We, the "aliens".
"Part of my frustration is to hear illegal immigrants called immigrants when I'm called an alien. I'm doing things right, but I'm still called an alien," ... "If I lose my job tomorrow, my reward is a ticket back home." Very true...
Most of my colleagues on L1/H1 visas went back upon completion of their 5/6 year terms, they never applied for GC. Couple of them are right now packing back.
The management of the company (not IT related) bravely decided to replace the "aliens" by american engineers. This proud decision had a disaterous consequence - our international based customers pulled back and found other contractors. Despite of all the money pumped to promote the "american" presence in the company, down-sizing is on its way and closure is on the horizon...
I was stupid enough to decide in 2003 to apply for a GC and to bear all this BS. Now working hard on plan B and waiting for the right moment.

My wife and I will be travelling out of USA to our home country in the first week of August. My employer's attorney will be applying I-140 and I-485 for both of us before we leave the country. My attorney has said that we could travel out of country without jeopardizing the validity of I-485 application as long as it is recived by USCIS prior to leaving the country. Because of a large influx of I-485 applications, USCIS won't be able to issue the receipt notice immediately but will take weeks to issue the receipt nos. However, when they issue the recipt nos, they will use the application receipt date as the date when the application was physically received by them (the day when Fedex or UPS...courier service delivers the applications to them).
We will have to go to US consulate for H1B/H4 stamping and I am a little concerned if we would be able to get VISA stamping. I am in the 8th year of H1B extension? Both of us have I-797 approval notice for H1B/H4 valid until 2008. Has anyone travelled out of country and got the VISA stamps on the passport without any issues?
My attorney says there won't be any problems.

With President Bush in Omaha today pushing for immigration reform, Sen. Ben Nelson, D-Neb., said his approach to immigration reform has more of a chance of becoming law than the Senate version he voted against.
Nelson spoke to reporters during a telephone conference Tuesday.Last month, he voted against a Senate immigration bill that went on to be approved, saying the legislation accomplished nothing and left the borders wide open.
At the time, Nelson said the Senate plan to provide amnesty to millions of illegal immigrants in the United States would ultimately stall.
He said the Senate amnesty plan will allow more than 66 million immigrants into the United States and cost $100 billion.
Nelson has proposed his own bipartisan border security first bill that would strengthen U.S. borders by increasing border patrol agents, increasing detention facilities for those caught crossing the border illegally, adding court resources, building a border barrier, and cracking down on employers who knowingly hire illegal workers.
Nelson said Nebraskans will warmly greet Bush, but said most agree with his position about the importance of securing the border first.
With such a wide gap of agreement between the House and Senate immigration bills, Nelson is not optimistic that a compromise can be reached in conference committee.
But Nelson said his position bridges the gap between the House and Senate bills and could lead to compromise legislation that could pass this year.
He said after first securing the border, lawmakers can then look at solutions concerning the estimated 12 million undocumented immigrants currently in the country, "...instead of cobbling together in the middle of the night an amnesty."
Nelson said there has been some discussion among lawmakers that the House/Senate conference committee on reconciling the House and Senate immigration bills "will never meet."
"If the conference committee doesn't meet, then the two bills are left in limbo because they can't square it," Nelson said.
If an immigration reform package doesn't pass this year, Nelson said, an unsecured border will become even more of a pathway for undocumented immigrants.
"You will have people coming across the border because they have heard comments that others have made that they can't get everybody back," Nelson said. "The result of this, even with the good intentions of my colleagues, is that we'll have more people coming across the border at a larger rate than we have had in the past. That's happening right now."
And Nelson is concerned that will lead to more deaths with people illegally crossing the border in the desert during the heat of summer.
"It is a sad situation and we have to stop this border bleeding," he said. "If we don't do that, the problem will get so big that it will be harder to deal with."

My I140 is approved and now I am filing the I 485/765/131 together based on new developments. Now that all dates are current, are they going to process the application based on July filing date or based on Priority date(labor).
Can please someone confirm that. My attorney says its based on priority date but I just called USCIS information desk and they said that its based on 485 application date.

How can you deposit 401Km money to Ninja Trader, Your employer might offer one of top asset management company not Ninja.
Could you let us know what was your trading capital on which you made 4.25% return last year...
You are mixing two things. Ninja is software for charting. It supports add-on indicators in c# language.
I use Ninja software for making trading decisions for my futures trading account. Also, it helps me making decision to enter and exit Index based funds for 401(k) and IRA accounts.
For futures trading, I use short term chart setups whereas I use long term setups for index direction.
Hope it helps.

If you read my any previous posts and to repeat, there will be no issue to contribute from me or most of us here. We need an action item. Anyone with minimum common knowledge here sees there is no change in dates for the last 6 months, or even last few years. You seem to be a strong supporter of contributions, can you list one action item which we planned to take up in the last or in near future that addresses our concerns of backlogs. Now dont come back and tell me or send me a picture of July 07 campaign or your 12th grade or 10th grade marksheet. We need to be doing things of our interest EVERY single day. I do my job very good.. I know.. but I have to keep doing it everyday if I have to keep it. Similarly unless you put continuous efforts, you wont get continuous results.
If you want a reply to your post from me again, come back with an action item that you see as planned.
You don't contribute for FOIA. You don't want to accept that FOIA will help us. Thats your decision. IV does a lot things both in public and behind the scenes. All of this require money and time. You haven't contributed in past either. You come to IV and write post like these to make yourself feel better thinking you are doing something for your GC process. Fact is you are not helpful yourself. IV is nothing but people like you and me who are in the line for GC.
For a new action I would like you to lead it. You should meet your local law makers. Tell your personal story about the GC struggle. Ask them to bring up recapture and other bills which will help us. Then work with other people on the IV forum as well as in real world to do same.
If you want a reply to your post from me again, come back with an action item that you see as planned.

I think BPC and new case PERM is same, if it is same position then employer has to withdraw the first case as of DOL new FAQ, if it different position then shouldn't have to withdraw the case, possibly audited by the DOL as of above explained rule..... If the case is audited how long it usually take DOL to decide,

I fully second Pappu's comment as the current IV core leadership does not have time/$$ to spend on Citizenhip. Getting GC for all of us has and should be the first priority. Thanks to IV core and many of us fellow volunteers, their effort has paid off as things are moving decently fast for EB2 for now. Hopefully our fellow EB3 friends also see some hope in FY'11. As I was saying in the previous posts, many big corps have not filed for new labors in FY'08, FY'09 which should free up many ROW visas. This should help EB3 in the near future.
I think we need a kind of checklist on this effort to do this in an organized manner.
IV can help on that.
Also, will need to collect the folks who are willing to join.. I am sure there would be a lot.
Need to gather support from other groups like Immi List, Immigration for America, Murthy, etc.

After 5 months they're auditing my PERM application. My attorney just sent me an email. They're not asking for specifics but wants to make sure we advertised the position. Attorney's going to submit a report as to why the applicants weren't hired as well.
