How far can someone go in time and sue somebody for an accident. 18 months seems to long to discover what they claim.....

There is a difference between H1B Visa/AP and I797/EAD.
The first one is a travel document. That is all it is good for.
The second one is for employability proof. That is all this one is good for.

So... if you are working on a H1 (I797), going out of the country and returning by using AP will not make you lose your H1 as long as you continue to work full time for the sponsoring company.
As far as the company is concerned, your work eligibility status is based on what you provide to them when you fill out the I9 form.

Where do you get this from? In original proposal it was 45 days to file I-140, after that day labor just dies. Company can request substitution only before labor approval.

I read about your intense desire for GC and was thinking to myself... is GC something that someone has to be so very obsessed about? But after reading about your ordeal on this thread, I am starting to see why this is such a joyful time you in you life. Congrats!!! This is a standing testimonial of the kind of negative impact this broken, fu**ed up immigration system brings to the life of individuals. Core IV team, I think we should package this person's story and use it as an example of how bad things can get in this system and publicize this incident. Maybe mail his story to all the incoming senators and house reps and make them see the kind of shit every single person undergoes in this system. This almost makes Abu Gharib prison system look like a Christmas fete ... atleast they KNOW the kind of crap they will have to endure each day. With the US immigration system, you never know what they will hit you with next.

lots of EB3 qualify for EB-2 after such a long wait and in the first case they were put into eb3 although they could have gone to eb2...
I cant believe that EB-3 is at 2001 when we are getting to 2009..its really a shame on the system
if this is how they treat people the entire h1b needs to be scrapped or people spend thier decades in slavery working this unpredictable system thinking that they will get in next few months..its like chasing a mirage in the desert....

USCIS does not consider backlogs / pending cases as "pending" in case there are no visas available or FBI checks are pending
( such as EB2 and EB3 India at this time )
The numbers shown in this report seems to be OF cases which are yet to be adjudicated and NOT the cases which have been already pre- adjudicated are dumped in their cold-store because there are no visas available.

2006 PD filers dont worry abt spouse 485. Your PD would become available only after couple of years. My PD is Sept 2005 and I dont anticipate to get my GC within 2yrs. For reference look at the PERM data that is published, you would get a good idea.

An accident is an accident. It was on a public road and you were within speed limit. If someone does not want to get hurt they should sit at home their whole life and pray that the roof does not drop on them.

On a different note, you can file claims till 24 months after the accident and if any of the victims are minor, they can file a claim(medical/emotional blah blah) till they turn 18(if I remember correctly).
