Took an info pass and the officer told mine is stuck in name check. My name check is initiated for name check on mid of October 2007 . I can wait for GC. All I am worried is that because of me my husband's GC should not be denied.:mad:

Your current salary has nothing to do with ability to pay issue. It looks like your company's tax returns was not good enough and uscis sees that company cannot pay what they state in labor.

Here is my situation. eb3 labor/gc process started in dec 02.
married in 2005. applied for 485 in june 07.
wife has been in depression since march, and recently psychotherapy sessions have revealed that its a case of "hidden personality". she is not interested in marraige/family life and wants to pursue a strong career and be independent. Since she has had a previous "self mutilation" incident in life, psychiatrist is advising me to let her go or she could spiral down more into something more disastrous.
problem is, her family is not ready to accept this and they just pushing her to rethink, make it work etc. so wife doent want to go back and wants to continue to live & make career in US. Due to difficulties with getting H1 nowadays, im ok with keeping her dependent till GC comes and then think of legal seperation (divorce in india / US -whatever is needed). Since she seeks independence she is guilty to take my gc, and i think she will try her best to get herself a h1 next year. but i dont know where this will end.
after GC, if there is seperation will derivative spouse get to keep her GC? is there some standard "soaking" period during which she cannot untie the relation. ?

I am not a lawyer so treat my advice as based on only heresay. I am not aware of any such soaking period for a derivative spouse in an employment-based GC. I do know for a fact that such a soaking period exists when a non-US citizen gets a GC by marrying a US citizen...you have to show matrimonial ties, bank accounts, etc for two years or so to prove that the marriage is not only for green card.
In any case, you should get others' opinions as well, but finally make a decision based on what a qualified attorney says.
On a personal note, realize that it could take several years to get a GC, so the decision to stay together just for a GC should be made with a sound mind. You want to do whatever is best for the two of you.

This website is great help to people who are in the queue of employment based immigration.
I apologies if my answer misguided any one.
I asked my lawyer specific regarding the fees about EAD and AP as I have filed with new fee structure and lawyer replied with confidence you have to pay fees...it was free only for first time.
We have just sent the applications in last week with fees....we are still waiting for receipts. Hope USCIS is not going to encash my checks I will update this thread later with what USCIS did with my checks.
This is lesson for me to not trust lawyar all the time.

Hi,
I am currently located in Dallas. My passport is damaged so I have to apply for a duplicate passport. I have a valid L1-B visa and also I-94. Do I have to apply separately for visa or it will automatically get stamped at the time of creating new passport? Also do I have to apply for I-94 as well. can you please help me in this regards. Friends,
According to USCIS guidelines we do not have to send any originals except a few like employment letter, I-134, Medical Report etc, but definitely not I-140 is my understanding.
HOPE_GC_SOON is right regarding A#. not all I-140 approvals have A#.
So please double check before sending any originals.

Please call him and thank him over the phone guys. Don't count on just the lobbyist to guide him. We're a grass root org and we need to do what we've to do.
Btw, Senator used to have Tuesday Tea party in Dallas. (http://cornyn.senate.gov/index.asp?f=page&pid=17&lid=1 ) This is open to anyone, you've to mail in advance and confirm your appointment. I think it'll start again next year. Some of us should go there when it opens up and thank him and show our support.
I'm planning to attend next year. Let me know if any1 else is interested.

Your definition includes, IBM, SAP... you name it, any consulting company. They all place people in clients place and make lot of money. IT Projects work that way. I am not sure how much experience you have, but with over 12 years in this industry, I can tell you that is the way business works globally. So if IBM bills 150 per hour and gives you 80K per anum. You don't complain, but if a desi startup bills 80 per hour and works hard to give you 75K, you make all these stories?? I know lot of Citizens work with many layers to get their pie. Stop whining about all these. These are all people playing by rules and creating jobs.

II agree, I had been to DC Consular few years back and was surprised to find that they still use Rotary Phones that apart staff especially the ladies on the counter were rude, infact the folks on the railway reservation counter in India are more courteous. I am surprised what impressions citizens of other countries get when they apply for VISA, after all that is their first experience of the country they are visiting- India, a country that boost of having specialized in customer service for the world through its call centers and IT enabled services.

I think instead of discussing the video and giving them more viewership, can you all please make your own videos and post them on the internet. It is very simple. I have heard You can even make a powerpoint presentation and convert it to a video file and post it. Other tech members in the group can help with more information.
If you need help, start a thread and collect people together and make few videos and post them on youtube, google etc. Only then our efforts will be useful.

Just take the Original Approved EAD Notice to SS department and fill up the forms. They will give it to you. I did it for my son last year who was 9 years and got his SS card with in 10 days.
You can not apply on line as they need to verify the original approved EAD notice.

It will not be a problem. The only headache you will have is that you will have to be answering "yes" on questions like "have you ever been arrested" and submit court documents. And you will have to be doing it each time you submit any paper to USCIS. Also forget about interview waiver. Other than that - you shouldn't have any problem as case was dismissed.
