H1b will only be considered valid when its stamped (even if you enter on AP). If you dont have a valid stamped h1b then it will be considered abandoned...H1b is dual intent.
OK, so I could have an H1B approval (I-797) without a stamped H1B and still enter on AP with my H1B status intact ?

Yes, Gapala is right, it depends on the LCA.
Do not rush and get an evaluation done by people offering SPECIAL evaluation done for 3 year Indian degree equating it to 4 year US degree. USCIS do not buy it anymore; it was accepted for EB2 also, but now, not even for EB3!
The charges are very high ~$1500 and rush service $200, though it's all the same all old 300 pages PDF file with find-and-replace done with your name!
So check your LCA carefully and discuss with a qualified attorney.

Lot of birth certificates issued in India sometimes do not have the childs name in it. So USCIS also accepts an affidavit on Indian stamp paper made by your parents. I had submitted that & so far have had no issues.

Hello all:
My dearest friend died in January this year while waiting for his GC which was in final stages. His family had to pack up and return to India. They forwarded their mail to a friend's home.
Couple of weeks back, they received the I-485 approval and the GC by mail. They also got a AR-11 notification for change of address.
Does anyone know if the GC is valid given my friend's death?
Can his family return to US?
His wife has the new GC and kid is a citizen.
Any advise will be appreciated.

May GOD rest his soul in peace and gives his family the strength to bear his loss. As others sugested, get an opinion from an attorney before they make a move.

I spoke to an IO this morning and he says that you don't have to pay any fee in the following two cases:
1) If you have filed under new structure
2) If you have paid $340/$305 once (renewals are free thereon)
my company attorney is also saying that once we pay new fee for EAD ($340), we will not have to pay for renewals (even though we have filed I485 with old fee structure). But I couldn't find any authentic proof of this.

My wife got "match found" error during fingerprinting.
She does not have any criminal background. Any ideas. Please post if
you had similar experience
I think what he's saying is "During finger printing (at the center)" the computer displays "Match Found " after every finger is FP. I'm not sure whether this is same as "MATCH FOUND" in any database. If you are referring to what i'm saying then i doubt you have anything to worry and wait for the actual report.

The real question is:
If they cannot do the filing even properly, should they be handling immigration at all. Should they be governing other people's lives ? Do they deserve salaries from our money ?

Priority Date, is not truly a priority date, as we have experienced, and are still experiencing. When your physical file is reviewed for approval, this date (which is written somewhere in your file) is checked against VB cutoff at that moment. If you are lucky, you are cleared. USCIS system does not have clear data on based on PD's. That's why monthly VB cutoff dates move back and forth purely based on guess work.

How can they do that - may be we should write back to them if this happens with proof of delivery and request for an earlier date based on press statement released by USCIS that they (USCIS) will honor the date that they received the application on. My .02 cents
Interesting thought. I can prove my application was signed for on May 3rd. My receipt date is May 9th, took six days to get from Nebraska to Texas.
Not sure we have any recourse though, we are at their mercy.

I can understand ur frustration - now you have some info on how to deal with them - so you may not want to bad mouth them anymore - as such all these consultaning companies have poor reputation.
The governement knows all these things and how these companies operate - there are thousands of complaints. So just get going on what you have to do. Good luck

What happens if you work you A@@ off, working late hours and weekends and at the end of the month, they get like 20% or 30% of what you make? Isn't that a hitech theft? What about the promises they make when you initially dealt with them?
