We applied to TCS on July 2nd, and already got our RN, FP notice, and 2 EAD's in the mail. Thus, I think that data provided by USCIS for TCS is not accurate. There is more people on this forum who applied to TCS and are in the same situation as we are.

I am on EB2 with PD dec 2006 and will be filing for 485 and i140 is pending. Being single and marriage date not sure, i may not got much benifitted by EAD/AP. I still have 3 years of h1b. I work for a non profit organization on IT side ..good thing is very secure and very easy to get GC. Bad part is pay not competativ enough with private companies all though good enough to lead a good life in US.
I have got H1b done from a consultancy and now i am the delema to jump to private company or not as i still have 3 years of H1b. But the very fact that i need to go thru al the process of GC again makes me think twice. The fear fo regretting is making me not to take chance as the 485 dates became current. Also i feel i can alaways think of climbing the career ladder after GC. In brief i am bit confused as i have many options.
I would apprecite if you throw suggestions on this situation.
Although eventually i will take the decsion which is good for me.

Coming to the case:
My wife's H4 & I-94 expired on Feb 26th 2007 (Company A). We had applied her extension on May 21st 2007. We couldnt file extension before time as my wife was going thru her pregnancy and child birth. In this process we forgot.
Currently the H4 extension is still pending. When we realised that its too late and thot of sending her to India, we had to wait for approvals our new born son's SSN, US passport, Indian visiting visa and also on the health grounds (vaccinations etc).Now when we got all that, this 485 thing came up which is a big blessing for us.
I have my valid I-797 approval from Comapny B till May'08.
Now for applying 485 for my wife, I heard that we can file under section 245(k) if its still uner 180 days. My wife is still under 180 days. 180th day wud be Aug 23rd. My attorney doesnt have much detailed knowledge about it. Some how I managed to get in touch with her and requested to file under 245(k).
After my long story, Now my questions are :
1. Do we need to explicitly apply under sec 245(k), or if the applicant is out of status her application fall under the 245(k)?
2. If we have to apply under 245(k), what other documents,forms etc do we need?
3. **If my wife's 485 gets filed this week and we get a receipt notice after her 180 days? what wud be the scenario? Does she need to leave the country before 180 days? Can she leave without receipt notice?
4. Assuming my attorney doesnt know how to file under 245(k) and she applies as a normal 485 filing, what wud be the outcome?
These are some of the concerns we both are facing now and having sleepless nites. Can some one pls take some time and advice us. Appreciate it.

180 days is just a guidance. I think its up to the officer handling the case to interpret it. Its always advisable to leave country as soon possible to adjust status. Consult your attorney and file with all kinds of documentation to support your case and hope for the best

My I-140 was approved from TSC but I got AOS Receipt Notice from NSC.
I am in the same situation now. My I-140 is been approved at TSC and my I-485 has been filled at NSC on July 3rd.

The I-140 will not get cancelled by itself, the employer will have to withdraw it, and they will have to do it before 180 days since your I-485 filing. The worst that can happen after your employer cancels your H1 (and does not withdraw I-140), USCIS would ask you to confirm that you still have a job offer, in the RFE. Here is the kicker - if you get to respond AFTER 180 days are through, you can submit a job offer from a different employer. Given how quick USCIS is generally to turn, I would hope that at the very least, you will have enough time to get to 180 days.
Here is the good news - if you have an approved I-140, you will be able to port your priority date to your new green card process. I believe it is true even if the I-140 is withdrawn.

5)So, i may not have Job after Oct 31st from same employer so, I'm trying to find out what are the options available for me.

Answer is obvious. Tell your "friend of friend" ;) never to lie on immigration forms.

Folks , don't flame me because this is a friend of friend info. This person came into USA in around Dec2009, without informing the petitioning employer.He found a job in last few days and approached the employer.His employer is asking him to leave the country and saying he would revoke h1.
This guy wants to report to DOL and get back pay but he will have to misrepresent some information to make his case. If he tells DOL that I came and never informed the employer I am doubting DOL will side with employer. I was advising my friend that a bigger concern is if he lies to make his case and that lie is found out he may be in bigger trouble for lying on official form and supplying false info to a govt official.A am advising that the best would be to either get the matter resolved by negotiation and if the employer doesn't budge, leave the country.
Can some one comment if my doubts are unjustified?
Part II: Will this friend be in trouble ,if he helps the guy with lying and the follow-up process.
Please share your opinion.

this event is nearby (for bay area folks, unlike the DC rally) and is on a weekend too. Why are over 40% of responders not planning to attend? All marshals were mostly local thanks to all, Thanks for arranging the accomodations Dhiren, Thanks to Sukh Praaji for all the hardwork and hauling water, flowers, placards, flags (and unlocking the Johny :)). Thanks to Arun for heading the Marshals and containing the crowd in one lane and for the safe Rally. Thanks to all the localites (Shivkanth and team) who helped out in permits and logistics. Thanks to guys who waited at monument till evening to get the stuff hauled back.
