This is in reference to a thread about feeling depressed by retrogression or labor backlogs to stuck FBI namechecks or whatever it is that depresses you. Not criticizing anyone in particular so dont aim for me.
Yes, and a lot of people know that there are highly skilled people who are depressed and that takes a toll on employee productivity.
After all, if 90% of your time is spent on thinking about BECs and visa bulletins, imagine if that time was spent on doing the job they've hired you for.
Some employers(like Microsoft) realize this and want to do something about it. Its not just about keeping the best and brightest here in USA. Its also about keeping the morale and productivity up.
As to how to deal with this...try this.
Call your local congressman's office(Find out info about that from House.gov, with your zipcode). Get an appointment with congressman. There is an Easter recess coming up when they would be back from DC.
Then talk to him about all issues you have. Take all the material you need from the "Volunteer" menu item of this website.
Doing something about the problem is the best therapy there is. I am not saying this because I want to coax you into meeting your congressman. No. That's not the objective. But I think action is the best remedy for this problem. And there is actionable stuff to do about this. If you are suffering from terminal cancer, then you really cant do anything about that. This is not such a problem. This is a problem for which the solution is out there.
Somehow, after landing in this country, people lose the appetite for risk and adventure. Before they are in here, they would move mountains to score an H1 or an F1. After coming here, they hunker down, heads-under-the-desk kind of approach. What I am talking about is nearly 200 people right now, who have read this post, but havent logged in. They wouldnt log in. They wouldnt give their real email address if they sign up. They would never contribute. WHY? Because they are afraid. That they will be deported. For no reason. Everything we do is legal, including raising funds and spending it on lobbying. But they are afraid. They are also afraid that by talking to congressmen, they will make them mad and the congressman will pick up the phone, call USCIS and then get their 140 cancelled. Yes. People create their own fastasies and become afraid of them..
Yesterday, nearly 2000 Irish illegals went to capitol hill (http://www.ireland.com/newspaper/frontpage/2007/0308/1173121325488.html)and talked to various lawmakers to lobby for CIR and legalization. They were illegals. Yet, the somehow managed to walk into the building where laws of this country are made, talk to people who make the laws that they have broken, go thru Capitol Hill security check, and look into the eye of the lawmaker and talk to them.
However, our community, this is how they behave. Forget about talking to congressman, or contributing money. When they call the core group with a question, they block the caller id can call. Dont disclose their name too. Ask a questions and then quickely hang up. Some of them want to contribute with cash because they are not willing to believe us that we are doing everything legal here and its their right to lobbying and petition the Government for problems.
After paying taxes, after following all immigration laws, after getting all the education in the world to become "Highly skilled", the highly skilled cant bring themselves to stand-up with a straight spine, thump their desk and talk to their lawmaker.
So at the end of the day, if we are depressed that legals dont get attention, then you know where to look for blame : the highly skilled who are highly educated and too afraid because their education and skills make them think too much and analyze too much, and they are afraid all the time.

Oh yeah .. but that is provided I can file my 485 by that time. Given my PD was just May 06, I had NO preparation for 485 filing, wonder how much time gathering up all the required docs takes for this filing :)
Usually everyone has all the documents. The most common missing document is the birth certificate. It has to be in english if not translation is required. Plus, it should match your name is passport exactly. Otherwise, the american gori is always there as backup :) hehe..:D

This data is ambiguous from the USCIS. It very well could represent pending 140 petitions, in which case all the euphoria would turn to shock. We must try to get clarification about this before anything else.
One of the tables there mentions the NIW, that is determined at the 140 level, after that a 485 is a 485 and it goes into the EB2 queue. So when they list that in the breakdown, I suspect if they may be referring to 140s here. Additionally they list either no NIW140 or NIW-based 485s from the NSC. If they are referring to NIW based 485s, this is incorrect, since I am one of those with an approved NIW and pending 485 at the NSC. There are others like me on IV physician forum.
So lets try to get more information about this response. This data does not give the whole story. In a worst case scenario it is indeed pending 140s they have given.

Why
Silicon Valley is the world’s most advanced crucible of innovation, an example that countries all over the world have tried to emulate. The success of Silicon Valley as a global hub of innovation has a lot to do with it being the world’s foremost melting pot of highly skilled immigrants. In San Jose, the heart of Silicon Valley, these highly skilled, legal immigrants who want to continue that tradition of innovation by becoming permanent residents of this country will stage a peaceful protest rally to bring awareness and attention to their issues.
The people gathered at this peaceful walk are already huge contributors to the innovation edge of the US but their potential is still not fully tapped as it is still being hindered by unreasonable delays and bottlenecks in the process of gaining permanent residency (green-card).
With this effort, the skilled, legal immigrant community hopes to create awareness about their predicament and express their anguish and frustration at the reversal and the lack of action from the Government. These are the highly skilled workers who have been driving the innovation in the US for many decades and have been living in this country legally and yet, they feel that their issues, concerns and contributions to the economy have largely gone unnoticed. According to exhaustive research done by Vivek Wadhwa, executive-in-residence at Duke University, if highly skilled immigrants in the U.S. don't have a chance to stay here permanently, would-be entrepreneurs take their skills back to their home countries—where they compete with U.S. companies instead of founding them.
There are 140,000 Green cards allocated for highly-skilled workers and their dependents in a fiscal year (unused visas may not be rolled over to the next year). However, due to over-subscription, thousands of highly-skilled workers, including engineers, scientists, MBAs and health care professionals have been waiting patiently for years in order to be eligible to apply for their Green cards.
Now, these highly-skilled professionals have decided to call attention to the "broken" immigration system in the U.S. for legal immigrants. Earlier this week – the community received widespread attention when hundreds of them sent flowers to the USCIS Director, Emilio Gonzalez. With the San Jose rally, the community of skilled, legal immigrants wants to put focus on people who have abided by the law, played by the rules and ask for a fair treatment and attention to their issues.

here are many other reasons why people get mugged..i understand the concern, but agitating against him is not going to produce anything substantial to the IV cause, you will end up providing free publicity to his show. You time will be better spent if you motivate others to join IV and
work with the congressmen and senators.
There is no way that he is going to change his tune. CNN will not drop him because he brings in $$$'s and according to them he is doing nothing wrong, just playing to his crowd.

Since we are looking for options....Maybe we can help each other grow technically...possibly by the time we get our GC. Then we could start a company, which will have satellite office across the USA. Then get Vinod Khosla to provide Venture Capital.....:) :D
So to start the process of helping.....here is what I can offer....I am Elect Engg grad from IIT, Roorkee, got my MBA from Kansas and have a PMP, which I got in 1999. Last Year I was elected the President for the Local PMI (Project Management Institute) Chapter in Michigan. ......So if any of you need any help on project management or getting a PMP, I could at least guide you what needs to be done. Please send a private email to me and I could help you enhance your skills in Project Management.
I have been waiting for my GC for almost 10 years. During this time I have managed to trust in God. I continued to increase my education and increased my business network during these years, which has helped me increase my "Face Value" in the US Market.
Here are some suggestion...-Try getting involved in Non-Profit organizations in US or India or possibly go help somebody. Trust me there is more to life than Green Card......I remember asking a friend of mine what was his reaction after waiting for GC for 8 years and then getting it.....He did not have a positive answer.
So when GC will come, it will come....Increase your education, give back to society (maybe help some of your old neighbours who do not have a way to get around), maybe you want teach (Free) math or science to a student in your downtown area. When you look around you will see many people are waiting to be touched by you, through the talents that God has given you......
So keep moving...do not sit back....do something.....A small pool of water will become a swamp, since it does not move, while a river which is flowing swiftly will reach its destination...

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. If you need more info on this let me know I have gone through this and waited for almost three years to file for my spouse I resheduled my FP notice in 2004 to get married by the time my wife came retrogression kicked in and waited till June 2007 to file for my wife. Thanks ajmalnasar, for your detailed reply! I am in the same boat. I am filing my i-485 this month and am hoping that I will at least get married on papers this Oct/Nov. The rest of the dhol dhamaka can be done later. I don't want to get married and then have to wait another 5 years to bring in my wifey. My PD is Dec 2003.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. While I was waiting for GC, I finished MBA last year. I have a Masters degree in Comp. Sc. also. It has been 4 1/2 years with no clear indication regarding the LC alone. Hats off to the screwed up concept of BEC. If my LC is not processed in time, I might leave next year.
I am thinking of doing a part time job on H-1B also. If that pans out well, atleast I will forget the pain of GC for a while.

I have seen many of my friends doing H1 for their spouses..... while their spouces have no experience what so ever..... employers help them cook their resumes..... in these cases employee has something to hide.... so they pay
H1 fees, stay on bench for few months......and never complain...
Now a days many companies send people on L1 visa. On L1 you have no choice. If you can't get H1 in April you are slave to the employer.... also with L1 there is no stipulated salary like H1.... so employers pay whatever they feel like and not market rate.....but since many employees have desire to stick around in US and save some Green... pay of their debts in home country.... they stay with same employer without complaining......

Congratulations for having the guts to stick it through. Not that it really matters, but I'm curious as to your occupation. I don't think I have much of an appreciation for how certain fields are magnets for unscrupulous employers like the one you described.
Now it is time to celebrate with family and friends, and get back in physical and mental shape. Make sure to get your citizenship then push hard for changes to the system. That's the light at the end of the tunnel for me, also.
