I do not think that is the cause anymore. All those people had PDs till Apr 2001. We are past that PD long back.
Yes, I agree that EB3-I is past 245K. Almost all of the retrogression years have gone in getting 245k filers and out of the system. Even then, situation is still grim.
Now this all my estimate….
There are about 10-12 thousand EB3-I I-485 applications for every year since 2002. With 3.5 thousand applications approved every year, it will take 3-4 years to move PD year by an year. To reiterate for every calendar year there will 3-4 months of real movement in PD.
Around June/July 2009 EB3-I will reach around March/April 2002 and then go back to Nov 2001 in October 09.
Hopefully FOIA result will disprove me in +ve way.

I called the Buffalo department of labor(federal). She took all my details and ex-employer details. She said that she will follow up with them and ask them to send the check. Meanwhile, I will try to approach the NY state department of labor.

What should be the Sign date on 485 applications for Priority Dates that are retrogressed in June VB but will be current in the July bulletin. I want to send my application to be received on July 2nd, however this means that I would have to use a sign date of June 30th as USPS is closed on Sunday.

I have my old AP valid till mid-oct... and new AP renewal is pending...I have plans to travel out of country for 3 months...can I Leave the country on Old AP and come back on new one ( assuming my friend will mail the new AP to me)

I went through the same for my wife before we got the GC. According to my lawyer the law says that AP is only valid if approved when you are in US i.e. the date AP is approved you should be in US for it to be valid. But that is by the book. He stated that most commonly you should be OK if AP get approved when you are in India, someone Fedex it to you and you come back using it. In my wife's case it was fortunately approved two days before we left for India as i got the CRIS email but it did not arrive before we left US. The lawyer Fedex it to us in India and she used it to come back.
Please suggest.

Lobbying is not intended as a guarantee. Perhaps you have to use linear and concrete thought in your area of work that has rendered you so rigid in your thought process.
That is not how the legislative process works in America. IV is doing a good job and you pay to have your voice heard, nothing more nothing less. If you feel our cause is just compared to all the other issues in this debate then contribute.
If not just leave and stop whining and just go plan your life for all contingencies.

All marshals were mostly local thanks to all, Thanks for arranging the accomodations Dhiren, Thanks to Sukh Praaji for all the hardwork and hauling water, flowers, placards, flags (and unlocking the Johny :)). Thanks to Arun for heading the Marshals and containing the crowd in one lane and for the safe Rally. Thanks to all the localites (Shivkanth and team) who helped out in permits and logistics. Thanks to guys who waited at monument till evening to get the stuff hauled back.

It was great to see the positive response from staff members of congressmen that we visited, not one of them opposed the idea of reform to this process.
I've had the time of my life at this event. I almost feel guilty for having all the fun that I did in the past three days, and a bit sad to leave my new family. IV simply rocks!!!

I had a similar case.....Make sure you have all documentation of last pay stubs. You should have proof to show gaps in pay stubs, like bank statement.
Tell your current employer to give the money within a defined period of time, otherwise you will be forced to complaint to DOL. This will give him the time to pay you and prevent you from reporting to DOL. Tell him all the documents that you have to report, which will give him proof that you are serious. Also tell that the $3000 of H1 fees that he forced u to pay was also illegal. Make sure you send all this in written format, either email or printed document, with some proof of certified mail.....which will act as proof for your documentation purposes.
Tell him, to pay at least the salary for 2 months, otherwise you will be forced to report. Give him a 2 week notice....make sure you get a bankers check or money order from him...so that you know you received the money.
Also tell him, you need a letter of experience for the period you worked for, along with the money....This will help you for the GC application too in the future.
My ex-employer did the same to me....In a gentle manner, i told him he was doing stuff illegally and made sure all my communication with him was documentated. He gave me my 11k along with letter of experience, exactly the way I drafted it for my GC application, which i used for my 140 application and got approval in 2006.
The key is to keep calm and not get angry. Be stern and give all the details as I have mentioned above to this employer. You will get your money back.

I need to reschedule my appointment date from Delhi to Mumbai. Can you please tell me what is the procedure? I am told that I need to cancel the existing reservation. Does any one have any good experience buying gold bullion? Did you buy physical gold or did you buy the virtual gold (like the one Canadian mint allows).
I am looking for any tips and advise from the experts.

Its a myth that numbersUSA is amenable to reforming green cards without increasing H1-B. The anti-immigrants will still cause a huge uproar if there is any increase in EB visas. They dont want to see additional immigration period. The only clauses that can possibly get through unscathed are those that do not increase visa numbers - things like filing 485 without a visa number, more mobility with EAD etc. I am starting to believe in this "silver medal" theory that has been doing the rounds on this forum - Last week showed that the anti-immigrants are fervently opposed to even re-capturing visas from past years let alone even a temporary increase in visa numbers. To say we are in for a very tough battle ahead would be an understatement.

I think some of the folks seem to agree that this is a good idea but are pessimistic about this becoming reality..I say we should be little more optimistic here..if a congressman thought of having a provision for premium processing for I485 I believe there is hope..I know AILA may not support it but who cares..and why should we care they are here to help us facilitate not to hinder our path to GC..I believe IV foundation it self is based on immigrants trying to help them selves ( .. enough of bhashan) so we should keep this thread alive and ask more people to support this initiative..
