If USCIS goes to Ex-employer they can say anything. They can say we had a agreement ( though a Void one )with this fellow that he will be my chained slave( sorry for the word but that's how some employers expect you to be) for next 5 years and he ditched us using a EAD ....
USCIS should directly come to me/petitoner or the petitioner's approved attorney (as in G28) and ask for a FUTURE employment proof again as an RFE... The above should never happen...
Could you please tell a little more detail on this - Did USCIS send an RFE to Ex-employers attorney ( because his/her name in mentioned in G28) and that attorney in turn queried Ex-employer about this Particular Guy ??

Is there a difference between biometric and FP appointment? How to find out? Also, what immigration papers are required? For filling out the forms, what kind of information is required? Will I have to take all my old immigration related papers?
Code 1 is FP, code 3 is biometrics. I dont know about code 2.It should be on your appointment notice.
Passport, current visa approval (for legal status) as a precaution, application receipt based on which FP is requested, DL or state ID if it is there, appointment notice.
for filling out names, if I remember right (2 years since), apart from your routine details, your background, full expansion of initials or name as in passport, short forms of the name you might have used, signature etc. Nothing that needs preparation or documentation.

Incorrect. 1 and 2 cannot be filed separately. They MUST be mailed in together to IRS. This is a very common mistake everyone makes, and it ends up denying their ITIN application and delaying their refund.

If we cannot come up with few reasons why this act is bad for American how can we expect the joint House-Senate committee to take any action against it?
FYI - the Senate just passed the bill; as far as I can tell, it has the H-1B ban. Now its up to the joint committee.

Most people say the Labour Certification process is pretty straight forward and the DOL doesn't raise queries about programming skills.
I am wondering whether my lawyer did sent enough documents to the DOL or not.
I am about to enter my 6th year on H1, so time is very critical for me.
I would really appreciate your inputs. Your inputs will definitely help me for answering back the DOL letter.
Getting certifications, couse syllabuses and letters from your former professors will definitely help.

FYI
Most insurance companies cover the immunization and test part of the USCIS medical exam.
When finished with the Dr.'s office don't forget to take the receipt and then file for insurance claim.
We did ours in Jan 2004 when we filed our I485. It took me another 6 months to go through the insurance claims and few follow ups with the Dr.'s office and the insurance company. But I did get 350+350 = $700 refund that was useful to file for repeated AP and EADs.
May be you can donate it to IV if you get the money back from insurance company since you learned that here at IV. Actually you should donate that to IV.

My I-140 is approved, and I filed I-485 in July. Now, My company got acquired by another one. Old company no longer exist.
Can new company revoke I-140 filed by the old company?

Personally I faced this problem, employer has the right to revoke the I-140 before approval, also there is a fair chance that he does not respond to RFE which will land u in trouble.
Ideally I suggest you to stop thinking on the idea of not moving before your I-140 clears. Don't say that you cannot survive there, you NEED TO HAVE PATIECENCE, WHICH IS LAGGING IN EVERY HUMAN BEING NOW A DAYS. Also I would say IT IS BETTER TO DEAL WITH KNOWN DEVIL THAN UNKNOWN ANGEL. There is one another say all land look green from distance. So my brother please be patient, you are not gonna earn the whole economy by moving to a new employer. I myself have personally experienced this and also I know both sides of the coin. Every one thinks that these Employers are sucking but they have their own problems. After reading this every one will bang me I know but what I want to say is every one should be patient I mean infact ur employers also.
I understand that you are going through lot of pain, so it be until you clear your I-140. Trust me you will be in good hands once you cross this.

this bill is not yet dead guys. Dont think Kennedy and friends are going to give up on a potential 20million vote bank so easily. this will be back... Also, the final vote was apparently 46-50. So in the course of a few hours more than a dozen senators changed their vote! This can only be more encouraging for supporters of the bill, they are almost there...

Same day action is a good idea. Thousands of big boxes landing in their office same day will wake up the sleeping Congressmen. We can also alert the media to the event, so that they can film and air the distribution (like Flower campaign). Even if they don't care for us, they do care about their media image ! They don't want to be seen uncaring of their constituents.

I-797 is printed on the official US gov paper. H1B is the property of the employer although you are entitled to get a copy from the employer. And employer's (usually) have no interest to hold on to the originals....they usually send it to the recipient....if the employer is holding it, something is not right there....smell fishy!!!

I am traveling to Japan for business and then I am going to Africa for vacation. Can I go directly from Japan to Africa or do I need to come back to US, get my AP stamped and then go from US to Africa? I have an AP.
Also are there any risks associated with traveling for vacation on AP?
