shame on the members who incite intolerance and cast people (members/programmers/lawmakers) in generalities. Stop this nonsense.
The point is we have to make the lawmakers actually see our perspective. The first time I go to the lawmaker office, I meet the aide, the second time - the aide and since I have been visiting them often, the aide knows me well - and talks to me about the politics in DC. By itself, its not a great task/achievement. However, I know for a fact that I am getting through to them. Still, all my effort is just a drop of water in the ocean (like i said elsewhere on the forum).
See if you can be inspired to commit to meeting with your senators regularly?

If one has an approved I-140 in EB 2 from current employer, can another Employer capture this PD to file a new EB-3 in PERM

It is not "C" but it is a similar company (top 50 in DQ list).
I am still negotiating on GC and they are checking with their legal team. I have decided that I will take the offer only if they agree they will start GC on day 1 of my joining. Otherwise, I am hopeful of getting EAD in the next 2-3 years.

I am starting this thread to discuss why/why not USA need Illegal immigrants more than Legal immigtants. I want to see why one group should be favored over the other group from an American prespective.
Some of my observations:
Illegals are seen as
Law breakers, Will do the dirty work that americans will not do, will work for less than minimum wage, exploited, harassed, 12 million in number and so need support.
Legals are seen as
Take away american jobs, make more money than illegals, will bring down white collar wages down and so on and do not need support.
The above sentiments may drive what is happening in the Congress.
Your Comments? Observations?

My spouse has received EAD and she plans to apply for the SSN. In the meanwhile, my company is extending her H-4. Will she lose her H4 status on applying for SSN? Can she simultaneously apply for H4 extension?

This is one of those grey areas. USCIS has allowed self porting provided all conditions are satisfied. There are some old posts on Rajiv Khanna's forum, but a fresh discussion always helps.
If anyone can write a detailed blog - it will be helpful to fellow IVans.
In this challenging job market, a lot of people maybe wanting to self port and work on contracting assignments till companies have enough budgets to hire permanent employees.

Essentially if the I-140 has been approved, the new company has to get the name changed on the I-140 app. Still would like to hear from someone who has been thru this.
Also the question of going to a new employer under these conditions still remains? Please advise.

Thanks so much for your response. As we all know thats after after aug 17th the dates are no longer current say atleast till October(God knows what would happen then!). Having said that do you think its better to go ahead and apply for 485 for me alone as we can add AOS to spouse when dates are current.(I am just looking for a good advise.)
My only thought is can my 485 be approved when the dates are not current.

Couple of months ago, I moved from TX to FL. My wife and I was issued temporary license with validity of one year. However, in Texas I had full blown license, just like US citizens, with validity of six years.
I guess I will have to live with yearly renewals :mad:
I am worried since the next renewal will be due in Aug 2010, just few months before my H1B extension in Oct 2010.

Not to mention that companies like Patni ask employees to work 10-14 hours a day.But in reality,these employees are billed only 8 hours a day from their clients.

Nope. Mine also missing that stamp. Other thing is even on the old passport the stamp it used to read like "ECNR Stamp required except for several countries (including the US)". So I think it does not really matter for the people who are in the US.

As long as your I-140 remains pending and your labor certification is not revoked you can port your H-1 to another employer in one year increments. If the I-140 is approved, you can get a 3 year H-1 extension, and as long as you continue to work in the same or similar occupation, you will eventually get permanent status.
However, if the I-140 is denied and/or the LC is revoked, your long pending I-485 will be denied and no further H extensions will be granted.
At this point, it would be prudent to seek another employer willing to pursue a labor cert. and I-140 on your behalf as soon as possible.

My question is, does this bill contain a recapture visa bill? And if this bill moves fast to become law, will it be implemented right away? I hope we don't have to wait another year for the law to be put in to use.
Please advise.
They are just placeholder as of now. Wait for actul text to come. Even it may changed during hearing in sub and full commitee. Also on house floor too.
But as every one is positive, there will be some kind of relief for us. Dont know how. They may scrap EB system ( again not good for us who is in line but may be good for new applicants ) . Just giving some more query. I guess, I can get h1b visa approved based on job letter, before the residency ends. But, after getting h1b approved for new employer, I can't start that job untill next 1 1/2 to 2 months. And as far as my understanding is,, you are out of status if you are not doing your job, even if you have h1b approval. since, you are not on payroll of new employment for 2 months. is it allowed or not?:confused:
