I also think the last 2 negative clauses, esp wrt to filing I485 even when numbers are retrogressed needs to be fought for. I think a good campaign can convince Sen Specter of these.

This is Specter's markup to Comprehensive Immigration Bill. It tries to consoldiate and bring out one single bill for all the immigration reform bills. This is only a markup and still needs to be discussed on the senate. Despite a PD of May 2007, I was stuck in Atlanta PERM center and couldn't file I-485 last August. My I-140 was filed last October and was approved two months ago. Am I happy that the I-140 is approved? Yes. But I'd trade for the chance of being able to concurrently file any day with my approved 140, even if that means both will be pending for a long time.
As I said before there is no use of filing concurently without approved 140 not even the chance of porting your PD to a new employer which you can obviously do and I am not critical about people who got there 140 apporved. I just want to point TSC's is making its own rules to screw up approval data in the front and not touching 140 files for 350 days. And all the below are useless too

Here's the situation.
My spouse's birth was not registered at the birth. We have been trying to get Non registration of birth certificate from Corporation for past 3 months. First, they were really unapproachable.. After several attempts, my in-laws were asked to submit an application to extract the records of birth along with copy of school leaving certificate and passport bio pages. They did the search, came back and said that they could not find any records for the range of years searched. They suggested to apply for registration of birth certificate and when my in-laws asked about form no 10 for NABC, they says they do not know anything about NABC and will not issue one. I have taken a print out from government website and provided to in-laws to show it to folks at Corporation. But they showed my in-laws a book that they have with various forms that they can issue to public and they do not have a form no. 10 in it for issuing NABC. They also said that they cannot follow what is on the website as when administration change, the information on website also change :D. He asked us to show him how does it look like? Now, I have no clue how does it look like nor does my in-laws who are trying to get this done from Corporation.
They says we will have to get the Birth registered, since its beyond 1 year from date of birth, it will have to go through a different route via office of RDO and may take about an year to issue one.
All this information was provided only after following their internal procedure :);), you know what I mean. I read a lot of posts from members who got NABC on this forum. Can some one who already got NABC please provide some information on the procedure to follow.

O Ya! It will screw your GC process. Once your Canada immigration is done, Canadians will put a stamp on both cheeks of your buttock...saying..."immigrated to Canada"!
Coming back to US GC, before issuing GC, US immigration officer will ask you to come to local USCIS office and they will have a good look on your buttock! If you find that Canadians stamped your buttock then you will have to take shower with either LUX or HAMAAM soap to get rid of that stamp right at USCIS office.

Yes, I would highly recommend IV members to meet with their legislators.
1. We are letting them know that legal immigrants have our own problems too, and its just not always about amnesty or border security when it comes to Immigration reform.
2. When we go and meet with them, we realize how much or how little the legislators office know about our problem - which goes to show that if they don't know a problem exists, then obviously there cannot be any solutions.
3. We get over the jitters of meeting with the staff members when we talk to them - and when the time comes for us to really push for reform (when the bill is being debated), we can be very confident in our talking points and in how we deliver them. We will know what they ask for and are well prepared.
4. Last but not the least, if we cannot help ourselves, who will?

My name in school, college and passport was First name, Surname and fathers name. When i got my visa i got in the form of first name fathers name. Surname is too hard to pronounce so i middle it as middle name now. All my name structure from last 6 years when i came to USA is first name and last name. I had kept the same format and made my last name to middle name. I did not have any problems yet.
On the top of it. My last name and my dad's last name are both different. So that creates a more confusion.
For canadian immigration they took my name from my certificate so they had took the format First name last name and fathers name.
So i have two names. I have no tensions nor i ever think about it.

Finally I decided to quit this pilot program.
I had been communicating with an Army Recruiter in CA who said that they can take care of MAVNI Program for a month or so. Suddenly my file was transferred to another station. Until now I had no idea what was going on. I asked why and nobody reponded me, even the Commender who is in charge of the whole Southern CA. I guess this is why so many people adviced me to be careful when they knew I am interested in joining the Army.
Acoording to what I was told by another Commander in LA area who I believe is honest, I would like to warn those who are interestedof the Linguist Program (I don't know anything about the medical parts):
(1) There is no such thing to be enlisted as a Linguist. The US has their own Linguist Program and all of the MAVNI enlistees will be assigned or choose MOS based on the ASVAB score. Nobody will be a Linguist via this pilot program (They confirmed this several times)!
(2) For those who have bachelor degree or above, you will be an officer ONLY when you are younger than 29 years old limit. If you are 28 years old in 2009, and you get your citizenship in 2010, then you are no longer eligable to be an officer.
(3) Every enlistee through this program will definitely be deployed to the war, no matter what. Nuless you and your family are ready for this.
When I was told the truth by this Commender, I was stuned for a while and felt like being cheated. My suggest is that do not believe everything the recruiters say. Ask them to put promises in words by writing. This is an advice that an Navy Attorney offered. Good luck, folks! Citizenship is attractive, but nothing is free ...

But I heard that as long as my 485 in not approved before my marriage I should be able to file 485 through CP or AOS. Is that no longer true? Also is there a possibility that a 485 application gets approved if the dates are not current?

It is very highly unlikely that your i-485 will get approved before your marriage (End of Aug) with so much madness going on. Also, they will send finger priniting notice. You can postpone the finger printing notice (even if you cant post pone, just dont show-up for the first notice). This will buy you some time, but like I said before, you cant even expect FP notice anytime soon.

I'm out of the US and got the 485 approval today. Will be traveling back on Saturday - so let's see what happens. I'll provide an update. I have my AP.
Lawyer says there shouldn't be any issues.
Happy to share the news that I received an email saying that "card production ordered" for 485 yesterday. Technically I got greencard approval, but I have not received the card in mail.
However, here comes tough situation along with the good news. I have tix booked to leave to India tomorrow. I'll be return in 3 weeks. Lawyers suggested to go to Infofass in Boston (nearest to where I live) and get my passport stamped with 551. I checked the appointments and there is none available for today. Is there any emergency appointments. There is no phone number available for InfoPass/Boston.
My AP is valid till this December. So can I use it. Lawyer suggests not as there will be intense scrutiny. Horror stories and happy stories shared by friends about friends who were in similar situation.
Does anyone know about this? What are my options. Please advice asap.

Eventhough the salary mentioned is for future job the current pay is one of strong evidence to prove that Employer has the ablity to pay for future job. So, Employer has to pay more than mentioned in the green card application to avoid problem in gc processing
Your current salary has nothing to do with ability to pay issue. It looks like your company's tax returns was not good enough and uscis sees that company cannot pay what they state in labor.
Open MTR and borrow sometime and meanwhile jump to another company and start fresh. If your I-140 is approved, you will get 3 years extension.

Law is always up for interpretation of the judge and lawyers always help interpret to get a benefit to their clients. That is why one can't replace a judge with a computer. That is why I am only insisting that only lawyers take a stab at this question and we not polute this thread with our unnecessary analysis.

Yes it counts a lot. I guess it is for 1-2 years, go for evaluation ASAP. I too have same from private institute plus another diploma of another year. It worked for me.

How about making groups in that rally... Each group will carry their profession related board in front of the group like 'MEDICAL PROFESSIONALS', 'COMPUTER PROFESSIONALS', 'ENGINEERING PROFESSIONALS' etc.,etc.,
