeling tough to imagine this....

    Also I want to know, Am I really out of status? Is this true, even If my 1st employer hasn't cancelled my H1-B visa with them. Also if my 1st employer hasn't cancelled my visa, can I still go back to him, if he accepts me in to their company.......

    The two things: 1) The USCIS decision and 2) My this laid-off(terminated) situation with my current employer happening at the same time has put me into a very tough situation...please advice me......

    today, I've booked the visa appointment date at canada consulate for the next week. But the "current employment letter" is mentioned as the very required document for either the canada visa or for the US visa staming in canada......So iam not sure what to do....please advice me.....

    Iam asking you this question again....If my 1st employer hasn't cancelled my visa with them, can I still go back to him, if he accepts me in to their company.......?

    I did transfer when my 8th yr H1B was pending and 7th yr had expired. Similar situation (but not fired), frustrated with manager who thought I'd never move and could give me all the boring work to do because no one else would do. I managed to find a company who welcomed me, got me transferred and very soon going to start with them.

    Please pm me and I can point you to good lawyers, if you do happen to find new employer and move on, make sure you legally go after the one who got you fired, there are several options for you.

    This yr I need to file jointly. Got married last year and my wife is on H-4. I am told I need to apply for ITIN Number and file via paper only.

    Can someone who has gone through this process shed some light? is this something that can be done by an individual?. I have filed taxes before on paper and via websites.

    My complaint to the Department of Labor worked like a charm. In fact, I setup an appointment with an official from DOL next week. The lady asked me to give a call and ask for the last time, I complied and did ask the employer to send the final paycheck, but they didn't heed; I told them that I have no option but to complain to DOL. The CEO of the company gone bonkers and agreed to send the final paycheck. In fact, she send a personal mail to me saying that the check was already mailed. They are still due 2 more days, which I will pursue eventually. Meanwhile, I sent a mail to the New York Depart of Labor, explaining everything. I am expecting a reply from them on Monday. I will also file a case in small claims court. I will pull their leg as much as I can. They got a "Small business Innovation award" from Amherst Chamber of Commerce. On Monday, I will give a call to them and explain them that how ridiculous it is to give an award to a company that they don't deserve. I have heard stories of some other consultants and how badly the company screwed them. :mad:

    Enough is enough already.

    1. Get a termination letter from you current employer showing the termination date. This letter can be used to prove your intent to join the GC employer, if at all USCIS issues an RFE on your I-485.

    ....

    The most important thing to do right now is to be in legal status by transferring your H-1 on November 1, 2007.

    .....

    If USCIS issues you an RFE on I-485 in the future, asking you for reason for change of jobs < 180 days, then you can respond by attaching the current company's termination letter. This goes to prove that you had the intent to join the GC sponsoring company but business went sour and they had to let you go.


    1. how is getting a termination letter going to save him? If anything it makes things worse (it is written proof that no job exists 180 days past the filing of the 485, hence the I-140/485 is potentially invalid anyway).

    2. if what you are suggesting saves his 485, why do you think he needs to transfer his H1? He will remain in 485-pending state and work on EAD

    3. its not just intent by you to join the company, its also intent by the COMPANY to hire you that drives the GC process. If there is no intent to hire by them, then does'nt the GC process collapse?

    I have lived in OK for 12 years now. I work in Tulsa and commute 140 miles each day. 70 miles takes me only 63 minutes one way at speed limit. Bottom line.....nice place to live and work, less traffic. People are very friendly and decent. Tulsa was recently surveyed as the #1 city in the U.S. for relocation.

    If you have a choice between Tulsa and OKC, I'd go for Tulsa. Tulsa is better planned, newer and easy to get around than OKC.

    Cons: Tornadoes (not many in the Tulsa area though), not great Indian restaurants, not the most exciting place in the U.S. for sightseeing and touristy things.

    plus no one cares for illegality for a kid... i dont remember showing my son's tin to anyone for anything except for taxes...


    If things go good, we are fine at any point. But the way things are here, I don't want to tag him as Illegal just because he does not have SSN. Also don't want to miss any offer for my son just becas he did not have SSN.(Like the tax rebate we got last year as an example).. I thought if I get it this year, I can get back 300 of 340 we paid and get SSN for him making him eligible for future rebates as well :D

    This is obviously a match from previous fingerprinting, unless match was about some unlawful activity.

    Many people how have applied for security clearance will and should get a fingerprint match.

    Donot worry, and actually you cant do anything in this case anyways.

    If you were previously employed in the United States, copies of all pay slips and monthly bank statements for the time you were employed.

    ALL PAY SLIPS??? wow!


    With all these documents, whole packet would weigh at least a ton. :)

    I request all Michigan members to write letters to the Michigan Governor instead of complaining on the forum. As of now there are hardly 30 yeses for writing letters and 18 for the law suit. Considering thousands of visa holders affected it's really sad to see such dismal response ( coming from 800+ registered IV members from MI).

    Complaining on the forums will not change anything. Real-world action is needed to bring about a change in the situation. So please write the letters to Gov. Granholm. Also, please write letters to the President which may provide permanent fix to all your problems if President Bush does recapture through executive order.

    Template for the letter to send to Governor Granholm of Michigan is provided below. Feel free to customize it as you feel right. Please keep in mind that customized letters carry more weight. If you can't do it, that's also fine. Just fill in the blanks and mail it. What do you got to lose by trying? After all , it just costs an envelope and 41 cents stamp.

Though my application for permanent residency has been approved, my case is backlogged in immigration system due to lack of visa numbers.

    I would like to draw your attention to recent rule issued by Secretary of State Ms. Terri Lynn Land to deny driver�s license to residents with temporary visa status, which includes employment immigrants waiting for their green card. This new rule is based on Attorney General Mike Cox�s interpretation of state (opinion no 7210, issued Dec 27, 2007) that that state can provide driving licenses to only �legal and permanent� residents.

    Ms. Land�s decision to deny driving licenses to legal and lawfully admitted immigrants creates a hard situation for us. Thousands of immigrants like me who are engineers, vehicle designers, professors, doctors, and international students in Michigan universities will be affected. It�s impossible for many of us to commute to work, or to school. Many highly-skilled immigrants will be forced to leave the state, and universities will have a tough time in attracting international students.

    Our state has already lost 30,000 residents to recession. It can ill-afford to lose thousands more at a time when the recession is worsening. Scarcity of highly-skilled workers will discourage high-tech companies from moving their jobs to Michigan. This will definitely impact your commendable initiative to attract high-tech companies to open their offices here. Also, sale of homes by several thousand immigrants will lower the home prices further. This will adversely affect the real-estate industry reeling under sub-prime crisis.

    A precedent has been set by the Governor of Tennessee overruling the restrictive state DMV through executive order. I request you to consider our contributions to the state economy, and exercise your executive powers as the Governor of the state to fix the situation by allowing legal residents on temporary visa status to get driver�s license as before.

    This info is posted on the USCIS website. If your application is still at NSC then your info should have been entered, but if it was transferred to TSC then you have to wait

    I know this info from USCIS website. There's no need they should transfer my case to TX as my I-140 was from NSC. Still God knows.. but there's nothing to do with this update. When I called USCIS and mentioned about this updates in their site.. they said they are not aware of this...
